Dear Mr. Montgomery:
Attached to this letter is the draft NPDES permit for the Town of Pittsborl Wastewater
Treatment Plant, NPDES Permit No. NC0020354. The following changes have been made to the
permit during this renewal cycle:
Metals: A statistical analysis was conducted on data collected through the pretreatment short
term monitoring plan. This data indicated a reasonable potential to exceed the allowable levels
for nickel, copper, and zinc. Nickel will be limited at 25 ug/I (based on the water quality
standard for water supply classifications). Copper and zinc are action level water quality
standards. Monthly monitoring is recommended for these parameters. Due to the limited
amount of data used in the analysis, Pittsboro may request that the Division re-evaluate the
Nickel limit after one year of data has been collected.
Nutrients: As stated in the speculative letter submitted to the Town, dated April 4. 2000.
Roberson Creek is listed as partially supporting and not supporting its designated uses on
North Carolina's 303 (d) list. The 303(d) list is mandated by the Clean Water Act and requires
states to list any impaired water, then develop a management strategy to restore the
waterbody to its designated use. One of the water quality parameters affected on Roberson
Creek is chlorophyll a, a measurement of algal activity that responds to excess nutrients
(phosphorus and nitrogen). Information is currently being obtained by the Division in order to
develop a management strategy (or total maximum daily load - TMDL) for Roberson Creek.
Additionally, House Bill 515, passed during the 1997 session, specifies an average annual
mass load limit for total nitrogen and/or phosphorus, if one or both of these nutrients are
deemed to be a parameter of concern. Senate Bill 1366 was also passed in 1997. which
allowed an extension date for compliance with nitrogen and phosphorus discharge limits until
such time that a calibrated nutrient response model was developed. The Town of Pittsboro is a
member of the Jordan Lake Coalition, which has proposed a schedule to comply with the
stipulations of Senate Bill 1366 and is not currently required to meet nutrient limits.
For this permit renewal, no changes will be made with regard to nutrients. with the exception
of an increase in monitoring frequency for total nitrogen (weekly monitoring will be required
with this renewal). A special condition has been placed in the permit noting that the Division
may revise the permit based on the outcome of the Jordan Lake Coalition modeling effort.
However, as also stated in the speculative letter, any potential expansion of the treatment
plant will be affected by both the waterbody impairment and House Bill 515.

Nutrients (continued)
Although not required as part of this permit, the Division encourages Pittsboro to gather total
phosphorus and total nitrogen data upstream of the discharge. Because the Town is a
member of the Upper Cape Fear Basin Association, no upstream data is collected at this time.
This information may, better assist the Town and the Division of any nutrient impacts directly
attributable to the Town.
Please review these documents very carefully to ensure a thorough understanding of the
information, conditions, and requirements contained therein. Once a permit is issued, except for
typographical or technical errors. the permit may be appealed only through the legal process.

Footnotes:
Sample locations: Upstream = at least 100 yards above the outfall; Downstream = at least 100
yards downstream from the outfall. Instream monitoring shall be conducted 3/Week during June,
July, August. and September, and once per week during the remainder of the year. Instream
monitoring is provisionally waived in light of the permittee's participation in Upper Cape
Fear River Basin Association. Instream monitoring shall be conducted as stated in this
permit should the permittee end its participation in the Association.
2. The monthly average BOD5 and Total Suspended Residue concentrations shall not exceed 15% of
the respective influent value (85% removal).
3. The daily dissolved oxygen effluent concentration shall not be less than 6.0 mg/l.
4. Compliance shall be based on a quarterly average of weekly samples. Also see Special Condition
A.(3). regarding nutrients (especially nitrogen).
5. Chronic Toxicity (Ceriodaphnia) P/F at 90%; March. June, September & December (see Condition
A.(2.)).
6. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be
monitored three times per week at the effluent by grab sample
There shall be no discharge of floating solids or visible foam in other than trace amounts.
A (2). CHRONIC TOXICITY PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality
to Ceriodaphnia dubia at an effluent concentration of 90%.
The permit holder shall perform at a minimum, ouarterlu monitoring using test procedures outlined in the
"North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent
versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February
1998) or subsequent versions. The tests will be performed during the months of March, June, September,
and December. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent
discharge below all treatment processes.
If the test procedure performed as the first test of any single quarter results in a failure or ChV
below the permit limit, then multiple -concentration testing shall be performed at a minimum, in
each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent
Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.
The chrome value for multiple concentration tests will be determined using the geometric mean of the
highest concentration having no detectable impairment of reproduction or survival and the lowest
concentration that does have a detectable impairment of reproduction or survival. The definition of
"detectable impairment," collection methods, exposure regimes, and further statistical methods are
specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February
1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter
code TGP313 for the pass/fail results and THP3B for the Chronic Value. Additionally, DW9 Form AT-3
(original) is to be sent to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than
30 days after the end of the reporting period for which the report is made.
Test data shall be complete, accurate, include all supporting chemical/physical measurements and all
concentration/response data, and be certified by laboratory supervisor and ORC or approved designate
signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine
is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is
required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form
indicating the facility name, permit number, pipe number, county, and the month/year of the report with
the notation of "No Flow" in the comment area of the form. The report shall be submitted to the
Environmental Sciences Branch at the address cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring
will be required during the following month.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of
Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and
modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival, minimum control organism reproduction, and appropriate environmental controls, shall
constitute an invalid test and will require immediate follow-up testing to be completed no later than the
last day of the month following the month of the initial monitoring.
A. (3.) NUTRIENT LBUTS SPECIAL CONDITION
Limits on total nitrogen have not been included at this time because the facility is participating in the
Lake Jordan Coalition. If compliance with any element of this strategy, or subsequent approved
revisions to the strategy is not maintained, the Division reserves the right to reopen this permit to
include nitrogen limits. If requirements other than those listed in this NPDES permit are adopted as
part the results of the Jordan Lake model, the Division reserves the right to reopen this permit to
include these requirements.

SUMMARY
The Town of Pittsboro currently has the capacity to operate the treatment plant at 0. 75 MGD.
Annual average monthly flow is below that, at 0.358 MGD. This facility is 1000r6 domestic with
no pretreatment program.
The discharge goes into Robeson Creek (a tributary to Jordan Lake). Robeson Creek is listed as
partially supporting and not supporting its designated uses on NC's 303 (d) list. One of the
water quality parameters affected on Robeson Creek is chlorophyll -a, a measurement of algal
activity which responds to excess nutrients. A TMDL is being developed for this creek.
In addition, both HB 515 and SB 1366 passed in 1997 will affect Pittsboro's future
requirements with regard to nutrients. SB 1366 allowed an extension date for compliance with
nitrogen and phosphorus discharge limits until such time that a calibrated nutrient response
model was developed. Pittsboro is a member of the Jordan Lake Coalition, which has proposed
a schedule to comply with SB1366, and is not required to meet nutrient limits at this time.
Pittsboro is under a self-imposed moratorium on large subdivisions to allow the Town time to
formulate a plan for upgrading the treatment plant. The Town requested speculative limits
(received April 4. 2000) for expansion up to 3 MGD. The Division stated that nutrient loading
must be held constant in Robeson Creek due to the 303 (d) listing (and HB515): the Division
also offered some options to the Town to meet the nutrient limits (at constant nutrient loading,
the proposed nutrient limits may be beyond the current limits of technology). At this time,
Pittsboro is still trying to find options for expansion.
TOXICITY TESTING:

The Town has had no toxicity failures since March 1999.

