Dear Mr. Quick:
Division (DWQ) personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15,
2007 (or as subsequently amended).
Your April 12, 2011 letter to the DWQ requested the following changes to the draft permit:
1. "The Monitoring requirement for flow remains as they are in the existing permit."
a. The Measurement Frequency has been changed to 2/month and the Sample type is
changed to Instantaneous with the duration of the flow also required to be reported
(Footnote 1).
2. "A footnote to require Monitoring only if fluoride is being used as part of the treatment process."
a. Footnote #3 had been be added requiring monitoring only if the permittee backwashes with
fluoridated finish water.
3. "A footnote identical to the existing permit for Aluminum and Iron."
a. Footnote #4 has been added requiring monitoring only if alum is used as part of the
treatment process.
b. The Monitoring requirement for Iron is part of the revised "Water Treatment Strategy
(October 2009) and must remain in your permit.
4. "Remove the requirement to continue monitoring for total phosphorus."
a. The Quarterly Monitoring requirement for Total Nitrogen and Total Phosphorus is part of the
revised - Water Treatment Strategy (October 2009) - which indicates that facilities should
monitor for nutrients if discharging to Nutrient Sensitive waters (NSW). Your facility
discharges to Back Creek classified as C — NSW which requires these two monitoring
requirements in your permit.

All previous NPDES Permits issued to this facility, whether for operation or discharge are
hereby revoked. As of this permit issuance, any previously issued permit bearing this number
is no longer effective. Therefore, the exclusive authority to operate and discharge from this
facility arises under the permit conditions, requirements, terms, and provisions included

1) For Instantaneous flow monitoring the duration of the discharges must be reported.
2) The Division shall consider all effluent TRC values reported below 50 ug/I to be in compliance with the permit.
However, the Permittee shall continue to record and submit all values reported by a North Carolina certified
laboratory (including field certified), even if these values fall below 50 ug/I.
3) Aluminum monitoring is required only if alum is used as part of the treatment process.
4) Parameter should be monitored in conjunction with toxicity test.
5) Fluoride shall be monitored if facility backwashes with fluoridated finish water
6) TN = TKN + NO3-N + NO2-N, where TN is Total Nitrogen, TKN is Total Kjeldahl Nitrogen, and NO3-N and NO2-N
are Nitrate and Nitrite Nitrogen, respectively.
7) Chronic Toxicity Monitoring P/F (Cedodaphnia Dubia) @ 10.87 %, during the months of March, June, September,
and December. See Part I, Condition A. (2.). Further studies will be required to determine the cause of toxicity, if
any. The collection of samples shall coincide with the sampling of other parameters.
There shall be no discharge of floating solids or visible foam in other than trace amounts
All samples collected should be of a representative discharge.

A. (2.) CHRONIC TOXICITY MONITORING (QRTRLY)
The permittee shall conduct uq arterlY chronic toxicity tests using test procedures outlined in the "North
Carolina (Ceriodaphnia Dubia) Chronic Effluent Bioassay Procedure," Revised February 1998, or
subsequent versions.
The effluent concentration defined as treatment two in the procedure document is 10.87 %. The testing shall be
performed as a Ceriodaphnia dubia 7day pass/fail test. The tests will be performed during the months of
March, June, September and December. Effluent sampling for this testing shall be performed at the NPDES
Permitted final effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B.

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no
later than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements performed
in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent
toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the
permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the
facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No
Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Section at
the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, then monthly
monitoring will begin immediately. Upon submission of a valid test, this monthly test requirement will revert to
quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water
Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include
alternate monitoring requirements or limits.
If the Permittee monitors any pollutant more frequently than required by this permit, the results of such
monitoring shall be included in the calculation & reporting of the data submitted on the DMR & all AT Forms
submitted.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls,
shall constitute an invalid test and will require immediate follow-up testing to be completed no later than
the last day of the month following the month of the initial monitoring.

Dear Mr. Guerra:
The City of Graham is in receipt of Draft NPDES Permit No. NCO045292 dated March 16,
2011. After review of the proposed requirements associated with this Draft Permit, the City has
the following comments and requests to the Division of Water Quality/NPDES Unit.
Currently the City is required to monitor flow weekly and estimate the flow of the
effluent. The facility operates a PC-1 Lagoon system that receives flow intermittently only
when the facility backwashes filters, re -washes filters, or removes solids from the
sedimentation basins. The lagoons only discharge in the event they are receiving flow under
these conditions. The draft permit changes this requirement to continuous recorded
monitoring of the effluent. In addition to not having a continuous discharge, the city has
received a cost estimate of $150,000 to install continuous flow monitoring at this facility. In
light of the Governor's Executive Order No. 70 and the City not experiencing any problems
reporting estimated flows, which to my knowledge is not a contaminant, this is a financial
burden the City did not expect, especially during the current economic times when all of our
budgets are strained. The City would request that the monitoring requirements remain as they
are in our existing permit. In the event there is some underlying EPA requirement that exist
and DWQ has no option other than to require this, the City request that DWQ provide a
compliance schedule for engineering, NCDENR plan review and authorization to construct,
construction, etc. of at least 18 to 24 months to comply with this requirement.
The draft permit includes fluoride monitoring which is a requirement of our current
permit. The City has been monitoring fluoride for four (4) years and the results have never
exceeded a value greater than 0.3 mg/L. It is important to note that only two samples resulted
in 0.3 mg/I during this four year period. All other samples analyzed resulted in values of 0.2
mg/L, 0.1 mg/L, or <0.1 mg/L. These are all typical of the natural fluoride levels found in the
Cape Fear River Basin. (Note: The City reported 2.0 mg/L in December of 2010 in error. The
actual result was 0.2 mg/L. An amended DMR to reflect this correction has been submitted to
DWQ/CENTRAL FILES.) The City is planning to discontinue the use of fluoride within the next
12-24 months. Additionally, based on a Position Statement issued by NCDENR/Public Water
Supply Section, the City has reduced the amount of fluoride added to the drinking water from
1.0 mg/L to 0.7 mg/L. (A copy of this Position Statement is enclosed for your review.) The
facility is actually adding less fluoride now than it was the four previous years. Based on
historical laboratory results and this additional information provided, the City requests DWQ
remove the required monitoring for fluoride. In the event that the City discontinues the use of
fluoride, at the very least, the City requests a footnote to require monitoring only if fluoride is
being used as part of the treatment process.
The draft permit requires the facility to monitor for both iron and aluminum. Only one
or the other of these metals will ever be used in the drinking water process. The City requests a
footnote identical to our current permit for these two constituents. The current permit requires
monitoring only if they (iron or aluminum) are used as part of the treatment process.
The City is aware of the concerns both EPA and NCDENR has with the control of
nutrients entering our receiving streams. DWQ required monitoring for total nitrogen and total
phosphorus from this facility in our NPDES Permit dated February 14, 2007. Upon review of the
last four years of data the City has had only three samples with detectible values. The highest
value reported was 0.11 mg/L TP in July, 2008. The majority of the samples analyzed resulted in
values that were reported as < 0.05 mg/L TP. It is apparent that this facility is not contributing a
total phosphorus load to the receiving stream that would cause any concern of nutrient annual
mass loading. The City requests DWQ consider removing the requirement to continue
monitoring for total phosphorus.

