Dear Mr. Arrington:
Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is
issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated May 9, 1994 (or as subsequently amended).
This final permit includes the following changes from the draft permit sent to
you on April 26, 2006:
➢ To support nutrient -sensitive modeling for the Jordan Lake watershed, the Division
now requires dischargers to report the component species (TKN and (NOs-N + NOz-N))
as well as Total Nitrogen (M. Your lab already analyzes the species in order to
calculate TN values; this added condition merely requires you to report the
intermediate results along with the TN value.
➢ All permits in the Jordan Lake watershed now include a re -opener Special Condition.
In the event that the EMC adopts a Nutrient Management Strategy or the EPA
approves a TMI)L in the coming permit term, the condition allows the Division to re-
open affected permits to set nutrient limits and related conditions accordingly.
Be aware that the Haw River is listed as an impaired stream on North Carolina's 303(d)
list. This means that the stream does not meet all water quality standards. Although the Division
believes multiple sources are causing degradation to the Haw River, we will continue to monitor
compliance at your facility. If noncompliance with your permit's effluent limits is shown to be a
direct cause of stream degradation, the Division will recommend removal of your discharge. Part
III of your permit requires ' you to "continually evaluate all wastewater disposal alternatives and
pursue the most environmentally sound alternative of the reasonably cost effective alternatives" to
surface water discharge. Such an evaluation may help you find an alternative to surface water
discharge that is more appropriate for your facility.

Your facility discharges to a nutrient -sensitive water (NSW). In 1997 the Clean Water
Responsibility Act (House Bill 515) was enacted, with the intent to strengthen the control of
nutrients from all discharges to NSW waters. Any new (or expanding) will be subject to nutrient
limitations for total nitrogen and total phosphorus according to House Bill 515 requirements.
Since modifications to treatment systems are expensive and time consuming, it is highly
recommended that you begin planning for this possibility now if a future expansion is anticipated
at your facility.
If any parts, measurement frequencies or sampling requirements contained in this permit
are unacceptable to you, you have the right to an adjudicatory hearing upon written request
within thirty (30) days following receipt of this letter. This request must be in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed
with the Office of Administrative Hearings "(6714 Mail Service Center, Raleigh, North Carolina
27699-6714). Unless such demand -is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The
Division may require modification or revocation and reissuance of the permit. This permit does
not affect the legal requirements to obtain other permits which may be required by the Division of
Water Quality or permits required by the Division of Land Resources, the Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.

revoked, and as of this issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under

Sludge from the Oak Ridge Military Academy wastewater treatment plant are disposed of in the following
manner:
Solids are collected in the sludge holding tank and digested aerobically. The excess solids are
periodically pumped and hauled by a licensed septic pumper contractor and disposed of at the city of Elkin
wastewater treatment plant.