1 e COMPLIANCE SUMMARY: BASED ON THE PREVIOUS 2 YEARS - 3)
Per the computer printout, the Town has had periodic noncompliant instances for BOD5 and
fecal coliform. The problem does not appear to be chronic and no adverse comments regarding
operation at the facility were noted in the staff report.
The facility has had 7 "monthly" civil penalty assessments in the past 3 years.
INSTREAM MONITORING: Pittsboro is part of the Upper Cape Fear River Basin Association
and is not required to perform localized monitoring. A station still exists on Roberson Creek.
however, due to its 303d listing (chlorophyll a violations have been documented, which
prompted the 303d listing).
It may be advantageous to Pittsboro to perform some upstream nutrient monitoring and this
will be suggested in the cover letter to the draft permit.
There appears to be different sources for the creek name. Pittsboro folks call it Roberson, but
USGS lists as Robeson.
TOXICANT ANALYSIS: Pittsboro has a modified pretreatment program with data results from
the short term monitoring plan. A reasonable potential analysis (RPA) was conducted based on
this data (the data is from 1997-1998, so the data may not be reflective of this year - the
facility will be allowed the opportunity for comment with the draft permit).
See below for recommendations on metals monitoring/limits.
PROPOSED CHANGES:
Copper and zinc monitoring will be recommended (both are action levels). Since Pittsboro has a
good compliance record with regarding to toxicity testing, monthly monitoring will be
recommended. Based on the RPA analysis, a Nickel limit will be recommended (Nickel standard
is 25 ug/1, due to the WS classification).
NUTRIENTS:
As discussed in the summary, nutrients will not be limited at this time - due to SB 1366. The
Division is in the process of collecting data to develop a TMDL for the creek. Total nitrogen
monitoring will be increased to weekly. A special condition will be placed in the permit
discussing the nutrient issue and possible re -opening of the permit. Also, the cover letter to
the draft permit will discuss the various Bills that affect Pittsboro, as well as the chlor a
impairment and 303d listing.

Enclosed with this letter is a copy of the draft permit for your facility. Please review the draft very
carefully to ensure thorough understanding of the conditions and requirements it contains.
The draft permit contains the following changes from the terms contained in your current permit:
A weekly average limit for ammonia has been added to the permit. Since December 2002, the
Division has been adding daily maximum limits for ammonia to permits with monthly average
limits in order to conform to federal NPDES regulations.
• Monitoring requirements have been added pursuant to the Division's Cape Fear River Basin
permitting strategy, which is primarily concerned with the discharge of nutrients in the Jordan Lake
watershed. These new requirements include monitoring/reporting for:
Total Kjeldhal Nitrogen (TKN)
Nitrates + Nitrites (NO2 + NO3)
Total Monthly Flow
Total Nitrogen Load (Monthly and Annual Loading)
Total Phosphorous Load (Monthly and Annual Loading)
The Town is currently monitoring for all of these parameters per the requirements of the existing
permit. The new requirements will call for different manipulations and/or displays of the data on
monthly reports.
• New narrative conditions [Sections A. (3) — A. (6)] have been added to address various aspects of
nutrient issues relevant to this discharge.

A Total Residual Chlorine (TRC) daily maximum limit has been added. Since the issuance of the
existing permit, the North Carolina Environmental Management Commission has adopted rules
that establish a water quality standard for TRC. However, the condition within the permit remains
that TRC will only have to be monitored if chlorine is added as a disinfectant or used elsewhere in
the process.

Footnotes from Limits and Monitoring Requirements:
1. Sample locations: Upstream = at least 100 yards above the outfall; Downstream = at least 100 yards
downstream from the outfall. Instream monitoring shall be conducted 3/Week during June, July,
August, and September, and once per week during the remainder of the year.
2. The monthly average BOD5 and Total Suspended Residue concentrations shall not exceed 15% of
the respective influent value (85% removal).
3. The daily dissolved oxygen effluent concentration shall not be less than 6.0 mg/l.
4. Total residual chlorine shall be monitored if chlorine is added as a disinfectant or used elsewhere in
the process.
5. TN = TKN + NO3-N + NO2-N, where TN is Total Nitrogen, TKN is Total Kjeldahl Nitrogen, and
NO3-N and NO2-N are Nitrate and Nitrite Nitrogen, respectively.
6. TN or TP Load is the mass quantity of Total Nitrogen or Phosphorus discharged in a given period of
time. See Special Condition A. (4.), Calculation of Mass Loads.
7. See Condition A. (5.) for prospective Total Phosphorous summer effluent limit to be included in
future permits.
8. The quarterly average for total phosphorus shall be the average of composite samples collected
weekly during each calendar quarter (January -March, April —June, July —September, October -
December).
9. Chronic Toxicity (Ceriodaphnia) P/F at 90%; March, June, September & December (see Condition
A. (2.)).
10. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be
monitored three times per week at the effluent by grab sample
There shall be no discharge of floating solids or visible foam in other than trace amounts.

A. (2.) CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY)
The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to
Ceriodaphnia dubia at an effluent concentration of 90 %.
The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North
Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or
"North Carolina Phase 11 Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent
versions. The tests will be performed during the months of, March, June, September, and December. Effluent
sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment
processes.
If the test procedure, performed as the first test of any single quarter, results in a failure or ChV below the
permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two
following months, as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test
Procedure" (Revised -February 1998) or subsequent versions.
The chronic value for multiple concentration tests will be determined using the geometric mean of the highest
concentration having no detectable impairment of reproduction or survival and the lowest concentration that does
have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection
methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase 11 Chronic
Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the
pass/fail results and TBP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the
following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later than 30
days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include
all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory
supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be
measured and reported if chlorine is employed for disinfection of the waste stream
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the
permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating the
facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow"
in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address
cited above.
Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be
required during the following month. Should any test data from this monitoring requirement or tests performed by
the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be
re -opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document (such as minimum control
organism survival, minimum control organism reproduction, and/or appropriate environmental
controls) shall constitute an invalid test and will require immediate follow-up testing, to be completed no
later than the last day of the month following the month of initial monitoring.

A. (3.) PERMIT RE -OPENER: SUPPLEMENTARY NUTRIENT MONITORING
Pursuant to N.C. General Statutes Section 143-215.1 and the implementing rules found in Title 15A of
the North Carolina Administrative Code, Subchapter 0211, specifically, 15A NCAC 02H.0112(b)(1) and
0211.0114(a), and Part 11, Sections B.12. and B.13. of this Permit, the Director of DWQ may reopen this
permit to require supplemental nutrient monitoring of the discharge. The additional monitoring will be
to support water quality modeling efforts within the Cape Fear River Basin, and shall be consistent with
a monitoring plan developed jointly by the Division and affected stakeholders.
A. (4.) CALCULATION OF MASS LOADS
a. The Permittee shall calculate monthly and annual TN (or TP) Loads as follows:
i. Monthly TN (or TP) Load (lb/mo) = TN (or TP) x TMF x 8.34
where:
TN (or TP) _ the average Total Nitrogen or (Total Phosphorus) concentration
(mg/L) of the composite samples collected during the month
TMF _ the Total Monthly Flow of wastewater discharged during the
month (MG/mo)
8.34 = conversion factor, from (mg/L x MG) to pounds
ii. Annual TN (or TP) Load (lb/yr) = Sum of 12 Monthly TN (or TP) Loads for calendar
year
b. The Permittee shall report monthly Total Nitrogen and Total Phosphorus results (mg(L
and lb/mo) in the appropriate discharge monitoring report for each month and shall report each
year's results (lb/yr) with the December report for that year.
A. (5.) TOTAL PHOSPHOROUS LD41TS IMPLEMENTING THE TOTAL MAXIMUM
DAILY LOAD (TMDL) FOR ROBERSON CREEK
A Total Phosphorous summer effluent limit consistent with the requirements of the TMDL for Roberson
Creek will be included in the permit issued to this facility for the next permit cycle and subsequent
permit cycles if and as long as the facility continues to discharge into Roberson Creek. As of the issue
date of this permit, the prospective summer limit at 0.75 MGD for Total Phosphorous will be 1.5 lbs/day
(an approximate 0.25 mg/L concentration equivalent). The Town will be expected take necessary
actions to ensure it will be compliant with such a limit by the expiration date of this current permit if the
discharge remains in Roberson Creek.

