Dear Mr. DeVries:
RE: Proposed wetland fill at Hanes Mall Blvd site, Winston Salem, NC
Thank you for your letter dated December 18, 2001 (received on January 2, 2002) concerning
permitting fill of approximately 0.028 acres of wetlands on this site. You stated that no written approval from
DWQ was needed if fill is less than one-third acre. This is not necessarily true. First, the US Army Corps of
Engineers will need to confirm the wetland delineation to affirm that only 0.028 acres of jurisdictional wetlands
will be filled. Second, the Corps will need to decide which type of permit could be issued on this site. If that
permit is an Individual Permit or a Nationwide Permit which requires written DWO approval (such as all fill
proposed under Nationwide Permit 18), then application to and written approval from DWO will be required
before you can fill this wetland. Please consult our web site at h2o.enr.state.nc.us/newetlands for details
concerning certification for the various Nationwide Permits.
