USACE 1) Verify that the culvert will sustain hydrology to the off -site wetland (WA). Please also explain the current conditions of stream (SA) and include any photos you have. Applicant Response: The proposed dissipater pad at Crossing 1 is oriented such that it will continue hydration of down - gradient unimpacted Stream SA and Wetland WA (off -site), based upon a review of field conditions and existing topography. Wetland WA and Stream SA are low quality features that have been affected to their location just outside the road right of way. They have been adversely impacted from clearing debris, etc. from the right of way and nearby former construction of a billboard near where Stream SA leaves the site. The proposed Crossing 1 is located between two existing culverts that has also affected the quality of the features. Photographs documentating conditions of the down -gradient portions of Stream SA and Wetland WA are included as attachments within the updated PCN application and impact drawings. USACE 2) Justification of the proposed road stubbing with zoning requirements with a statement of independent utility from future development on the adjacent property. Applicant Response: The road stub to the adjacent parcel east of the site is a zoning requirement of the site and also requirement for the long term road master plan of the local municipality. The adjacent parcels to the east of the site are not for sale, were not included in the zoning of the site or this project and the applicant has no intentions of purchasing the adjacent parcels for potential future development. It should also be noted that the road is stubbed to the adjacent parcel is stubbed to area that is high ground (i.e. uplands) based upon a review of the topographic map. It is possible should the adjacent property to the east be developed in the future by others, that it could be developed in a manner that road access could be provided wholly from uplands from Highway 801 (an NCDOT throughfare) or Carter Drive (an unmaintained road), thus not requiring use of the proposed road crossing on the site and meeting the USACE independent utility test. However, if an application for development of the property located east to the site should occur and require impacts to streams or wetlands in the future, then the independent utility test combined with the stated purpose and need would be required to determine if cumulative impacts with any future project and those requested herein.