A. (6.) TOTAL PHOSPHOROUS COMPLIANCE PLANS
By January 1, 2009, the Town of Pittsboro will submit a plan prepared by a professional engineer
documenting how it intends to satisfy the Total Maximum Daily Load (TMDL) that has been established
for Roberson Creek and/or Total Phosphorous permit limits imposed upon the Town of Pittsboro
W WTP based upon the TMDL or other nutrient management strategies for the Cape Fear River Basin.
The plan should include an analysis of projected growth for the Town and projected future wastewater
needs along with detailed discussion of how the Town plans to meet any needs for additional capacity
and remain in compliance with water quality regulations. The report should discuss any plans for- -
expansion of the WWTP, potential relocation(s) of the outfall and the effects these decisions may have
on both permitting issues and the actual water quality of the receiving stream. This report shall be
submitted to:

Dear Mr. Hughes:
This letter is in response to a request for speculative effluent limits for the potential
expansion and relocation of the Pittsboro wastewater treatment plant. Based on the meeting held
between the Town of Pittsboro and various state agencies July 14, 2004, it is the NPDES Unit's
understanding that Pittsboro will review all three locations described in Melba McGee's letter
dated May 27. 2004. This letter will provide Pittsboro with speculative limits for all three
locations. The Town will need to work with the various state and federal agencies, as well as
interested parties, to determine the best location for a point source discharge.
These speculative limits are based on our understanding of the proposal and of present
environmental conditions. The Division of Water Quality (DWQ) cannot guarantee that it will
issue the Town an NPDES permit to expand its discharge of treated wastewater into waters of the
State. Nor can we guarantee that the effluent limitations and other requirements included in any
permit will be exactly as presented here. Final decisions on these matters will be made only after
the Division evaluates a formal permit application for the discharge and notices the proposal for
public comment.
Environmental Assessments of New Projects and Expansions
Any entity proposing to construct new or expanded wastewater treatment facilities using
public funds or public (state) lands must first prepare an environmental assessment (EA) when
wastewater expansions equal or exceed 0.5 MGD. Please contact the Division's State
Environmental Policy Act (SEPA) coordinator, currently Alex Marks, at (919) 733 - 5083, ext. 555
for further information on EA requirements. DWQ will not accept a permit application for a
project requiring an environmental assessment until the Division has approved the EA and sent a
Finding of No Significant Impact (FONSI) to the state Clearinghouse for review and comment. Due
to the public interest in the area, the Town may also wish to investigate the possibility of
proceeding directly to an Environmental impact Statement (EIS), in lieu of an EA. Again, the
Town may wish to contact Mr. Marks about this possibility (or Ms. Melba McGee, Environmental
Coordinator for DENR, 715-4194).
Engineering Alternatives Analysis (EAA)
In accordance with the North Carolina General Statutes, the most practicable wastewater
treatment and disposal alternative with the least adverse impact on the environment is required to
be implemented with any expansion. Therefore, a detailed engineering alternatives analysis (EAA)
must be prepared. The NPDES Unit requires the EAA as part of the Environmental Assessment or
Environmental Impact Statement The EAA must justify requested flows and provide an analysis of
potential wastewater treatment alternatives. Alternatives to a surface water discharge, such as a
spray/drip irrigation, wastewater reuse, or inflow/infiltration reduction, are considered to be
environmentally preferable.

Permit applications for new or expanding flow will be returned as incomplete if all EAA
requirements are not adequately addressed. You may also wish to refer to the NPDES Unit
website for more information regarding requests for expansion,

Speculative Effluent Limits
Based on the available information, tentative limits for the proposed discharge of 4 MGD flow to
the Haw River at three locations are outlined below. The three locations reviewed are: (1)
dischurchased tract
belowa15-50e to1; (2) discharge into the mainshe Haw River upstream from tem of Jordan► Lake above Stinking Cf state reek; 3)rty and
discharge to the Haw River near US Highway 64. Also refer to Table 1 for an outline of the
speculative limits. Limits are the same for all three locations.
Flow Limits. The flow would be limited to 4 MGD at your request. This limit would be applied as
a monthly average.
BODE and D1H -N. The proposed limits for a 4 MGD discharge into this proximity of Jordan Lake
would be 5 mg/l (BOD5) and 1.0 mg/l (NH3-N) during the summer months, 10 mg/l (BOD5) and
2.0 mg/l (NH3-N) during the winter months.
Dissolved Oxygen. A minimum daily average dissolved oxygen level of 6 mg/l must be maintained
in the effluent.
TSS. The limits for total suspended solids are standard for secondary treatment of municipal
wastewater (30 mg/1 monthly average).
Fecal Coliform, pH. The limits for fecal coliform bacteria and pH are derived to protect water
quality in the receiving stream and will likely remain the same as in the previous permit.
Chlorine. A total residual chlorine limit of 28 ug/l (daily maximum) would be implemented in this
permit.

applicable to location nos. 1 and 2). Should the Town of Pittsboro determine that discharge to
Lake Jordan is the most feasible option (location no. 3), the facility will be required to comply with
a 24 hour Acute Pass/Fail test using the fathead minnow species.
Toxicant Parameters: Estimation of toxicant parameters will not be given with this speculative
letter, but will be submitted as appropriate with the draft NPDES permit.
Nutrient Parameters: A nutrient model for Jordan Lake was recently developed. Meetings
between Division staff and the stakeholders for Jordan Lake are continuing to take place (with
specific allocations for each discharger not yet determined). We encourage the Town to become an
active participant in the Jordan Lake meetings. At this time, the Division of Water Quality can
provide only estimates of possible individual nutrient limits. For total nitrogen, Pittsboro would
likely receive a mass -based equivalent of 5 — 6 mg/l TN. For total phosphorus, the Town would
likely receive a mass -based equivalent of 0.5 mg/l TP.

