Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). Please note that your facility is discharging excessively high amounts of total residual chlorine (TRC). The average TRC concentration in the effluent should be below 28 µg/L to protect the stream from acute toxic impacts. This facility discharged an average of 550 µg/L per month in 1999 and 559 µg/L per month in 2000. Unless these concentrations are reduced, the Division may reopen this permit to include a chlorine limit. Several citizens in Chatham County requested a public hearing to discuss Wallace Woodall, Inc. (WWI), listed as a party responsible for disposal of biosolids in Chatham County. Since the citizens raising the issues did not specifically object to your permitted discharge, and since you apparently do not use W`NVI for sludge disposal, the Division is proceeding with reissuance of your permit. Be aware that proper disposal of biosolids is critically important to the Division, and to citizens in your area. The Division expects to hold a separate hearing on the renewal of the WWI permit. You should closely monitor this issue in case changes are required for disposal of biosolids from facilities in Chatham County. Your facility discharges to a nutrient -sensitive water (NSXX-). In 1997 the Clean Water Responsibility Act (House Bill 515) was enacted, with the intent to strengthen the control of nutrients from all discharges to NSW waters. Facilities currently permitted to discharge greater than 500,000 gallons per day, new facilities or facilities expanding above their current permitted capacity will be subject to nutrient limitations for total nitrogen and total phosphorus according to House Bill 515 requirements. Since modifications to treatment systems are expensive and time consuming, it is highly recommended that you begin planning for this possibility now if a future expansion is anticipated at your facility. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). The Sludge Management Plan consists of solids wasted into a sludge holding tank, water removed and returned to process, aeration, and more decanting. When solids inventory becomes too much for productive decanting, Granville Farms is contacted, the sludge is then treated to conform to EPA 503 regulations for PSRP and Vector, depending upon land application method. Granville Farms removes sludge from aerobic digester then applies it to permitted land. Approximately 120,000 gallons of liquid sludge at 1-1.5% solids are removed and applied yearly. An examination of the Cape Fear basin plan and the NPDES permit schedule has revealed that the existing expiration dates in Cape Fear NPDES permits do not coincide with the revised permit expiration dates for the basin. This discrepancy could create unnecessary delays in the processing of over 200 permit renewals. Accordingly, the Division is changing the permit expiration dates for NPDES permits in the Cape Fear river basin. This permit modification changes the expiration date of the subject permit in subbasin 30605 to April 30, 2001. Please find enclosed the revised permit cover page. Insert the new cover page into your permit and discard the old page. All other terms and conditions contained in the original permit remain unchanged and in full effect. Environmental Protection Agency. In accordance with the modification of the permit expiration date, the new due date for your renewal application is November 1, 2000.
