The Division of Water Quality (the Division) hereby issues the attached NPDES permit for the
subject facility. We issue this permit pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency dated October 15, 2007, or as subsequently amended.
Changes to Your Previous Permit. Your request to discontinue Whole Effluent Toxicity (WET)
testing cannot be approved as this is required of fuel bulk -storage facilities statewide. However,
the Division has reduced your monitoring frequency for the parameters Oil & Grease and
Naphthalene, per your request, from Monthly to Quarterly, based on no detection over the past
permit cycle. Your discharge of "hydrotest" waters is permitted [see Section A. (L), "Other
Requirements"] provided you have verified in advance that benzene and toluene levels are not
present above surface -water quality standards for a receiving stream classified water supply
(benzene <1.19 µg/L; toluene <11 µg/L). Therefore, no changes needed for renewal.
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing, upon written request submitted within
thirty (30) days after receiving this letter. Your request must take the form of a written petition
conforming to Chapter 150B of the North Carolina General Statutes, and you must file it with the
office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-
6714. Unless such a demand is made, this permit shall be final and binding.

In compliance with the provisions of North Carolina General Statute 143-215.1, other lawful standards

to receiving waters designated as an unnamed tributary to Long Creek, subbasin 03-08-34 within the
Catawba River Basin, in accordance with effluent limitations, monitoring requirements, and other
conditions set forth in Parts I, II, III and IV hereof.
This permit shall become effective March 1, 2011.
This permit and authorization to discharge shall expire at midnight on June 3 0, 2015.

All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.
Marathon Petroleum Company, LP
is hereby authorized to:
1. continue to operate a Surface -Water Pollution Prevention Plan for stormwater in proximity to above-
ground storage tanks (ASTs), surface bulk -storage of ethanol and petroleum hydrocarbon fuels in
excess of one million gallons, and fuel -truck loading racks, utilizing
• oil -water separator (10,000-gal)
0 two (2) holding tanks (10,000-gal each)
• bermed secondary containment for ASTs
• final holding pond (currently 160,000 gallons) with hand -operated discharge
valve (normally closed)
located at the Marathon Petroleum Company, LP, Charlotte NC Terminal, 8035 Mount Holly Road,
Charlotte, Mecklenburg County, and
2. discharge from said treatment facilities via Outfall 001 at the location specified on the attached
map, into an unnamed tributary to Long Creek [stream segment 11-120-2.5], a waterbody
currently classified WS-IV within the Catawba River Basin.

Footnotes:
Flow — shall be monitored during each discharge event — During periods of no flow, the Permittee shall submit a
signed, monthly Discharge Monitoring Report (DMR) indicating "No discharge." Flow may be monitored using any one
of the following four methods:
a) measure flow continuously;
b) calculate flow [see Rational Equation , section A. (3)] based on total rainfall per unit area
draining to the outfall; exclude built -upon areas (best method for facilities with large
runoff -collection ponds);
c) estimate flow at 20-minute intervals during the entire discharge event; or
d) report flow based on discharge pump logs."
2. Oil and Grease — Where possible, the grab sample for oil and grease should be skimmed from
the surface of a quiescent (calm water) zone.
3. Turbidity — Effluent shall not cause receiving -stream turbidity to exceed 50 NTU. If receiving -stream
background exceeds 50 NTU, effluent shall not cause this background value to increase.
4. Concurrent Sampling - the Permittee shall acquire samples concurrently with Acute Toxicity.
5. Acute Toxicity Outfall 001 (Fathead Minnow, 24-hour), Annual [see Special Condition A. (2.)].
Other Requirements:
The Permittee shall discharge no floating solids or foam visible in other than trace amounts.
There shall be no direct discharge of tank solids, tank bottom water, or the rag layer.
There shall be no direct discharge of tank (or pipe) contents following hydrostatic
testing unless benzene concentration is less than 1.19 µg/L and toluene concentration
is less than 11 µg/L.

A. (2.) ACUTE TOXICITY MONITORING (ANNUAL)
The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document
EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas)
24-hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste
treatment. The permittee will conduct one test annually, with the annual period beginning in January of
the calendar year of the effective date of the permit. The annual test requirement must be performed and
reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this
date. Toxicity testing will be performed on the next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit
condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was
performed, using the appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent
to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Section no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina -
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following the
month of the initial monitoring.

A. (3.) RATIONAL EQUASION FOR CALCULATING FLOW
The Rational Equation: Q=KuCIA,, where:
Q = flow (peak flow rate (cfs or m3/sec)
Ku = units conversation factor = 1.008 for U.S. standard units (usually ignored because
it -is so close to 1), or 0.278 for SI units •
C = dimensionless runoff coefficient for the watershed, loosely defined as the ratio of
runoff to rainfall
I = intensity of rainfall taken from the intensity -duration -frequency curves for the
specified design return period at the time of concentration, tc (in/h or mm/h). tc =
time of concentration (time after the beginning of rainfall excess when all portions
of the drainage basin are contributing simultaneously to flow at the outlet).
A = area of tributary watershed (acres or km2)
The rational equation is used to calculate the runoff from a region, given:
• runoff coefficient which accounts for infiltration and other potential losses in
the region, •
• rainfall intensity to the region,
• time it takes for runoff to travel from the region's upper reaches to its outlet,
and
• region's drainage area.