201 Facilities Plan
Dear Mr. Hughes:
I am writing to acknowledge receipt of two copies of the subject 201 Facilities Plan on
August 4, 2003. A request was previously made for a determination by Construction Grants and
Loans concerning whether the subject project would qualify for a Categorical Exclusion, using
two alternate routes for the reclaimed water line to the 3M plant. The plan that has been
submitted indicates that the alternate route that is located along Turkey Creek has been selected
and, as noted in my May 9 letter, this alignment may or may not qualify for a Categorical
Exclusion, and an environmental assessment will be needed. Based on a discussion with the
town's consultant engineers, Hydrostructures and Diehl & Phillips, it is my understanding that
the town does not want to pursue a Categorical Exclusion for this project, and an environmental
assessment is being prepared that meets EPA's environmental information document
requirements for a STAG funded project.
If SRF funding is not currently being requested and the town does not plan on requesting
SRF funding for this project, it is recommended that the document be re -titled and reformatted to
be a Preliminary Engineering Report (PER) instead of a 201 Facilities Plan. The PER for a
STAG funded project may address only current needs, and it is recommended that only current
needs be discussed to avoid possible confusion and unnecessary review concerns by the resource
agencies, which will comment as a part of the environmental review process. It is my
understanding that the environmental assessment being prepared will only address the current
needs, which consist of improvements at the WWTP to meet reuse effluent standards and the
reuse effluent pump station and force main, and that a Finding of No Significant Impact is only
requested for these current needs.
Eighteen copies of the document, which include the environmental assessment, will need
to be submitted to the Construction Grants and Loans Section. The Construction Grants and
Loans Section will perform a technical and environmental review, and the document will also be

2500 mg/1 as possible. Younger sludge and the correct dissolved oxygen should stop all
denitrification and as a result in lower turbidity, which will result in consistant UV
disinfection. Replace the rubber on the #1 skimmer so all of the scum that occurs on the
clarifier surface will be removed.
C) Continue to maintain the UV bulb -cleaning schedule until a consistent fecal kill is
maintained.
D) I would recommend that you consistently feed alum for phosphorus removal as long
as needed to meet compliance.

I. INTRODUCTION:
This laboratory was inspected to verify its compliance with the requirements of 15A NCAC 2H .0800 for
the analysis of environmental samples.
II. GENERAL COMMENTS:
The inspection consisted of reviewing data for NPDES #NC0020354. The staff is congratulated for doing
an excellent job of implementing the laboratory certification program. Very good bench sheets and
forms are used. All equipment, for the most part, appears to be well maintained. Records are well kept
and the data appeared accurate. It would like to be noted that this laboratory corrected all deficiencies
that were cited on the previous inspection.
Comment: For all benchsheets, it is recommended that the lab indicate which edition of the method is
being referenced. This will aid the analysts, when method changes are promulgated by EPA, to
maintain adequate documentation of their data.
III. DEFICIENCIES, REQUIREMENTS, COMMENTS AND RECOMMENDATIONS.:
pH:
A.) Comment: The laboratory is not changing the pH storage buffer solution on a regular basis. Much
growth was observed in the pH 7.0 electrode storage buffer and beaker.
Requirement: The laboratory should change the long term storage buffer solution on a daily basis, to
prohibit growth and to maintain a constant electrode environment and integrity and must follow
manufacturer's instructions on the storage and care of the electrode.
Recommendation: It was recommended by the inspector that a smaller beaker be used for the
electrode storage buffer so as to decrease the volume used when changing on a daily basis.
Comment: The laboratory is calibrating with the 4.0 and the 10.0 buffers and reading the 7.0 as the
check buffer on a daily basis.
Comment: Although not required the laboratory is checking the ATC temperature sensors on all of
the instruments and performing calibration checks with an "In-house' NIST certified thermometer more
often than annually and any corrections are displayed on the instrument.

Dissolved Oxygen:
Comment: The Laboratory had purchased a new DO meter since the last inspection. The. dry
calibration check readings appeared to be within the normal range and well documented. The
membrane and probe appeared to be in excellent condition and the absorbent electrode storage pad
was very wet and clean, evidence that proper rinsing of the probe was being performed on a regular
basis.
Temperature:
Comment: The Temperature is being recorded by the laboratory using the temperature probe on the
pH meter. The temperature probe is being checked against an "In-house' NIST certified thermometer
and any correction is well documented and displayed on the meter.
IV. PAPER TRAIL INVESTIGATION:
A paper trail was conducted at this facility. This consisted of comparing laboratory bench data and
contracted data of several parameters with quarterly DMR reports from February, March, April and
July, 2005 and some transcription errors were detected as follows:
Comment: February 16, 2005 reported DO as 9.2 mg/L, actual reading was 8.1. July 25, 2005,
reported Settleable Solids from contractor's data report as 1.2 ml/L on DMR when actual reading
was 0.34 ml/L.
Requirement: All misreported data must be corrected by submitting an amended DMR form to the
state of North Carolina Water Quality Division within 30 days of this report.
V. CONCLUSIONS:
Correcting the above cited comments and implementing the requirements/recommendations will
help this lab to produce quality data and meet certification requirements. Please respond to all
the lettered comments.

A letter of request for Authorization to Construct was received on September 22, 2003 by
the Division, and final plans and specifications for the subject project have been reviewed and
found to be satisfactory. Authorization is hereby granted for the construction of modifications to
the existing 0.75 MGD Town of Pittsboro Wastewater Treatment Plant, with discharge of treated
wastewater into Roberson Creek in the Cape Fear River Basin.
This authorization results in no increase in design or permitted capacity and is awarded
for the construction of the following specific modifications:
A 500,000-gallon aerated flow equalization basin with dual variable -speed
pumps, a flow splitter box, two new 40-ft. diameter clarifiers, the conversion of
the two existing clarifiers to anoxic zones, two new 50 sq. ft. tertiary filter cells,
new ultraviolet disinfection facilities, and an effluent pump station with dual 350
GPM pumps for reuse water transmission, pursuant to the project plan,
specifications, and other supporting data subsequently filed and approved by the
Department of Environment and Natural Resources.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of
NPDES Permit No. NC0020354 issued December 28, 2001, and shall be subject to revocation
unless the wastewater treatment facilities are constructed in accordance with the conditions and
limitations specified in Permit No. NC0020354.
The sludge generated from these treatment facilities must be disposed of in accordance
with G.S. 143-215.1 and in a manner approved by the North Carolina Division of Water Quality.

In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may
be required by this Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.
The Raleigh Regional Office, telephone number (919) 571-4700, shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an on site
inspection can be made. Such notification to the regional supervisor shall be made during the
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.
Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the permitted facility
has been installed in accordance with the NPDES Permit, this Authorization to Construct and the
approved plans and specifications. Mail the Certification to Cecil G. Madden, Jr., P.E.,
Construction Grants & Loans, DWQ / DENR, 1633 Mail Service Center, Raleigh, NC 27699-
1633.
Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the
wastewater treatment facilities. The operator must hold a certificate of the type and grade at
least equivalent to or greater than the classification assigned to the wastewater treatment
facilities by the Certification Commission.
The Permittee must also employ a certified back-up operator of the appropriate type and
grade to comply with the conditions of T15A:8G.0202. The ORC of the facility must visit each
Class I facility at least weekly and each Class II, III and IV facility at least daily, excluding
weekends and holidays, must properly manage the facility, must document daily operation and
maintenance of the facility, and must comply with all other conditions of T15A:8G.0202.
A copy of the approved plans and specifications shall be maintained on file by the
Permittee for the life of the facility.
During the construction of the proposed additions/modifications, the permittee shall
continue to properly maintain and operate the existing wastewater treatment facilities at all times,
and in such a manner, as necessary to comply with the effluent limits specified in the NPDES
Permit.
You are reminded that it is mandatory for the project to be constructed in accordance
with the North Carolina Sedimentation Pollution Control Act, and, when applicable, the North
Carolina Dam Safety Act. In addition, the specifications must clearly state what the contractor's
responsibilities shall be in complying with these Acts.
Failure to abide by the requirements contained in this Authorization to Construct may
subject the Permittee to an enforcement action by the Division of Water Quality in accordance
with North Carolina General Statute 143-215.6A to 143-215.6C.

