Southern Oaks Gravity Sewer Outfall - Phase II DWQ Sewer Fast Track Application Submittal
To Whom it May Concern:
Please find enclosed a sewer Fast Track Application package for the Fuquay-Varina Southern Oaks Gravity
Sewer Outfall - Phase II project. The project consists of the installation of approximately 6,600 linear feet
(LF) of 18-inch gravity sewer and 1,380 LF of 12-inch gravity sewer generally parallel to Kenneth Creek from
just north of Phelps West Road to the existing Southern Oaks Pump Station off of Wagstaff Road. The
project also consists of re-routing existing sewer to the new outfall with approximately 40 LF of 8-inch
gravity sewer and 48 LF of 18-inch gravity sewer.
The proposed gravity sewer is to be installed using open -cut and dry bore and jack methods. The project
meets all required setbacks, separations, and all gravity sewer minimum design criteria. When the gravity
sewer is installed the Hwy 42 No. 2 Pump Station will be decommissioned. All above -grade structures and
electrical gear at the pump station will be removed and all below -grade structures at the pump station will
be demolished/filled with No. 57 stone. The existing force main will be flushed/cleaned with water,
abandoned in place, and capped on both ends with grout/flowable fill.
An erosion and sedimentation control plan has been submitted for this project to the NCDEQ Raleigh
Regional Office for review and approval. We anticipate having full approval and an NCG01 Certificate of
Coverage no later than 1/2/2024. A US Army Corp of Engineers (USACOE) NWP 58 notification letter has
been submitted to the USACOE for this project for review and approval. We anticipate having full approval
no later than 1/2/2024. All other required permits (NCDOT encroachments agreements, Duke Energy
encroachment agreements, local floodplain development permits, etc.) will also be acquired no later than
1/2/2024.

FAST TRACK SEWER SYSTEM EXTENSION APPLICATION
Division of Water Resources INSTRUCTIONS FOR FORM: FTA 10-23 & SUPPORTING DOCUMENTATION
This application is for sewer extensions involving gravity sewers, pump stations and force mains, or any combination that has been
certified by a professional engineer and the applicant that the project meets the requirements of IS N AC2T and the Division's
Minimum Design Criteria (Gravin. Sewer & Pumn Stations/Force Mains) and that plans, specifications and supporting documents
have been prepared in accordance with 15A NCAC 2 A NCACp2T.0300 Division policies, and good engineering practices.
While no upfront engineering design documents are required for submittal, in accordance with 15A NCAC 02T .0305(b), design
documents must be prepared prior to submittal of a fast track permit application to the Division. This would include plans, design
calculations, and project specifications referenced in IAA NCAC 02T .0305 and the applicable minimum design criteria. These
documents shall be immediately available upon request by the Division.
Projects that are deemed permitted (do not require a permit from the Division) are explained in 15A 'r�-AC 92T,0.301,
Projects not eligible for review via the fast track process (must be submitted for full technical review):
➢ Projects that do not meet any part of the minimum design criteria (MDC) documents;
➢ Projects that involve more than one variance from the requirements of 15A NCAC 02T;
➢ Pressure sewer systems utilizing simplex septic tank -effluent pumps (STEPs) or simplex grinder pumps;
➢ Simplex STEP or simplex grinder pumps connecting to pressurized systems (e.g. force mains);
➢ Vacuum sewer systems.
General - When submitting an application, please use the following instructions as a checklist in order to ensure all required items are
submitted. Adherence to these instructions and checking the provided boxes will help produce a quicker review time and reduce the
amount of requested additional information. Failure to submit all required items will necessitate additional processing and review
time, and may result in return of the application. Unless otherwise noted, the Applicant shall submit one original and one copy of
the application and supporting documentation.
A. One Original and One Copy (second copy maybe digital) of Application and Supporting Documents
® Required unless otherwise noted. Signatures on original must be "wet ink" or secure digital signatures.
Please do not submit engineering design plans with the application unless specifically requested.
B. Cover Letter/Narrative Description (Required for All Application Packages):
® List all items included in the application package, as well as a brief description of the requested permitting action.
➢ Be specific as to the system type, number of homes served, flow allocation required, etc.
➢ Include the permit number!status of any other required sewer permits (downstream. -upstream)
➢ If necessary for clarity, include attachments to the application form.
C. Application Fee (All New and Modification Application Packages):
® Submit a check or money order in the amount of $600.00, dated no more than 90 days prior to application submittal.
➢ Payable to North Carolina Department of Environmental Quality (\CDEQ)
D. Fast Track Application (Required for All Application Packages, Form FTA 10-23):
® Submit the completed and appropriately executed application.
➢ If necessary for clarity or due to space restrictions, attachments to the application may be made.
❑ If the Applicant Type in Item 1.2 is a corporation or company, provide documentation it is registered for business with the
North C'ao1ina Cr+G1ar - of Stale.
❑ If the Applicant Type in item I.2 is a partnership or d/bia, enclose a copy of the certificate filed with the Register of Deeds in
the county of business.
® The Project Name in Item 11.1 shall be consistent with the project name on the flow acceptance letters, agreements, etc.
® The Professional Engineer's Certification on Page 5 of the application shall be signed, sealed and dated by a North Carolina
licensed Professional. F.ngincer.
® The Applicant's Certification on Page 5 of the application shall be signed in accordance with 15A NCAC 02T .0106{ b1. Per
15A NCAC 02T .0106(c), an alternate person may be designated as the signing official if a delegation letter is provided from
a person who meets the criteria in 15A NCAC 02T .0106(b).

