Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). DNxt9or Through further review, several changes were made to the draft permit sent to you on January 13, 2016: I • With the confirmation from the permittee, the treatment facility name has been modified to "Ridge Haven W WTP"; • Electronic Discharge Monitoring Report (eDMR) requirements have been updated. Three main revisions include: 1) Electronic reporting of DMR data is required effective December 21, 2016; 2) Electronic reporting requirements of compliance monitoring data and reports have been added; 3) A section has been added on how to request an electronic reporting waiver. Footnote #1 under Section A. (1.) was revised to state "No later than 264 days from the effective date of this permit, begin submitting discharge monitoring reports electronically using NC DWR's eDMR application system" and Special Condition A. (2.) was updated to reflect the eDMR reporting deadline of December 21, 2016. As identified previously, the draft permit contains the following significant proposed limitations, monitoring and reporting requirements: • The requirement to begin reporting discharge monitoring data electronically no later than 264 days from the effective date of the permit using the NC DWR's Electronic Discharge Monitoring Report (eDMR) intemet application has been included in this NPDES permit. Ridge Haven Inc. can submit monthly Discharge Monitoring Reports by mail until the 264 days expire. Blank Discharge Monitoring Reports can be found on the NC DEQ website at http•//portal ncdenr ora/web/wq/swp/ps/npdes/forms. • The proposed discharge has numeric and/or narrative limitations on flow, BODs, Total suspended solids (TSS), pH, fecal colifonn, total residual chlorine, and floating solids/visible foam. Monitoring requirements include continuous monitoring for flow; weekly monitoring for temperature, BODs, TSS, pH, fecal coliform; twice per week monitoring for total residual chlorine; twice per month monitoring for ammonia -nitrogen, and quarterly monitoring for total nitrogen and total phosphorus. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699- 6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS [G.S. 143-215.1(b)] Federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and program reports and specify that, if a state does not establish a system to receive such submittals, then permittees must submit monitoring data and reports electronically to the Environmental Protection Agency (EPA). The final NPDES Electronic Reporting Rule was adopted and became effective on December 21, 2015. NOTE: This special condition supplements or supersedes the following sections within Part II of this permit (Standard Conditions for NPDES Permits): • Section B. (11.) • Section D. (2.) • Section D. (6.) • Section E. (5.) Signatory Requirements Reporting Records Retention Monitoring Reports 1. Reporting Requirements [Supersedes Section D. (2.) and Section E. (5.) (a)1 Effective December 21, 2016, the permittee shall report discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR) internet application. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data and submit DMRs electronically using the internet. Until such time that the state's eDMR application is compliant with EPA's Cross -Media Electronic Reporting Regulation (CROMERR), permittees will be required to submit all discharge monitoring data to the state electronically using eDMR and will be required to complete the eDMR submission by printing, signing, and submitting one signed original and a copy of the computer printed eDMR to the following address: NC DENR / Division of Water Resources / Water Quality Permitting Section ATTENTION: Central Files 1617 Mail Service Center Raleigh, North Carolina 27699-1617 If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1. 1, 2, 3) or alternative forms approved by the Director. Duplicate signed copies shall be submitted to the mailing address above. See "How to Request a Waiver from Electronic Reporting" section below. Regardless of the submission method, the first DMR is due on the last day of the month following the issuance of the permit or in the case of a new facility, on the last day of the month following the commencement of discharge. Starting on December 21, 2020, the permittee must electronically report the following compliance monitoring data and reports, when applicable: Sewer Overflow/Bypass Event Reports; Pretreatment Program Annual Reports; and Clean Water Act (CWA) Section 316(b) Annual Reports. The permittee may seek an electronic reporting waiver from the Division (see "How to Request a Waiver from Electronic