This letter is being sent in response to your letter dated January 19, 2005. Your letter was
a summary of the compliance inspection conducted by Mr. Ted Cashion of the Raleigh
Regional Office on January 11, 2005. Your letter outlined two outstanding violations that
were found during Mr. Cashion's inspection. The first was the effluent sampler being
programmed to take samples by constant timelconstant volume. The information given to
Mr. Cashion was incorrect at the time of the inspection. The effluent samples are actually
taken flow proportional with a 20ml sample being taken per every 3000 gals of effluent
flow. The other violation was related to chlorine residual. As noted in your letter the
chlorine residual was the result of cleaning the weirs for algae control. This method of
cleaning has been discontinued and only mechanical cleaning is being used. If there are
any questions concerning this letter or further action is required please let me know.
Additionally, my reply was somewhat delayed due to me being out of the office the week
of January 20. I received your letter on January 31, 2005.

Ted, according to the TRC policy, TRC limits will be assigned to permit renewals and
all new permits issued after April 1, 2003. So, Pittsboro's permit will be up for
renewal in 2006. At that time, the permit will be reviewed and a limit determined.
Facilities receiving TRC limits for the first time will be given 18 months from the
effective date of the permit before the new limit kicks in. If you have questions,

However, they use chlorine to clean algae from their weirs. When this occurs, the

there be a chlorine limit in the permit, in case they use chlorine?
If so, please have the permit modified to reflect this. Let me know what you
think.
We included in our report that they use high pressure water to clean the weirs

aeration basins, 3 tertiary filters, UV disinfection, effluent flow meter in a parshall flume, cascade post aeration, drum sludge
thickener, and 2 aerobic digesters.
2. The Town has 1 significant industrial user, Hydrotube South.
3. Mr. John Poteat, grade 4 license, is listed as the ORC; Mr. Perry Dunn, grade 2 license, is listed as the backup ORC for the
class 3 rated facility.
4. Sludge is lime stabilized by the town, and land applied by Synagro. Sludge was being hauled during the inspection. Both
digesters were near empty.
5. Environment I performs analyses for the Town.
6. A cursory review of laboratory and DMR data for October 2004 showed consistent reporting of results.
7. Mr. Davis stated the Pittsboro Christian Village pump station improvements were completed last week. The Town has 4
pump stations.
8. A review of the ORC logbook showed good information is entered on a daily basis.
9. As discussed during the inspection, the 24 hour sample collection time period must be noted on each chain of custody.
10. Influent and effluent sampler temperatures must be recorded when samples are collected. Temperatures must range between
04 degrees C, without freezing.
11. Calibration records for dissolved oxygen and pH appeared satisfactory. The pH buffers expire at the end of January 2005.
New buffer solutions must be secured by the town immediately.
12. As discussed with Mr. Davis, plant staff need to document the inspection and proper operation of the alarm system at the
influent pump station.

The influent sampler was programmed to collect 24 hour composites by constant time/constant time. This method is
satisfactory for the influent, as long as samples are collected are no greater than 20 minute intervals, and no less tli��t11i00 mis

14. The effluent sampler was programmed to collect 24 hour composites by constant time/constant volume. This is in violation
of the NPDES permit. The effluent samples must be collected proportional to flow as stated in the NPDES permit. Please
ensure the sampler is programmed to comply with this requirement.
15. The effluent flow meter was calibrated in August 2004. An instantaneous check showed it to be recording within ± 10% of
the actual flow.
16. The effluent appeared clear during the inspection.
17. A review of data from November 2003 through October 2004 showed 2 weekly average violations of Nickel (week of August
23, and week of November 10). These violations have been previously addressed by the Division. All other parameters were
compliant with limit and monitoring frequencies.
18. Comments included on the DMR for March 17, 2004 noted the fecal coliform sample contained residual chlorine due to the
weirs being chlorinated for algae control. Residual chlorine was not monitored as required by the permit for this day. We
recommend that the weirs be cleaned with high pressure water instead of chlorine.
This inspection is being sent as a Notice of Violation specifically for the failure to collect 24 hour effluent composite samples by
flow proportion as noted in item 14, and for failure to monitor chlorine as noted in item 18. Please respond in writing by February 1,
2005 stating when the effluent sampler was programmed to comply with this requirement.

As a generator and distributor of reclaimed water, you must submit a Reclaimed Water permit
application with the $1090.00 application fee. An application form is attached. As you are
aware, the 3M Company must also submit to the Construction Grants & Loans Section the
application for a modification to their existing water reuse permit.
Contracts II and III
You have identified the 100-year flood elevation of Roberson Creek on sheet 3 of the plans, by
pointing out its elevation contours. Please provide the elevation in feet above sea level
associated with these contour lines. Note: According to the information obtained from
responses to review comments for Contract 1, this elevation varies from 339 ft. to 341 ft. above
sea level, or 8.51 feet above the normal flow elevation.
2. The new sheet 4 of the plans, labeled "Plan and profile STA 40+00 to 57+00" shows the revised
plan, but not the profile. Please provide the profile for all revised sewer locations.
3. Regarding sheets 3 and 4, please label the locations of all 45-degree bends on the plan view.

Contract I:
1. Provide a Reclaimed Water permit application with a $400.00 application fee.
2. Please submit revised specifications showing that the notice of Award was modified to include
the signatures of the contractor and the Town of Pittsboro.
3. Please submit the subsurface geotechnical investigation report, which was to be appended to the
Specifications.
4. Please forward the executed agreement between the Town of Pittsboro and the 3M Company.
Please forward the design calculation notebook. This should include sizing data for the pumps,
air blowers, disinfection system, aeration basins modifications, and the volume of the reuse water
to be utilized. These calculations should also include total nitrogen removal data and the
volumes of each chamber within the existing aeration basins as shown on sheets 8 and 9 of 33.
6. In order to be able to utilize the Town of Pittsboro's reuse water, 3M Company must submit, as
soon as possible, a full application for permit modification.
7. On Sheet 2 of 33, there is a profile fort 10.45 lineal feet of new 10-inch gravity sewer. Please
provide a plan drawing for this sewer, clearly identifying its location.
8. Please provide the calculations used to estimate the flood elevation from the ASCE empirical
equation developed for Piedmont, NC, as stated on the note on sheet 3 of 33.
9. Please correct the typographical error on the cover sheet of the specifications. The correct
project number should be E-SRL-T-02-0053.
10. The Construction Grants and Loans policy requires specifications to be written in a manner that
maximizes competition. It has been our experience that product specifications are often written
in a restrictive manner. Therefore, our office expects the engineer to identify three
manufacturers that can meet the performance requirements for any given piece of equipment.
When three manufacturers cannot be identified, then as many as are known should be listed. The
three manufacturers should be listed followed by the phrase, "or approved equal".
a. In the first paragraph of page 2-R-3, Buna N gaskets are specified. Please remove this
reference, or specify two more manufacturers "or approved equal".
b. A few other places within the specifications list only two manufacturers or two specific
products. These include the flange adapters listed on page 2-R-3, and the tablet

Please list a third manufacturer where possible.
Contracts II and III
1. Please fill in the amount of estimated rock quantity needed to be disposed, and the amount of
backfill needed, on items 37 and 38 of the bid form.
2. Prior to issuance of approval documents, a copy of the 404 Permit obtained from the US Army
Corps of Engineers must be provided. Additionally, a copy of the 401 Water Quality
Certification (General Certification) must be provided or included in the Specifications.
Please include the subsurface investigations at the transmission main route and at the storage
tank site, as part of the specifications.
4. Please provide copies of both NCDOT encroachment agreements needed for this project. These
are the one for the controlled access portion of US 15/501, and one for the non -controlled access
roads. CG&L understands that no railroad encroachments are associated with this project.
5. Please ensure that all construction easements, permanent easements, and rights -of -way are
shown on the plans.
6. Please identify the 100-year flood elevation of Roberson Creek on the plans.