E. Flow Tracking/Acceptance Form (Form: FTSE 10-23) (If Applicable):
® Submit the completed and executed FTSE form from the owners of the downstream sewers and treatment facility.
➢ Multiple forms maybe required where the downstream sewer owner and wastewater treatment facility are different.
➢ The flow acceptance indicated in form FTSE must not expire prior to permit issuance and must be dated less than one year
prior to the application date.
➢ Submittal of this application and form FTSE indicates that owner has adequate capacity and will not violate G.S. 143-215.67(a}.
➢ Intergovernmental agreements or other contracts will not be accepted in lieu of a project -specific FTSE.
F. Site Maps (All Application Packages):
® Submit an 8.5-inch x 1 I -inch color copy of a USGS Topographic Map of sufficient scale to identify the entire project area,
including the closest surface waters.
➢ General location of the project components (gravity sewer, pump stations, & force main)
➢ Downstream connection points and permit number (if known) for the receiving sewer
® Include an aerial location map showing general project area (such as street names or latitude.: longitude) so that Division staff
can easily locate it in the field.
G. Existing Permit (Application Packages for Modifications to an Existing Permit):
❑ Submit a copy of the most recently issued existing permit.
❑ Include a descriptive and clear narrative identifying the previously permitted items to remain in the permit, items to be
added, and/or items to be modified (the application form itself should include only include items to be addedlmodified). The
narrative should also include whether any previously permitted items have been certified.
❑ The narrative should clearly identify the requested permitting action and accurately describe the sewers to be listed in
the final permit.
H. Power Reliability Plan (Required if portable reliability option utilized for Pump Station):
❑ Per 15A NCAc 02T .0305{hy 11, submit documentation of power reliability for pumping stations.
➢ This alternative is only available for average daily flows less than 15,000 gallons per day
➢ It shall be demonstrated to the Division that the portable source is owned or contracted by the applicant and is compatible with
the station. The Division will accept a letter signed by the applicant (see 15A NCAC 02T .0106(b)) or proposed contractor,
stating that "the portable power generation unit or portable, independently -powered pumping units, associated appurtenances
and personnel are available for distribution and operation of this pump station."
➢ If the portable power source or pump is dedicated to multiple pump stations, an evaluation of all the pump stations'
storage capacities and the rotation schedule of the portable power source or pump, including travel timeframes, shall
be provided in the case of a multiple station power outage. (Required at time of certification)
I. Certificate of Public Convenience and Necessity (All Application Packages for Privately -Owned Public Utilities):

On September 10, 2001, the Division of Water Quality Non Discharge Permitting Unit received your
flow reduction request for future and present, but not yet tributary, single-family dwellings in the Town of
Fuquay-Varina. The letter requests approval of a residential flow value of 220 GPD/residence for these
dwellings.
The information provided water use information for 2000 and actual daily waste water flow recordings
for their peak month of May. Other supporting data was provided. The evaluation covered 90 homes that are
representative of the subdivisions in Fuquay-Varina in accordance with 15A NCAC 211.0219(l)(3).
Based on the information submitted, the Division hereby approves the use of 75 GPD per bedroom
per dwelling for residential units (225 GPD per three bedroom home) in all applicable non -discharge permit
applications for future sewer line extensions and present, but not yet tributary projects for the Town of Fuquay-
Varina. The Division did note that the average flow per residence in February 2000 was 271 GPD. Regardless
of the adiusted design dailv wastewater flow rate, at no time shali the wastewater flows exceed the effluent
limits defined in the Town's NPDZ S permit for the treatment facility or exceed the capacity of the sewers
downstream of any new sewer extension