Reporting" section below). Part I, Page 4 of 5 Permit NCO089559 2. How to Request a Waiver from Electronic Reportine The permittee may seek a temporary electronic reporting waiver from the Division. To obtain an electronic reporting waiver, a permittee must first submit an electronic reporting waiver request to the Division. Requests for temporary electronic reporting waivers must be submitted in writing to the Division for written approval at least sixty (60) days prior to the date the facility would be required under this permit to begin submitting monitoring data and reports. The duration of a temporary waiver shall not exceed 5 years and shall thereupon expire. At such time, monitoring data and reports shall be submitted electronically to the Division unless the permittee re -applies for and is granted a new temporary electronic reporting waiver by the Division. Apprpved electronic reporting waivers are not transferrable. Only permittees with an approved reporting waiver request may submit monitoring data and reports on paper to the Division for the period that the approved reporting waiver request is effective. Signatory Requirements [Supplements Section B. (11.) (b) and Supersedes Section B. (11.) (d)l All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part Il, Section B. (11.)(a) or by a duly authorized representative of that person as described in Part II, Section B. (11.)(b). A person, and not a position, must be delegated signatory authority for eDMR reporting purposes. For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user account and login credentials to access the eDMR system. BACKGROUND: Ridge Haven, Inc. (Ridge Haven) operates a summer camp and retreat in Transylvania County, NC. The estimated area developed by the camp is 125 acres, which is reported mainly as woods with steep slope hills. Most of the area is underlain by bedrock and the surficial soil is Ashe-Edneyville complex with a depth up to 30 inches. A majority of the housing units were constructed in the 1980s. They were installed with septic tanks and leach fields. In 2006, a new septic system was installed for Shepherd Hall Cafeteria with a design capability for 200 campers eating 3 meals per day. In the summer of 2014, approximately 500 people were being fed at the dining hall that was designed to feed 200 people. With the expectation of increased business and campers, Ridge Haven is preparing to install an active treatment system with a direct discharge. The proposed design flow is 16,210 GPD from 750 campers at Shepherd Hall Cafeteria, 20 RV sites, four cabins, and 72 campers at primitive camping sites. The flow was based on flow justification using NC 15A NCAC 02T .0114 Wastewater Design Flow Rates. The Permittee proposes to operate the domestic wastewater treatment system continuously. The proposed Outfall 001 will discharge to the Toxaway Creek, a class C-Trout water in the Savannah Basin. TREATMENT PROCESS: The proposed wastewater treatment plant utilizes activated sludge to treat domestic wastewater. Wastewater treatment consists of influent pump station, screening system, aeration system, clarifier, return sludge system, sludge digestion system, effluent disinfection and chlorine removal system, and Fact Sheet Page I post aeration. Prior wastewater entering the collection system, an oil and grease trap will be installed on the kitchen sewer to collect grease. It is assumed that the influent to the treatment plant will be conveyed by gravity sewer and the effluent will be conveyed by pump station and force main. RECEIVING STREAM: • The receiving stream is Toxaway Creek, which is classified C; Trout. • Toxaway Creek is not an impaired stream on the 2014 final 303(d) list. • USGS indicates records from two reports in early 1990s and March 2015 show seven points, in vicinity of proposed discharge point, have annual 7Q 10 that ranges from 0.9 to 2.8 cfs. COMPLIANCE REVIEW: • This is a proposed NEW discharge. No compliance record. PERMIT DEVELOPMENT (for NEW discharge): • SEPA/FONSI Determination The proposed discharge is not subject to SEPA review. • Endangered Species Review It was reported that N.C. Natural Heritage Program concurred that there are no federally -listed endangered or threatened species within the proposed project area. • Local Government Review Transylvania County has completed its review of the application and a completed local government review form was send to the Division with the application. Transylvania County indicated that the plan for proposed facility is consistent with the local ordinance. • DWR Regional Office Review The DWR Asheville Region staff conducted an on -site visit on September 17, 2015. No issues were found during this inspection. • Impaired Waters Review (3.