First let me apologize as I failed to get the GPS coordinates earlier this week and just thought about it the afternoon. I
went out and shot the point this afternoon but our GIS personnel is out of the office today. I should have this
information the first of the week. (Monday or Tuesday at the latest.)
Thanks for the phone call last week as I believe that effort will help in the issuance of our new permit. Per our
conversation I wish to make the following comments:
,>---The City of graham uses no type of Zinc product or Chloramines prior to backwash and request that no
monitoring be required for these constituents.
!'Based on results of many years of monitoring, I would request that the city be able to discontinue Upstream and
Downstream Monitoring for this outfall.
3. 1 nderstand the reasoning of continuing to monitor for Fluoride, but our results have been negligible for the
st 5 years. Public Water Supply has recently issued new guidance for fluoride which will further lower the
fluoride concentration in the water. Additionally, the city is investigating the possibility of discontinuing adding
fluoride to the drinking water. I would request a footnote for fluoride that requires monitoring only if we are
�--meter.

5. You advised me that we would be required to perform a quarterly WET analysis of our discharge at possibly 90%
concentration. I have been unable to determine the 7Q10 of this receiving stream. I do however request a
much lower concentrations based on the following information. NCDENR requires the city to discharge 5
CFS/day (3.22 MGD)under normal conditions. Even if no discharge is occurring over the spillway this amount is
bypassing the dam to protect the integrity of the creek. Obviously if water is coming over the spillway, there is
an even greater flow in the creek. Our average discharge represents about 7% of the flow assuming no water..is-----
coming over the spillway so in rea ity outage is much lower. Du _ a s te_o#_e ergency (Drought
Conditions) we are allowed to reduce the amount of pass -through flo " 0 2.32 FS/da MGD) which has
not occurred since the drought of 2006-07. Even under these extreme con i ions our discharge represents only
12%of the creek flow. For this reason I would request you revise the WET percent concentration as this clearly
proves our concentration as percent flow is much lower. --
6. If possible I would request that DWQ e-mail me a copy of the preliminary draft permit for a quick review prior to
officially issuing the draft. This would enable me to respond and provide for the permit to be pretty much a
"done deal" when you issue the draft.

In compliance with permitting requirements all applications, reports, or
information submitted to the Director are to be signed by the City Manager or his duly
authorized representative. Additionally regulations state that if a duly authorized
representative is designated, it must be done in writing to the Director by the City
Manager.
By this letter, the City of Graham is notifying the Division of Water Quality that
this authority to sign as "Permittee" is given to the individual holding the position of
Utilities Director. The individual currently in this position is Victor R. Quick. In the
event the position becomes vacant, the City Manager will sign until the position is filled.

RESIDUALS MANAGEMENT PLAN
GRAHAM-MEBANE WATER TREATMENT PLANT
NPDES PERMIT No. NCO045292
The Graham -Mebane Water Treatment Plant uses three 500,000
gallon lagoons to settle and store the periodic discharge of residuals from the
water treatment process. Two lagoons have earthen sides with cement
bottoms and one has cement sides and earthen bottom. The supernatant is
discharged to Back Creek in accordance with our current NPDES Permit.
The Alum residuals are removed at approximate four to six month
intervals. The City has a contract with Synagro, Inc. to remove the residuals
from the lagoons. The residuals are pumped into 6500 gallon tanker trucks
and hauled off to be land applied. The City has its own farm and operates a
land application program in accordance with our Non -Discharge Permit,
WQ0003824. There are currently 89.4 acres permitted for land application.
The Alum Residuals are surface applied and co -mingled on the fields with
the BioSolids generated from the City's Wastewater Treatment Facility in
accordance with the permit restrictions.
A fescue cover crop is maintained on the fields and is harvested and
used for cattle feed. Fields are maintained and crops harvested in
accordance with the permit requirements.
Nutrient and metal loadings and application rates are calculated and
reported in accordance with WQ0003824 requirements.
All land application activities are performed in accordance with the
WQ0003824 Non -Discharge Permit requirements and EPA 40 CFR Part 503
federal regulations.
