The Town of Clayton offers the following informa�on for the NDMR NOV regarding Frequency Viola�on
of BOD, Ammonia, and TSS for March 2023. The calendar week of this NOV was February 27- March 3;
where the months changed during the week. The NOV was dated January 17, 2024 and received by the
Town on January 25. According to the informa�on from the February NDMR, no reclaim water was
pumped for the en�re month so no sampling data was reported to the State. For the March NDMR,
reclaim water was only pumped on March 8 and 9. In the past, the effluent BOD, Ammonia, and TSS
results for the DMR report had always been used as the sample results for the NDMR. Therefore, we
have the DMR data for February 27-28 we simply did not report it on the NDMR due to not running any
reclaim that month. I believe that is why the eDMR system flagged this as an NOV due to there only
being one sample reported that week. If you would like the Town to revise and/or resubmit the February
NDMR with the appropriate data we can do so. The Town’s response to this NOV in the future is that we
will only submit data on the NDMR report on the days/weeks that reclaim water is discharged. We will
ensure reclaim is discharged enough days throughout the week to ensure sampling frequency
requirements. This will also prevent any further confusion for the eDMR system.