�d) List) The receiving stream is not on the 2014 final 303(d) list. • Water Qualily Modeling Results. The Division has conducted a Level B model for the proposed new discharge at Ridge Haven WWTP. Applying updated USGS flow statistics and secondary standards for BOD5 to the proposed new discharge, and including the existing Wilds WWTP discharge located downstream, the model showed all downstream DO concentrations above 7.63 mg/L. The model showed that the proposed new discharge of 16,210 GPD would have no significant impact on instream DO. • Antidegradation Review Per NC Antidegradation Policy (15A NCAC 213.0201), each applicant for a new/expanding NPDES permit must document an effort to consider non -discharge alternatives pursuant to 15A NCAC 2H.0105(c)(2). The Engineering Alternatives Analysis (EAA) document was submitted as part of the NPDES application package. DWR staff reviewed both the flow justification and the alternative analysis. DWR staff concurred with the projected flow and the engineering alternatives analysis conclusion that a direct discharge to surface water was the most environmentally sound alternative from the reasonably cost-effective options (per 15A NCAC 2H.0105). The 20-year present cost analysis for each alternative is listed below: o Connecting with Wilds WWTP — Wilds WWTP will not accept proposed wastewater o Package Plant and Drip Irrigation System - $1,718,518.00 o Surface Water Direct Discharge - $983,458.00 o Surface Water Direct Discharge (with tertiary filter treatment) - $1,143,487.00 DWR concludes that the proposed discharge will provide public health benefits and social benefits to the community by providing necessary treatment services to accommodate future growth and failing septic systems. Fact Sheet Page 2 Transylvania County Department of public health has completed its review of the application and a confirmation email from Environmental Health Supervisor was send to the Division. Transylvania County indicated that given the shallow soils, steep slopes, large rock outcroppings, and limited available space for the installation of septic tank systems in the areas surrounding the conference center and associated facilities, a wastewater treatment/discharge plant would be the best fit for both current and long-term plans. Among these 7 sites, the winter 7Q10 yields range from 0.64 to about 1.4 cfsm (average approximately 1.0 cfsm). In a similar manner, the average annual discharge yields range from 2.9 to 3.9 cfsm (average approximately 3.4 cfsm). Applying the above winter 7010 and average annual discharge yield ranges to the drainage area (2.96 sgmi) for the point of interest results in a winter 7Q10 discharge estimated in the range from 1.9 to 4.1 cfs (average about 3.0 efs) and average annual discharge estimated in the range from 8.6 to 11.5 cfs (average about 10.1 cfs). No USGS discharge records are likewise known to exist for the point of interest. In the absence of site -specific discharge records sufficient for a low -flow analysis, estimates of low -flow characteristics at ungaged locations are determined by assessing a range in the low -flow yields (expressed as flow per square mile drainage area, of cfsm) at nearby sites where such estimates have previously been determined. A basin delineation completed using the online NC StreamStats application (http://water.usgs.gov/osw/streamstats/north carolina.htmll indicates the drainage area for your point of interest is 2.96 sgmi. For streams in Transylvania County, low -flow characteristics published by the USGS are provided in two reports: (1) The first is a statewide report completed in the early 1990's. It is USGS Water -Supply Paper 2403, "Low -flow characteristics of streams in North Carolina" (Giese and Mason, 1993). An online version of the report is available at htto://Pubs.usgs.gov/wsp/2403/reportpdE The report provides the low -flow characteristics (based on data through 1988) via regional relations and at -site values for sites with drainage basins between 1 and 400 sgmi and not considered or known to be affected by regulation and/or diversions. (2) The second is a newly published statewide report released in March 2015. It is USGS Scientific Investigations Report 2015-5001, "Low - flow characteristics and flow -duration statistics for selected USGS continuous -record streamgaging stations in North Carolina through 2012" (Weaver, 2015). The report is available online at http://pubs.usgs.gov/sir/2015/5001/. The report provides updated low -flow