Joe,
We offer no comments to the permit as drafted. Also, note that we did'not see a copy of the amended renewal
application for the subject facility. Our Staff report reflected the original application dated January 11, 2010. We have
no problem with the removal of outfall 002. In the original application, Motiva requested to maintain the ability to
discharge treated groundwater from the air stripper through outfall 002 during heavy rainfall events. It seems that the
company figured out a way around keeping outfall 002.

Joe,
Upon review of the draft NPDES permit we only have a couple of comments mainly for clarification. These items are as
follows:
- Regarding the reference to a Surface -Water Pollution Prevention Plan (Supplement to Permit Cover Sheet
page), it is our understanding an actual written Plan is not required rather this references the existing practices
the terminal performs when addressing stormwater.
- Regarding the "hydrotest water", since the water is required to be tested following specific parameters for
"hydrotest water" prior to discharge, we want to avoid comingling this water with stormwater. Since the
outfall is connected to the pond that contains stormwater we had earlier requested approval to discharge the
"hydrotest water" at a location different than the outfall.
We had a short discussion on this earlier however, upon further review, the cover letter of the draft permit
reads that no changes were required to the permit because the water was verified in advance that levels were
not above surface -water quality standards. Does this mean we would be allowed to release the water to the
receiving stream at a location different than the outfall?
If you would confirm, correct or expand on the above items, it would be greatly appreciated. Thanks in advance.

prior to discharge; and the discharge does not contravene the designated water quality standards.

We appreciate your understanding considering current hard times in DWQ's permitting group (5 empty chairs /
Governor's hiring freeze). Your renewal application is gradually ascending to the top of my pile — about #4 of 34 permits.
My goal is to get a draft permit to you before Thanksgiving. It would help if you could provide a site plan showing
facilities, outfall location(s) and your property perimeter (e-copy if you have it) so we might upgrade your facility map

separator is removed by Aaron Oil, Inc., and transported to Mobile, Alabama for disposal.
Waste from oil holding tank is pumped and hauled by Aaron Oil, Inc., and transported to
Alabama for treatment, tel # 1-251-679-6900.

concern other than the obvious. Air quality permit for this site is not required by
Mecklenburg County.
PART IV - EVALUATION AND RECOMMENDATIONS
Marathon Petroleum Company, LLC is requesting NPDES Permit renewal for the
discharge of treated wastewater from the facility.
According to Mr. Doug Bond, Environmental Compliance with Marathon Petroleum, The
last three years of data showed that there have not been any detectable levels of volatiles or semi-
volatiles and the other monitoring requirements have been all within acceptable limits. Therefore,
Marathon Petroleum is requesting the following changes to be implemented in the permit.
a- Allow the Oil and Grease monitoring to be conducted on a quarterly basis rather
than monthly.
b- Allow the Naphthalene monitoring to be conducted on a quarterly basis rather
than monthly.
c- Elimination of the Acute Toxicity testing.
Also, the Company is requesting that the hydrotest water to be discharge directly to the creek and
bypass the pond since the pond capacity is about 160,000 gallons and the discharge from the test
is about 140,000 gallons. Also, they are requesting to testing the wastewater from the tank
before the discharge rather than during the discharge to assure the limits are met prior to
discharging. We offer no objections for the hydrotest water to bypass the pond after meeting the
limits requirements. The Western NPDES Program is Unit is to comment on Item a, b and, c.
Pending review and approval by the Western NPDES Program Unit, It is recommended
that the NPDES permit be renewed.

Dear Mr. Weaver:
Enclosed, please find the application for the renewal of the referenced NPDES permit. During
the preparation of the application we reviewed the last three years of monitoring data. Based on
this review, it was determined that there have not been detectable levels of volatiles or semi-
volatiles and the other monitoring requirements have been well within acceptable limits. Based
on this, we are requesting the North Carolina Division of Water Quality to consider the
following:
1) Allow the Oil and Grease monitoring to be conducted on a quarterly basis rather than
monthly.
2) Allow the Naphthalene monitoring to be conducted on a quarterly basis rather than
monthly.
3) Elimination of the Acute Toxicity testing.
I have enclosed the monitoring reports in the event they would be helpful with your decision.
In addition, in the event of a hydrotest, we would like to have the option to discharge through a
hose at or near the point of the outfall rather than discharging to the pond and having the water
discharged through the outfall pipe. We feel this would be a more efficient approach by
segregating the hydrotest water from storrawater present in the pond. We also propose sampling
the hydrotest water while it is stored in the tank rather than during the discharge to assure the
limits are met prior to discharging.
We understand the importance of addressing the water quality within North Carolina and make
every effort to assure the discharged water does not impact the receiving stream. We are hopeful
you will approve our requests based on the reasons presented.
In regards to a sludge management plan, the facility does not generate solids from wastewater
treatment; therefore, a plan has not been developed.
