This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This final permit includes no significant changes from the draft permit sent to you on March 16, 2011. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. The Permittee shall calculate monthly and annual TN and TP Loads as follows: i. Monthly TN (or TP) Load (lb/mo) = TN (or TP) x TMF x 8.34 where: TN (or TP) = th8 average Total Nitrogen or Total Phosphorus concentration (mg/L) of the composite samples collected during the month TM = the Total Monthly Flow of wastewater discharged during the month (MG/mo) 8.34 = conversion factor, from (mg/L x MG) to pounds ii. Annual TN (or TP) Load (lb/yr) = Sum of the 12 Monthly TN (or TP) Loads for the calendar year b. The Permittee shall report monthly Total Nitrogen or Total Phosphorus results (mg/L and Ib/mo) in the discharge monitoring report for that month and shall report each year's annual results (lb/yr) in the December report for that year. A. (3.) PERNIIT RE -OPENER: SUPPLEMENTARY NUTRIENT MONITORING Pursuant to N.C. General Statutes Section 143-215.1 and the implementing rules found in Title 15A of the North Carolina Administrative Code, Subchapter 02H, specifically, 15A NCAC 02H.0112(b)(1) and 0211.0114(a), and Part 11, Sections B.12. and B.13. of this Permit, the Director of DWQ may reopen this permit to require supplemental nutrient monitoring of the discharge. The additional monitoring will be to support water quality modeling efforts within the Cape Fear River Basin, and shall be consistent with a monitoring plan developed jointly by the Division and affected stakeholders. Data showed seasonal variations one would expect to observe in a small stream. Cub Creek exhibits low dissolved oxygen during the summer months, both upstream and downstream of the discharge. There is no obvious connection between the discharge and the low D.O. values. I just spoke with Mandy Hall and she says Nature Trail MHP does not need an assessment condition. Vicki worked on the Nature Trail write-up and thought Mandy had requested it. Mandy reviewed the file today, as Vicki is not in the office, and determined that it is not needed. Sorry for the confusion. I will scan RRO permit later today and forward the language we are used to seeing in the permit for facility assessment. I'm working on one permit, and wanted to get a bit of clarification on RRO's desires. The one I've got that can probably move is NCO042357 Nature Trail MHP in Chatham County. Within the attached comments it was stated RRO may want to see a "facility assessment" regarding 1/I. Forgive my ignorance, but what would a facility assessment condition look like? I'm guessing it may be a report required within x days providing information on system capabilities and deficiencies, and plans for improvement where they are deficient. We've required different conditions in permits before, but I'm not sure I've seen a facility assessment asked for. Thanks for your help. I'm not trying to hurry anyone, but I'd like to get this one out with our round of public notices that ends tomorrow afternoon. If I could get a reply before then, that be great. Bob S.
