This Report is being issued as a Notice of Violation because of violations of North Carolina General Statute (NCGS) 143-215.1 and the subject Permit, specifically, because of the failure to install the required disinfection unit and to conduct required annual monitoring. Pursuant to NCGS 1443-215.6A, a civil penalty of not more than ten thousand dollars ($10,000.00)per violation, per day may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to NCGS 143-215.1. You will be notified • in writing should this Office decide to recommend that an enforcement action be taken. It is requested that a written response be submitted to this Office by no later than July 11, 1997, addressing the above cited violations. The permit renewal application has not been completed nor the fee submitted. The permittee indicated that she lives on a fixed income and could not afford the renewal fee nor the installation of a chlorinator(see below). FACILITY SITE REVIEW/OPERATIONS AND MAINTENANCE: The treatment system is a non-classified facility located at the Beverly Riccitiello residence at Denver Heights Circle, west of Kidville in Lincoln County. The facility is permitted to discharge treated domestic wastewater to Snyder Creek in the Catawba River Basin. The permit description of the treatment system is as follows: septic tank/nitrification field with overflow subsurface sand filter and tablet disinfection. The septic tank and sand filter are underground units; therefore, the condition of these facilities could not be determined. As documented during previous inspections, the required chlorinator has never been installed. It may be that due to the low flow to the system and the type of system which exists (septic tank/nitrification field), the overflow pipe could be plugged, and the permit be rescinded. However, such action could not be made unless the local Health Department, which has jurisdiction over such nondischarge systems, agreed to permit the system. Should you request and receive the necessary permit from that agency, then you may request the NPDES General Permit be rescinded. SELF MONITORING PROGRAM & RECORDS/REPORTS: The owner has not monitored the effluent on an annual basis nor maintained records for the parameters required by NPDES General Permit No. NCG550000, Part I, Section A., due in part to the permittee's inability to find the discharge pipe until a couple of years ago and also because she indicated she has never observed a discharge.
