The project is intended to establish a new NC Division of Water Resources (DWR) mitigation bank in Neuse 01, more specifically Hydrologic Unit Code (HUC) 03020201 (outside Falls Lake watershed). The proposed site would restore riparian buffer within the Lower Little River watershed (HUC 0302020116). Notably, the site lies within a Targeted Resource Area (TRA) for Water Quality, Habitat, and Hydrology, per online data from the NC Division of Mitigation Services (DMS). EXISTING CONDITIONS The site is situated directly north of the intersection of Pikeville-Princeton Road and Capps Bridge Road. Land use within the site’s watershed consists primarily of agricultural row crops and managed timber lands along with sparse residential lots. Current land use within the proposed easement consists of agricultural row crops, most recently seen in hay. The boundaries contain portions of two ditches connected to an unnamed stream. The site collects a small drainage area west of the proposed easement and conveys water east and north to where the stream exits the parcel boundary. From said site terminus, water travels half a mile east to reach Buck Swamp, which ultimately connects to the Neuse River via Mill Creek and Little River. HISTORICAL LAND USE Historical aerials illustrate that land use has not changed significantly over the past 50 years. The attached Google Earth imagery depicts the proposed conservation easement overlaid on historical aerial photographs of the site dating from 1993 to 2023. Older aerials may be obtained upon request. CONSTRAINTS & PERMITS There is no floodplain regulated by FEMA present on the proposed site or immediately outside of the proposed conservation area. Therefore, no floodplain development permit or resulting constraints associated with working within a floodplain are anticipated. There are no other currently known constraints with the site. Jordan Burbage with Eco Terra and Andrew Friedman-Herring with DWR were also present for the site visit. The Division of Water Resources has determined that the features listed as “subject” in the table below and identified on the attached maps are shown on either the most recently published County NRCS Soil Survey of and/or the USGS National Map at a scale that incorporates the National Hydrography Dataset High Resolution data at 1:24,000 scale. In addition, the features listed as “subject” on the below table have been located on the ground at the site and possess characteristics that qualify them to be at least intermittent streams in accordance with the NC Stream Identification Manual v.4.11 and therefore subject to the Nuese Buffer Rules. Please be aware that features identified as “not subject” may be considered jurisdictional according to the US Army Corps of Engineers and subject to the Clean Water Act. The enclosed map(s) depict the feature(s) evaluated and this information is also summarized in the table below. The owner (or future owners) should notify the Division (and other relevant agencies) of this decision in any future correspondence concerning this property. Landowners or affected parties that dispute this determination made by the Division may request a determination by the Director of Water Resources. This determination is final and binding unless an appeal request is made within sixty (60) calendar days of the date of this letter to the Director in writing.
