Alamance County
Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
In response to your comments regarding the draft permit, the limit for aluminum has been removed and
the monitoring frequency changed to monthly, and the monitoring requirement for ammonia -nitrogen has been
removed from the permit. This permit includes a Total Residual Chlorine limit that will take effect on
September L 2008. If you wish to install dechlorination equipment, the Division has promulgated a simplified
approval process for such projects. Guidance for approval of dechlorination projects may be viewed online at
http://www.nccgLnet/news/ATCoverview.html. You requested the permit limit for Total Residual Chlorine be
increased from 17 µg/L to 28 µg/L; however, due to the stream conditions, the limit must remain at 17 µg/L.
You also requested the monitoring frequency for fluoride be reduced from monthlyto quarterly; however, the
monitoring frequency must remain at monthly. This is to determine if there is any reasonable potential to
exceed the water quality standard for fluoride. After twelve months of collecting data, you may request the
Division review the data and reduce the monitoring if appropriate.
If anyparts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days
following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter
150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail
Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final
and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which maybe required by the Division of Water Quality or permits
required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local

conditions set forth in Parts I, II, III and IV hereof.
This permit shall become effective March 1, 2007.
This permit and authorization to discharge shall expire at midnight on May 31, 2011.

All previous WDES' permits issued to this facility, whether for operation or
discharge are hereby revoked. As of this permit issuance, any previously issued
permit bearing this number is no longer effective. Therefore, the exclusive authority
to operate and discharge from this facility arises under the permit conditions,
requirements, terms, and provisions included herein.
The City of Graham is hereby authorized to:
1. Continue to operate a potable water treatment facility and discharge filter
backwash water.
The facility is located west of Mebane at the Graham / Mebane WTP at 1824 US
Highway 70 in Alamance County.
2. Discharge from said treatment works at the location specified on the attached
map into Back Creek, classified C-NSW waters in the Cape Fear River Basin.

turbidity exceeds these levels due to natural background conditions, the discharge level

A. (2.) PERMIT RE -OPENER: SUPPLEMENTARY NUTRIENT MONITORING
Pursuant to N.C. General Statutes Section 143-215.1 and the implementing rules found in
Title 15A of the North Carolina Administrative Code, Subchapter 02H, specifically 15A
NCAC 02H.0112(b)(1) and 02H.0114(a), and Part II, Sections B.12. and B.13. of this Permit,
the Director of DWQ may reopen this permit to require supplemental nutrient monitoring of
the discharge. The additional monitoring will be to support water quality modeling efforts
within the Cape Fear River Basin, and shall be consistent with a monitoring plan developed
jointly by the Division and affected stakeholders.