The Division received your request for modification of the above -mentioned permit on April 6, 2004. You
requested removal of the nickel limit on the basis that weekly samples collected over the past year
showed low effluent levels. While most of the samples collected did show low values of nickel (< 10
µg/L), the Pittsboro WWTP exceeded its weekly average permit limit of 25.0 µg/L on November 11, 2003.
The value recorded on that day was 27 µg/L. Since the value was exceeded, the Division cannot remove
the nickel limit. The nickel limit and monitoring requirements will remain as is currently required in
the existing permit.

This laboratory was inspected to verify its compliance with the requirements of 15A NCAC 2H .0800 for
the analysis of environmental samples.
II. GENERAL COMMENTS:
The laboratory is spacious and well equipped. The facilities and equipment are well maintained.
III. DEFICIENCIES, RECOMMENDATIONS, REQUIREMENTS, AND COMMENTS:
General:
1. DEFICIENCY: The sample taken for Dissolved Oxygen and Temperature is not measured
immediately upon sample collection, but is transported to the laboratory for analysis.
REQUIREMENT: All Dissolved Oxygen and Temperature measurements must be taken immediately at
the site of collection. Ref: 40CFR Ch.1 (7-1-95) p. 644 table II.
A. COMMENT: Some of the daily logs used by the laboratory do not contain all of the necessary
labeling information. No units of measure are associated with some of the data values listed in the
logbooks and bench sheets.
REQUIREMENT: The laboratory should review all of their bench sheets and log books to make sure
that every entry is marked with the appropriate unit of measure. Every number recorded on a bench
sheet or logbook must have an appropriate unit assigned to it.
B. COMMENT: The laboratory does not list the acceptance ranges of quality control samples on the
laboratory bench sheets.
RECOMMENDATION: It is strongly recommended that the laboratory list the acceptance ranges for
each quality control sample on the bench sheet. This will enable the analyst to be able to compare the
analytical result to the acceptable range in a timely fashion. If the sample is out of the acceptable
range, it can then be reanalyzed immediately and within all holding times.

C. COMMENT: The laboratory does not record the pH electrode and Dissolved Oxygen calibration
information adequately.
RECOMMENDATION: The laboratory must record all calibration information. It is strongly
recommended that the laboratory record all calibration information on the same bench sheet as the
sample data. This allows for ease of data verification as well as eliminating the possibility of data
becoming separated from essential calibration information.
Temperature:
D. COMMENT: The laboratory is not verifying the automatic temperature compensation of the meter
for which the reported temperature values are obtained for reporting purposes.
Note: The laboratory indicated that this verification had been performed, but was not documented.
REQUIREMENT: The temperature sensor in the DO and pH meter must be checked annually against
an NIST certified thermometer and the process documented if the instrument is used for reporting
temperature results. It is recommended that the temperature sensor be calibrated annually even if not
being used to report temperature. (Other certified laboratories may provide assistance in meeting this
requirement.)
REQUIREMENT: The thermometer should be less than 30C from the certified reading to be
acceptable.
RECOMMENDATION: It is strongly recommended that the laboratory not use a thermometer that has a
correction of more than 10C against the NIST calibration. Thermometers with corrections of more than
1 °C can produce results that are not reliable on a day to day basis.
IV. Data Review
Laboratory bench sheet data was compared to DMR reports for the months of January, February, and
March 2004. All data was accurately reported.
V. CONCLUSIONS:
Correcting the above cited deficiencies and comments and implementing the recommendations will help
this lab to produce quality data and meet certification requirements.

This letter acknowledges that plans and specifications necessary to comply with the State Revolving
Loan funding requirements were received on September 22, 2003. Your project is being reviewed for
technical adequacy and conformance to State laws, regulations, design requirements, and good, sound
engineering principles. You will be advised of any recommendations, comments or other matters to be
resolved, should this be necessary prior to final approval.
A more detailed review is forthcoming. However, in an effort to expedite the review process and to
make funding available as soon as possible, we offer the following preliminary review comments.
Contract I - Wastewater Treatment Plant Improvements:
1. Provide a Reclaimed Water permit application with the $400.00 application fee.
2. Provide an updated cost estimate.
3. The existing reuse permit for the 3M facility must be modified to include the utilization of the Pittsboro
reuse water.
4. The Notice of Award should have places for the signatures of the Contractor and the Local
Government's Authorized Representative.
A reasonable subsurface investigation that must be made available to the contractor. If it is not included
in the specifications, the specifications must advise where a copy of the report can be observed.
Typically CG&L expects a boring about every 500 feet and at each road crossing for line work and at all
major structures like pump stations aeration basins, and clarifiers. In the event that the information is
not made available to the contractor then change orders associated with differing sites will not likely be
determined eligible for funding.

6. Provide a copy of the executed agreement between the Town of Pittsboro and 3M.
7. The scope of work in the plans and specifications must be reasonably close to the scope of work outlined
in the approved Preliminary Engineering Report (P.E.R.), or 201 Facilities Plan.
8. The sequence of construction should be identified in the specifications. This sequence must not result in
overflows or bypasses to the waters of the state.
9. If funding is desired, all addenda should be submitted to our office for review and approval prior to
opening of bids. Contractors should have all addenda at least 7 days prior to bid opening.
10. Approval of all "or equals" must be by addenda prior to receipt of bids.
11. Any waters Classified WS-II, WS-III, B, SA, ORW, HQW, or SB within 50 feet of the project must be
shown on the plans.
12. Confirm all mitigative measures required by other permits and environmental assessments have been
incorporated in the plans and specifications. Provide a summary of those measures in your written
response.
13. Provide design calculations for the sizing of all the units and equipment like equalization basin, pumps,
air blowers, disinfection system, modifications to existing aeration basins, and the volume of the reuse
water to be utilized.
14. Provide a justification for the sole sourcing of the effluent filters.
Contract II & III - Reclaimed water transmission main and storage tank:
1. Provide a copy of the Sedimentation and Erosion Control Permit from the Division of Land Resources
or a letter from them stating that no permit is required for this project.
2. For all stream crossings provide a copy of the 401 Water Quality Certification, and Army Corps of
Engineer's 404 Permit or provide a letter from each of the agencies stating that none is required for this
project.
3. A reasonable subsurface investigation that must be made available to the contractor. If it is not included
in the specifications, the specifications must advise where a copy of the report can be observed.