Please see my responses below.
1. When we submitted the Fast Track Applications for this project we had been told that we
would not need to submit for a 401/404 permit and that all three phases would fall under an
NWP 58 non -notifying permit. Since we always notify the USACOE and NCDWR of what we
are doing (even if it is an NWP 58) we did state in the narrative that we would be getting
"approval". However, since that time the threatened and endangered species survey came
back and showed that we may be affecting potential habitat for the Atlantic pigtoe mussel
and the tri-colored bat. This kicked us into needing to submit for a 401/404 permit forjust
Phases I & 11. Our impacts on Phase III do not require a 401/404 permit. The 401/404 permit
applications for Phase I & II was submitted on 12/8/2023 and based on correspondence with
NCDWR and USACOE we expect to have approval by 2/8/2024. The DWR permit application
number is 20231689 and the USACOE application number is SAW-2023-02416.
2. We have had a lot of issues finding the correct permit number for the 36-inch outfall. The only
number we found was WQ0015801, which was from an approved permit application for
another relatively new gravity sewer that is a tributary to the 36-inch outfall. We know now
that this number is not correct. If the Raleigh Regional Office does not have the number, then
we request that the permit number for the receiving downstream sewerjust be listed as
"unknown".
3. We are finalizing this map now and will have it to you as soon as possible.

Good morning. Please see me responses below.
#2: Our system wide collection permit is WQCS00193. 1 apologize for not knowing where
the WQ0015801 number came from, as I thought the engineering team had looked that
up and provided. The actual connection portion that the "new" line connects to was
constructed in 2006 when the Kenneth Branch WWTP was taken offline and flow sent to
Harnett County through our shared line. The Town owns, operates, and maintain the 36"
Line to the meter vault, and we have capacity after the vault to the WWTP.
#4: To be clear, there will be no "new" flow that hasn't already been permitted through
other development projects. Current flow and flow not yet tributary was accounted for in
the FTSE, as this project takes two pump stations offline. The flow from those pump
stations will be going through these "new" lines. Elaine Wild has been reviewing an
application for the Holston Subdivision since around August, which doesn't officially
have a permit number yet, but that flow is in my NYT volume. As it was originally
submitted before these applications.

I've given this application an initial review. I picked up all three phases of the Southern Oaks project
(WQ0044978 and WQ0040249 MOD also), but I'll keep these emails separate. I appreciate our
discussion of these projects on Friday (1/12). If you would answer the following (and I will
add/upload your answers as part of the record for the application). I don't think it is necessary to
revise the existing application, unless you and Michael want to do that.
1. Regarding Part IX.5. You indicated "no" on the requirement for a 404/401. The narrative
indicates you have sought approval of the project through the ACOE. Please provide the
reference number for this.
2. After our discussion on Friday, I believe that it is our understanding that WQ0015801 listed as
the downstream sewer in Part V of the application is incorrect. And at this time, it is unknown
what the reference permit is downstream (just that the receiving line is 36 inch gravity
sewer)? Michael if you can enlighten us further on that — maybe I could find it by a previous
project name.
3. Also during our discussion Friday, you are going to provide a more wholistic map outlining all
3 phases and the force main to be eliminated.
4. Just want to confirm that these projects will be designated as 0 GPD and that Fuquay-Varina
acknowledges that the flow in these lines is accounted for elsewhere? Likely I'll put a special
condition in stating this and Fuquay-Varina will need to submit a modification of this permit to
add additional flow if it is not added through separate permits.
Please provide the above information within 30 days. If additional information/corrected application
is not received within 30 days, your application will be returned, and you will need to resubmit along
with the fee (ref. 15A NCAC 02 T. 010 7(e) (2)].
Thanks also for the information regarding abandonment of the existing facility/lines.

Good morning. Please see me responses below.
#2: Our system wide collection permit is WQCS00193. 1 apologize for not knowing where
the WQ0015801 number came from, as I thought the engineering team had looked that
up and provided. The actual connection portion that the "new" line connects to was
constructed in 2006 when the Kenneth Branch WWTP was taken offline and flow sent to
Harnett County through our shared line. The Town owns, operates, and maintain the 36"
Line to the meter vault, and we have capacity after the vault to the WWTP.
#4: To be clear, there will be no "new" flow that hasn't already been permitted through
other development projects. Current flow and flow not yet tributary was accounted for in
the FTSE, as this project takes two pump stations offline. The flow from those pump
stations will be going through these "new" lines. Elaine Wild has been reviewing an
application for the Holston Subdivision since around August, which doesn't officially
have a permit number yet, but that flow is in my NYT volume. As it was originally
submitted before these applications.
Please let me know if further clarification is needed.