Dear Ms. Rust:
I express my gratitude for you and Gil Vinzani taking time out of your schedules
to meet with Mike Carson and myself to discuss various concerns the City of Graham had
with our draft NPDES Permit we received on December 11, 2006. As per your
recommendations this letter will serve as the City's draft permit response and summarize
our meeting discussions.
1. The Draft Permit contained an 88 ug/l weekly average with 2/month sampling
frequency for Aluminum. The City request that the limit be removed and changed
to require 1 /month monitoring only. After discussion, it was decided that while
this is EPA criteria, it is not a North Carolina Stream Standard and this request
would be acceptable to you.
2. A daily maximum Total Residual Chlorine (TRC) of 17 ug/l in the draft is based
on a 7Q 10 of <0.05 cfs (zero flow stream) for Back Creek. The City provides a
continuous release from the Graham -Mebane Lake of 4.96 cfs into Back Creek
prior to the Lagoon effluent discharge. Even during drought conditions, the City
is required to release 2.325 cfs into the stream. The City request that DWQ revisit
the stream flow information and asks for the TRC limit to be increased to 28 ug/l.
Water plant residuals in lagoons contain relatively large amounts of oxidized
manganese. Drinking water plants have compliance issues with the low level
TRC limits due to test method interference caused my manganese. Manganese
reacts with the Total Residual Chlorine DPD reagent and produces false positive
results for chlorine. In our conversation you indicated that DWQ had made an
internal decision not to issue "Notices of Violations" to water plants for TRC
exceedances because of this situation. Indication was made that the State
Laboratory is currently investigating an approved TRC method that would not be
inhibited by manganese. The City request that the Permit language reflect this
DWQ decision related to TRC violations. Additionally, while not part of our
discussion, the City request the compliance date for TRC be 24 months from the
permit effective date instead of the proposed 18 month compliance schedule.
This request is made to allow more time for resolution of the test method issues
facing Water Treatment Plants.
3. Fluoride is only present at concentrations of 0.85 mg/l to 1.1 mg/l in the
backwash water only. Much of the effluent discharge is generated through sludge
removal from the treatment plants sedimentation basins which does not contain
added fluoride. The backwash represents 40 to 50 percent of the total discharge
flow. Fluoride concentrations are expected to be reduced significantly through
dilution. In our conversation, the city requested that the monitoring frequency be
reduced to quarterly to coincide with the additional quarterly nutrient monitoring
that will be required under the new permit.
4. The draft permit requires a monthly monitoring for ammonia nitrogen. Ammonia
was listed in error on our permit renewal application. Ammonia does not come
into contact with the lagoon treatment process. During our meeting, it was
decided that the monitoring requirement for NH3-N be removed from the permit.
5. The additional NPDES Permit Requirements included in the draft permit package
appears to be an older version of the standard boiler plate requirements dated June
20, 2003. The reporting date language is different from the newer May 1, 2006
version. Since the City holds more than one permit, the City requests that the
newer version be used to provide continuity in our monthly reporting.
Additionally, based on previous permits issued for the Water Treatment Plant, the
permit should only include Part II, Standard Conditions for NPDES Permits. Parts
III and IV were included in the draft permit and it appears these pertain to
Wastewater Treatment Plants.

Permit Notes
The City of Graham is requesting renewal of permit NCO045292 for the facility in
Alamance County. A reasonable potential analysis indicated a potential to exceed the
water quality standard for aluminum; therefore, a weekly average limit for aluminum was
included in the permit. Additionally, according to the permit renewal application form,
fluoride and ammonia are added to the system, so monthly monitoring was added to the
permit for total fluoride and ammonia -nitrogen. In accordance with the September 2006
Cape Fear Permitting Strategy, monitoring was included in the permit for total nitrogen
and total phosphorus, and the permit re -opener language was added to the permit.

Dear Mrs. Bryant:
The City of Graham request renewal for NPDES Permit No. NCO045292 for the
operation of alum residuals lagoons at the Graham -Mebane Water Treatment Plant. The
facility has undergone upgrade and expansion since the issuance of the last permit. The
expansion included the installation of an additional 500,000 gallon lagoon for alum
residuals, allowing for a total storage of 1.5 MG. Please find enclosed the following

RESIDUALS MANAGEMENT PLAN
G-MEBANE WATER TREATMENT PLANT

The Graham -Mebane Water Treatment Plant uses three 500,000
gallon lagoons to settle and store the periodic discharge of alum residuals
from the water treatment process. Two lagoons have earthen sides with
cement bottoms and one has cement sides and earthen bottom. The
supernatant is discharged to Back Creek in accordance with our current
NPDES Permit.
The Alum residuals are removed at approximate six month intervals.
The City has a contract with Synagro, Inc. to remove the residuals from the
lagoons. The residuals are pumped into 6500 gallon tanker trucks and
hauled off to be land applied. The City has its own farm and operates a land
application program in accordance with our Non -Discharge Permit,
WQ0003824. There are currently 89.4 acres permitted for land application.
The Alum Residuals are surface applied and co -mingled on the fields with
the BioSolids generated from the City's Wastewater Treatment Facility in
accordance with the permit restrictions.
A fescue cover crop is maintained on the fields and is harvested and
used for cattle feed. Fields are maintained and crops harvested in
accordance with the permit requirements.
Nutrient and metal loadings and application rates are calculated and
reported in accordance with WQ0003824 requirements.
All land application activities are performed in accordance with the
WQ0003824 Non -Discharge Permit requirements and EPA 40 CFR Part 503
federal regulations.