4. Copies of NCDOT encroachment agreements and railroad encroachment agreements must be provided
in the specifications, or it must be documented how all construction requirements associated with the
agreements have been incorporated in the plans.
5. All construction easements, permanent easements, and rights -of -way must be shown on the plans. This
includes easements for the tank site, the access road and along the route of the force main up to the
connection point on the 3M site.
6. The scope of work in the plans and specifications must be reasonably close to the scope of work outlined
in an approved Preliminary Engineering Report (P.E.R.). Plans and specifications cannot be approved
prior the approval of the P.E.R.
7. Show all wells within the vicinity of the project.
8. If sewers are within a 100-foot radius of a well, then D.I.P. should be used with joints tested to drinking
water standards.
9. If D.I.P. is used within a 100-foot radius of a well, it must not be any closer than 50 feet
to a public well, nor any closer than 25 feet to a private well.
10. Manholes, air release valves, and valve boxes are not to be located within a 100-foot radius of a well.
11. If abandonment of any well is chosen by the Town of Pittsboro, provide documentation/certification,
signed by each affected homeowner, stating that they understand their well must be abandoned.
12. When abandonment of a well is chosen, provide an alternative analysis that justifies the abandonment of
each well.
13. If well abandonment is chosen, the GW-30 form, "Well Abandonment Record", must be included in the
specifications. The well must be abandoned by a North Carolina certified well driller in accordance
with 15A NCAC 2C, Well Construction Standards. The Well Abandonment form must be completed and
submitted to the Division of Water Quality Groundwater Section within 30 days of abandonment. The
GW-30 form and other information related to groundwater requirements can be downloaded from the
following web site: http://gw.ehnr.state.nc.us.
14. If funding is desired, all addenda should be submitted to our office for review and approval prior to
opening of bids. Contractors should have all addenda at least 7 days prior to bid opening.

16. Any private or public water supply source, including wells, any WS-I waters, or Class I or Class II
impounded reservoirs used as a source for drinking water within 100 feet of the project must be shown
on the plans.

17. Any waters Classified WS-II, WS-III, B, SA, ORW, HQW, or SB within 50 feet of the project must be
shown on the plans.
18. All existing utilities should be shown on plans and in the profiles.
19. Clearly show how horizontal and vertical controls are provided.
20. Plans should clearly identify the 100-year flood elevation.
21. Confirm all mitigative measures required by other permits and environmental assessments have been
incorporated in the plans and specifications. Provide a summary of those measures in your written
response.
22. Advise if there are gas stations in the vicinity of the proposed project. If yes, then an investigation
should be performed on the soils and groundwater to determine if they are petroleum contaminated.
When the contamination exists, plans and specifications must address how the contaminated soils and
groundwater must be handled. All materials used in petroleum contaminated soils need to be compatible
with petroleum.
23. When Petroleum contaminated soil is found other routes must be considered. Please advise what other
routes were considered and advise why they were not selected.
24. Provide design calculations for the sizing of the pumps, force main and storage tank.

I. General
1. It is our understanding that this document is only requesting review and approval of
the Phase I portion of the project. Hence, our review will be restricted to the Phase I
actions and our subsequent approval should not be construed as an endorsement of
Phases II and III.
2. The Executive Summary should be revised to plainly state that the information on
Phases 11 and III included in this report is for information only, and the only phase
recommended at this time is Phase I.
3. This project is to be funded in part by a State and Tribal Assistance Grant (STAG);
hence, all real property associated with the project must be acquired in accordance
with the Uniform Relocation and Real Property Assistance Act of 1970.
4. Please note that approval of the facilities plan does not constitute approval of sole
source procurement. Plans and specifications must comply with N.C. General Statute
Chapter 133, Section 3, prior to their approval.
5. The owner and consulting engineer should be advised that after approval of the
Preliminary Engineering Report, there are several construction project permits,
approvals, certifications, etc. that must be obtained before the project plans and
specifications can be approved and the project is advertised for bids. Therefore, it is
strongly recommended that preliminary work to obtain the following items, if
applicable, begin as soon as possible:
a. Sedimentation and Erosion Control Permit from the Division of Land Quality, or
a letter from them stating that no permit is required for this project.
b. 401 Water Quality Certification and Army Corps of Engineers 404 Permit for all
stream crossings, or letters from the Army Corps of Engineers and from the
Wetlands 401 Certification Unit stating that none is required for this project.
c. Section 10 Permit for aerial crossings of navigable waters, or a letter from the
Corps stating that none is required for this project.
d. A reasonable subsurface investigation that must be made available to the
contractor. If it is not included in the specifications, the specifications must
advise where a copy of the of the report can be observed. Typically, CG&L

e. NCDOT Encroachment Agreements and Railroad Encroachment Agreements.
Copies of these agreements must be provided in the specifications, or it must be

f. All construction easements, permanent easements, and rights -of -way. These
easements and rights -of -way must be shown on the plans.
6. Please confirm that the proposed project design will comply with NCAC 21-1.0219 -
Minimum Design Requirements, and NCAC 211.0124 - Reliability Requirements.
(A copy of .0219 & .0124 is attached for reference.)
7. Documentation that an agreement between the town and 3M is in place or that the
parties are planning to complete an agreement must be provided before the PER is
approved. The agreement for the Purchase of Reclaimed Water must be completed
and the information in the form of a final agreement must be provided to Construction
Grants and Loans before plans and specifications are approved.
H. Section B
1. (Reference Page 9) The discussion of capabilities and deficiencies on this page does
not include a discussion of the sludge train. This should be included and should
encompass both the capabilities and deficiencies at current flow and treatment levels
and at the flow and treatment levels following this upgrade. Is it anticipated that the
plant upgrade will result in an increase in sludge production? If so, discuss the
capability of the existing sludge train and disposal to handle the increase.
2. Please provide information concerning the proposed sludge treatment and disposal
that addresses how sludge management will comply with the 40 CFR 503 Regulations
including the following:
a. Sludge production calculations at the design flow and a discussion of the methods
that will be used to comply with pathogen and vector attraction reduction.
b. Discuss the adequacy of the ultimate sludge disposal site(s) at the design flow for
the 20-year planning period.
c. Confirmation of an agreement(s) with owner(s) of permitted sludge sites, or a
modifiable permit held by a contract hauler.
3. (Reference Page 19) This page documents a proposed sewer rehabilitation program
to begin in Spring of 2004, based on the results of a Sewer System Rehabilitation
Study (SSES) to be completed in August of 2003. Please provide an update on the
status of the results of the SSES and the proposed rehabilitation program.

