Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly,
we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
This final permit includes no significant changes from the draft permit sent to you on March 16, 2011.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you,
you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this
letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to
obtain other permits which may be required by the Division of Water Quality or permits required by the Division
of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that
may be required.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.
Nature Trail Associates
is hereby authorized to:
1. Continue to operate an existing 0.04 MGD wastewater treatment facility with the following
components:

This facility is located off NCSR 1008 at the Nature Trail UM P WWTP in Chatham County; and
2. Upon receiving an Authorization to Construct from the Division, construct and (after submitting an
engineer's certification form) operate facilities for a design capacity of 0.060 MGD, and
3. Discharge from said treatment works at the location specified on the attached map into Cub Creek
[stream segment 16-41-2-10-(0.5)], a waterbody currently classified WS-IV NSW waters within
subbasin 03-06-05 of the Cape Fear River Basin.

A. (3.) CALCULATION OF TOTAL NITROGEN AND TOTAL PHOSPHORUS LOADS
a. The Permittee shall calculate monthly and annual TN and TP Loads as follows:
i. Monthly TN (or TP) Load (lb/mo) = TN (or TP) x TMF x 8.34
where:
TN (or TP) = th8 average Total Nitrogen or Total Phosphorus concentration
(mg/L) of the composite samples collected during the month
TM = the Total Monthly Flow of wastewater discharged during the
month (MG/mo)
8.34 = conversion factor, from (mg/L x MG) to pounds
ii. Annual TN (or TP) Load (lb/yr) = Sum of the 12 Monthly TN (or TP) Loads for the
calendar year
b. The Permittee shall report monthly Total Nitrogen or Total Phosphorus results (mg/L and Ib/mo)
in the discharge monitoring report for that month and shall report each year's annual results
(lb/yr) in the December report for that year.
A. (3.) PERNIIT RE -OPENER: SUPPLEMENTARY NUTRIENT MONITORING
Pursuant to N.C. General Statutes Section 143-215.1 and the implementing rules found in Title 15A of
the North Carolina Administrative Code, Subchapter 02H, specifically, 15A NCAC 02H.0112(b)(1)
and 0211.0114(a), and Part 11, Sections B.12. and B.13. of this Permit, the Director of DWQ may
reopen this permit to require supplemental nutrient monitoring of the discharge. The additional
monitoring will be to support water quality modeling efforts within the Cape Fear River Basin, and
shall be consistent with a monitoring plan developed jointly by the Division and affected stakeholders.

Most Commonly Used Expedited Language:
• 303(d) language for Draft/Final Cover Letters: "Please note that the receiving stream
is listed as an impaired waterbody on the North Carolina 303(d) Impaired Waters List.
Addressing impaired waters is a high priority with the Division, and instream data will
continue to be evaluated. If there is noncompliance with permitted effluent limits and
stream impairment can be attributed to your facility, then mitigative measures may be
required".
"The facility shall report all effluent TRC values reported by a NC certified laboratory
including field certified. However, effluent values below 50 ug/I will be treated as zero
for compliance purposes."
* Instream data for temperature and dissolved oxygen were examined. Data showed seasonal
variations one would expect to observe in a small stream. Cub Creek exhibits low dissolved
oxygen during the summer months, both upstream and downstream of the discharge. There is no
obvious connection between the discharge and the low D.O. values.

I just spoke with Mandy Hall and she says Nature Trail MHP does not need an assessment condition. Vicki
worked on the Nature Trail write-up and thought Mandy had requested it. Mandy reviewed the file today, as
Vicki is not in the office, and determined that it is not needed.
Sorry for the confusion.
I will scan RRO permit later today and forward the language we are used to seeing in the permit for facility
assessment.

Thank you for the comments you provided.
I'm working on one permit, and wanted to get a bit of clarification on RRO's desires. The one I've got that can probably
move is NCO042357 Nature Trail MHP in Chatham County. Within the attached comments it was stated RRO may want
to see a "facility assessment" regarding 1/I. Forgive my ignorance, but what would a facility assessment condition look
like? I'm guessing it may be a report required within x days providing information on system capabilities and
deficiencies, and plans for improvement where they are deficient. We've required different conditions in permits
before, but I'm not sure I've seen a facility assessment asked for.
Thanks for your help. I'm not trying to hurry anyone, but I'd like to get this one out with our round of public notices that
ends tomorrow afternoon. If I could get a reply before then, that be great.

A few upgrades have been made and this facility acquired a new ORC and since then the plant
seems to be doing better. A "facility assessment" condition specific to identifying Inflow and
Infiltration may be warranted in the permit. Violations occurred in 2009, but no violation issues
noted in 2010.

Staff report. This site will need a few things, more concern is from the stormwater side.

This facility has trouble meeting Fecal limits and the MC blames it on the frogs. This WWTP
does not have enough contact time between chlorine chamber and dechlor chamber. There needs
to be some kind of ROW maintenance done. No clear path to the discharge pipe nor is there a way
to check on the line other than to T.V. it. This line runs a couple of miles to reach the Deep River.
