Dear Mr. Almond:
It has come to the attention of the Division that a discrepancy exists in your currently issued NPDES permit. The
"EFFLUENT LIMITATIONS AND MONITORING" page currently contains a requirement for a Daphnid 48
hour toxicity test, while Part III, Condition E specifies a fathead minnow 24 hour test. Your facility has an
episodic discharge, and is therefore required to perform a 24 hour static test employing a fathead minnow as the
test organism. In accordance with this determination, your NPDES permit has been modified to reflect the
appropriate changes.
Attached to this correspondence is an amended "EFFLUENT LIMITATIONS AND MONITDRING" page which
should be inserted into your permit. The old effluent limitations and monitoring page should be discarded. All
other terms and conditions contained in the issued permit remain unchanged and in full effect. These permit
modifications are issued pursuant to the requirements of North Carolina General Statutes 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency. This
permit modification becomes effective immediately.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you,
you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this
letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings, Post Office Drawer 27447, Raleigh,
North Carolina 27611-7447. Unless such demand is made, this decision shall be final and binding.

Samples taken in compliance with the monitoring requirements specified above shall be taken at the following location(s): the nearest
accessible point after final treatment but prior to actual discharge to or mixing with the receiving waters. Monitoring will be conducted during
normal work hours.
** All volumes of wastewater leaving the facility shall be monitored. If continuous flow monitoring is not feasible, then the discharger shall
record the approximate time that discharge began and ended, along with the instantaneous flow at the time of effluent sampling.
This Permit imposes no limitation of the discharge of storm water runoff uncontaminated by any industrial or commercial activity and not
discharged through any oil/water separator or other treatment equipment or facility.
*** The discharge shall not cause the turbidity of the receiving water to exceed 50 NTU. If the turbidity exceeds these levels due to natural
background conditions, the discharge level cannot cause any increase in the turbidity in the receiving water.
**** Acute Toxicity (Fathead 24 hour) Monitoring, Episodic, See Part III, Condition E.
***** Monitoring shall be conducted during the first five discrete discharge events after the effective date of this Permit, and then on an annual
basis thereafter, with the annual period beginning January of the next calendar year. The annual test must be performed and reported by June
30. If no discharge occurs by June 30, notification must be made to the Division by this date, and monitoring must be performed on the next
discharge event for the annual monitoring requirement.
The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be monitored 2/month at the effluent by grab
samples.
There shall be no discharge of floating solids or visible foam in other than trace amounts.