4. (Reference Page 20) Please provide a summary table of the current flows that
includes a total amount of current flow.
III. Section C
1. The Office of State Planning provides population data for each county and
municipality that can be accessed on the Internet http://www.ospl.state.nc.us/demog.
Population growth should be based on projected county growth and the historical
relationship between the area population and the county population. Other data may
be used if available but is subject to approval from this office. In areas of historically
fast growth, project design populations may be based on the prior ten -year -growth
rate of the area, if it seems reasonable. The PER must demonstrate that the locality
has or will have adequate capacity - financially, geographically, infrastructure -wise,
etc. - to support a projection of population which exceeds the county growth rate
during that same period.
2. In the event the entire flow estimates cannot be justified, only that portion of the flow
which is justified will be eligible for funding. A Reserve Capacity Cost Ratio
(RCCR) will be generated to determine the level of funding. In order to do so, a cost
estimate will need to be provided for the cost of construction at the flow capacity
justified by Comment #1 above and for that flow capacity that Pittsboro desires to
construct. This ratio will be applied to total project costs to determine which funding
will be provided through our program and which will be funded through local or
alternative funding.
3. (Reference Page 27) Please provide documentation (e.g. a Letter of Intent from the
industry) to support the inclusion of the 150,000 gpd industrial reserve flow allocated
to a potential new industry.
IV. Section D
1. By engineering calculation, please demonstrate the following;
a. The ability of the upgraded treatment plant to produce effluent capable of meeting
reuse water standards.
b. The ability of the pumping station and force main to 3M to handle projected flow
for that line.
2. (Reference Page 37) Please provide a description and a justification for each
treatment plant line item on this page.
Please discuss the proposed reuse program at 3M, particularly regarding final disposal
of the reuse water. How will the water be used, and will it be discharged back into
the collection system?
4. (Reference Page 55) Is an operation & maintenance manual to be prepared for the
upgraded treatment plant? If so, that cost should be included in the cost estimate.
5. Present worth should be calculated based on the following:

201 Facilities Plan
Dear Mr. Hughes:
I am writing to acknowledge receipt of two copies of the subject 201 Facilities Plan on
August 4, 2003. A request was previously made for a determination by Construction Grants and
Loans concerning whether the subject project would qualify for a Categorical Exclusion, using
two alternate routes for the reclaimed water line to the 3M plant. The plan that has been
submitted indicates that the alternate route that is located along Turkey Creek has been selected
and, as noted in my May 9 letter, this alignment may or may not qualify for a Categorical
Exclusion, and an environmental assessment will be needed. Based on a discussion with the
town's consultant engineers, Hydrostructures and Diehl & Phillips, it is my understanding that
the town does not want to pursue a Categorical Exclusion for this project, and an environmental
assessment is being prepared that meets EPA's environmental information document
requirements for a STAG funded project.
If SRF funding is not currently being requested and the town does not plan on requesting
SRF funding for this project, it is recommended that the document be re -titled and reformatted to
be a Preliminary Engineering Report (PER) instead of a 201 Facilities Plan. The PER for a
STAG funded project may address only current needs, and it is recommended that only current
needs be discussed to avoid possible confusion and unnecessary review concerns by the resource
agencies, which will comment as a part of the environmental review process. It is my
understanding that the environmental assessment being prepared will only address the current
needs, which consist of improvements at the WWTP to meet reuse effluent standards and the
reuse effluent pump station and force main, and that a Finding of No Significant Impact is only
requested for these current needs.
Eighteen copies of the document, which include the environmental assessment, will need
to be submitted to the Construction Grants and Loans Section. The Construction Grants and
Loans Section will perform a technical and environmental review, and the document will also be

A compliance inspection was conducted of the Pittsboro W WTP on November 26, 2003.
Mr. Perry Dunn, ORC for the wastewater treatment portion represented the Town during the
inspection. As a result of the inspection, the following comments are offered:
1) The 0.75 MGD treatment facility consists of manual and mechanical barscreens, 2 aeration
basins, 2 secondary clarifiers, 3 tertiary filters, UV disinfection, effluent flow meter in
parshall flume, cascade post aeration, sludge thickener, and aerobic digester.
2) The sludge is stabilized at the WWTP. Sludge is land applied by Synagrow.
3) The effluent sampler temperature was 5 degrees C. The influent sampler temperature was 0
degrees C. Both effluent and influent sample thermometer must be calibrated and sample
refrigerator must be maintained at 0 to 4 degrees C.
4) A review of the plant records compared to the submitted DMRs for the month of March 2003

Pittsboro Reclaimed Water Project
I am writing in response to letters dated April 10 and April 17, 2003 from the town's
consultant engineer, Hydrostructures, P.A. The letters requested a determination concerning
whether the subject project would qualify for a Categorical Exclusion using two alternate routes
for the reclaimed water line to the 3M plant. The Categorical Exclusion would allow the
project's Preliminary Engineering Report to be reviewed with a limited environmental review
and without the requirement for a Finding of No Significant Impact. EPA allows the Categorical
Exclusion for qualifying projects that are receiving a State and Tribal Assistance Grant (STAG)
funding. Since this project will receive STAG and State Revolving Loan (SRL) funding, either a
Preliminary Engineering Report or a 201 Facilities Plan may be submitted for approval as the
planning document. A 201 Plan would be required if a State Revolving Fund (SRF) loan was
being requested.
The April 10 letter (copy attached for reference) presented the scope of the project and a
route for the reclaimed water line to the 3M plant. The route for the reclaimed water line
presented in this letter, indicates that approximately 1400 linear feet of reclaimed water line
south of Cornwallis Street is not on the road's right-of-way. If a description of the area where
the line is located off of the road's right-of-way shows that this area is previously disturbed
and/or does not contain any of the resources listed in items 2, 3, or 4 of Table 2 of the
Categorical Exclusion checklist (copy attached for reference), the project would qualify for
Categorical Exclusion.
The April 17 letter (copy attached for reference) presented an alternate route for the
reclaimed water line to the 3M plant. This alignment may or may not qualify for Categorical
Exclusion, since the line will be located along Turkey Creek. For this alternate alignment, an
Environmental Assessment will be needed as part of the Preliminary Engineering Report to make
a final determination.

A compliance inspection was conducted of the Pittsboro WWTP on December 20, 2002.
Mr. Perry Dunn, ORC for the wastewater treatment portion represented the Town during the
inspection. As a result of the inspection, the following comments are offered:
1) The 0.75 MGD treatment facility consists of manual and mechanical barscreens, 2 aeration
basins, 2 secondary clarifiers, 3 tertiary filters, UV disinfection, effluent flow meter in
parshall flume, cascade post aeration, sludge thickener, and aerobic digester.
2) The sludge is stabilized at the WWTP. Sludge is land applied by Synagrow.
3) The effluent sampler temperature was 5 degrees C. The influent sampler temperature was 0
degrees C. Both effluent and influent sample thermometer must be calibrated and sample
refrigerator must be maintained at 0 to 4 degrees C.
4) A review of the plant records compared to the submitted DMRs for the month of July 2002
indicated no discrepancies. Calibration records for dissolved oxygen, and pH meters were
satisfactory.

A compliance inspection was conducted of the Pittsboro WWTP on April 19, 2002. Mr.
Bill Davis, back-up ORC represented the Town during the inspection. The findings during the
inspection are as follows:
1) The 0.75 MGD treatment facility consists of manual and mechanical barscreens, 2
aeration basins, 2 secondary clarifiers, 3 tertiary filters, UV disinfection, effluent flow meter in
parshall flume, cascade post aeration, sludge thickener, and aerobic sludge digester.
2) Sludge is land applied by Synagrow. Sludge is lime stablized at the WWTP.
3) An inspection of the ORC log indicated that entries had been made through March 27,
2001. The ORC log should be kept up to date. A review of the plant records compared to the
submitted DMRs for the months of November 2001 and January 2002 indicated no
discrepancies. Calibration records for dissolved oxygen, and pH meters were satisfactory.
4) The plant sampler were not sampling since the facility samples 3 times per week. The
effluent sampler temperature was 4 degrees C. The influent sampler must have a calibrated
thermometer installed. The thermometer was broken.