characteristics and flow -duration statistics for 266 active (as of 2012 water year) and discontinued streamgages across the state where a minimum of 10 climatic years discharge records were available for flow analyses. Inspection of both reports indicates the presence of seven nearby selected USGS partial -record sites (5) and continuous -record streamgages (2) in general vicinity of your point of interest on Toxaway Creek where low -flow characteristics have previously been published. Among these 7 sites, the annual 7Q10 yields range from 0.30 to 0.93 cfsm (average approximately 0.72 cfsm). Ina similar manner, the annual 30Q2 yields range from about 0.85 to about 1.7 cfsm (average approximately 1.4 cfsm). Applying the above annual 7010 and 30Q2 yield ranges to the drainage area 2.96 s m' for the point of interest results in an annual 7Q10 discharqe estimated in the range from about 0.9 to about 2.8 cfs (averaqe about 2.1 cfs) and Please note that estimated flows are provided in units of cubic feet per second (cfs). Provide USGS streamflow estimates. The closest know gauging station is "Toxaway River at Lake Toxaway." The reported flows at this station are: 7Q2, 4.9 cfs; 30Q2, 6.6 cfs; 7Q10, 2.3 cfs, and W2Q10 5.0 cfs. This gauging station is within 51/4 miles from the proposed site and has a drainage area of 7.79 square miles. The estimated drainage area up stream of the proposed discharge point on Toxaway Creek is 3.59 square miles. Since direct measurements have not been recorded, we have assumed a direct ratio of discharge areas. Therefore the estimated flows at the discharge point are: 7Q2, 2.25 cfs; 30Q2, 3.04 cfs; and 7Q10, 1.06 cfs. We believe that these flow estimates are accurate enough to establish the flow conditions at the discharge point. 3. Justify the requested wastewater flow in accordance with 15A NCAC 2T.0114. Since the primary wastewater flows are being generated from a dining hall that does not provide multiple courses at meals, we have used the institutional flow quantity of 5 gallons per meal. We have further assumed that 3 meals are provided each day, therefore the use of 15 gallons per person per day is reasonable for this situation. Mr. Bclnick NCDENR May 18, 2015 Page 2 4. Evaluate wastewater disposal alternatives in accordance with the Division's Engineering Alternatives Analysis (EAA). We have been working with Mr. Jim Boyer, Environmental Health Supervisor for Transylvania County Board of Health to provide us with a letter stating that the use of subsurface and drip irrigation systems is not recommended in this area due to the shallow soil cover over bed rock. He has indicated that the requested letter will be sent sometime in June. Further, we did not consider asking the Wilds (the only treatment plant operator within 10 miles) if they would allow us to discharge into their system since the additional load would push them over the 80% capacity limit and would force them into an upgrade situation. For these reasons we have not modified the Preliminary Engineering Report. 5. Even though our direct fees for services does not fully cover the operation and maintenance and capital budget, we have through fund raising, paid off all our debt and have in excess of 90% of the estimated construction cost of the treatment system. Further we have secured a letter of credit from Wells Fargo Bank in the amount of $200,000. We have included a copy of this letter, but for the sake of confidentiality we have only reference it in the PER. Our Board has further required that all of the funds be in place and as well as a budget to cover the operation of the treatment facility. The PER has been modified to show the estimated annual operational costs. We are including a revised copy of the PER that has been modified as noted above. It should account for the costs to operate the wastewater treatment plant over a 5-year permit term. This recurring cost was not provided within the PER. Regarding the Financial Qualifications: The estimate is 350k for the system which includes a 60k contingency. Our current building capital campaign has already raised this amount as our Board required us to do so before we submitted our application. We do not have any debt since 2011. We do have an active 200k line of credit that we have never used. Will that work? I will be glad to send our financial audit showing that we are indeed solvent. We have it for 2013 and will have the 2014 in the next 30 days. All our operations come from our fees. What we meant to express in the application was that we also raise additional funds from our churches and donors for our capital items and scholarships.
