1. McGill presented previous conceptual layout plans to show building pad iterations
developed to limit wetland and dwarf flowered heartleaf impacts. It was noted that the
client has had to reduce their site requirements due to existing site constraints. USACE
noted that retaining walls should be investigated as an option to limit wetland/stream
impacts.
2. McGill noted that the project intent is to construct the proposed building pads at Lots 4 &
5 of the RiverStone Business Park to attract commercial or industrial tenants to promote
economic development in Rutherford County. USACE requested that additional
information be provided on prospective tenants or industries being targeted, as well as
economic analysis to support the project.
3. Per USACE and USFWS request, revisions will be made to the Biological Evaluation
submitted to USFWS and resubmitted as a Biological Assessment. The USACE has
requested a historical and cultural assessment be completed by the NC Historic
Preservation Office (NCHPO), which is underway. The Clean Water Act Sections 401
and 404 permitting process has been put on hold until the USACE information requested
above is received, the revised Biological Assessment is submitted, and the NCHPO
assessment is completed.
4. The endangered species assessment for dwarf -flowered heartleaf permitting will require
a 135-day review. USFWS requested that additional information on the dwarf -flowered
heartleaf relocation sites be provided, including photos and an existing vegetative
assessment.
5. USFWS noted that the dwarf -flowered heartleaf flowering season is in March and
relocation in the dormant season (October) is preferable.
6. USFWS requested that site information, including the limits of disturbance, dwarf
flowered heartleaf boundaries, and relocation site boundaries, be provided in a GIS file.

7. USFWS noted that tree clearing may need to work around the Indiana Bat moratorium of
April 1 to October 15. McGill noted that the northern long-eared bat range was not
indicated at this site, so no restrictions for that species apply. It should be noted that
USFWS is scheduled to release updated bat species requirements in April of this year,
so these clearing restrictions and/or dates may change.
