The Division has received your January 24, 2005 proposal for permit modification at the subject facility. In your letter, you requested phased limits for your facility including both 1.3 MGD and 0.5 MGD flow limits and the corresponding requirements. In accordance with your permit modification request and our review, the Division is forwarding herewith a modification to the subject permit. Enclosed please find the modified permit pages. These pages should be inserted into your permit and the old ones discarded. This pemrit modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended). Please take notice that this permit is not transferable. This permit does not affect the legal requirement to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management Act or any other Federal or Local government permit that may be required. As of this permit issuance, any previously issued permit bearing this number is no longer effective. Discharge from said treatment works at the location specified on the attached map into the Deep River, classified GHQW waters in the Cape Fear River Basin. Permit Na062855 A. (L) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS During the period beginning on the effective date of the permit and lasting until the Division of Water Quality grants written authorization to increase the facility's flow limit, the Permittee is authorized to discharge from outfall 001. Compliance shall be based upon a quarterly average of weekly samples. 7. Chronic Toxicity (Ce wdaphrca) limit at 4% with testing in January, April, July and October (see A. (3)). There shall be no discharge of floating solids or visible foam in other than trace amounts. Permit NC3062855 SUPPLEMENT TO EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS A. (3.) CHRONIC TOXICITY PERMIT LIMIT (QUARTERLY) The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Gxix*brriu dubia at an effluent concentration of 4 %. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina C r ak lmi C11ronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July, and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or C hV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR 1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWQ Form AT-3 (original) is to be sent to the following address: Attention: NC DENR DWQ / Environmental Sciences Branch 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the pemmittee will complete the information located at the top of the aquatic toxicity (Al) test form indicating the facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. It is my understanding that you will include a footnote which will require the Town to change to the 1.30 MGD limits page when the 12-month average exceeds 90% of the permitted flow of 0.500 MGD. This change will be included when the permit is issued in May with an effective date of July 1, 2005. The permit was last issued on May 21, 2002 and expires March 31, 2006. The Permittee has requested several modifications to their permit as a result of the recent loss of the town's largest industrial user. The Town is requesting that the permit be modified to a tiered permit allowing a lower flow of 0.5 MGD and a higher flow of 1.3 MGD (their current flow). They have also requested we remove the limits for mercury and total phosphorus. Flow: In July of 1999 the permitted flow for the Robbins WWTP increased from 1.0 MGD to 1.3 MGD to accommodate demand_ Perdue Farms, the town's largest industrial user, had a permitted industrial flow of 0.82 MGD and an average flow of 0.72 MGD. In January 2003, Perdue ceased production at this facility. Their discharge to the town's WWTP was eliminated and average flows from the Robbins WWTP have dropped dramatically. From 2000 to 2004 average annual flows were as follows: • 2000 — 0.86 MGD • 2001 — 0.70 MGD • 2002 — 0.51 MGD • 2003 — 0.25 MGD • 2004 — 0.23 MGD The Town requests to have a first tier with a 0.5 MGD flow limit. Given the flow data of the past two years, this would seem to be enough to meet current need. The Town also requests to keep the current flow limit as a second tier as the plant has been recently built to handle 1.3 MGD and the town does hope to use this capability in the future. Fact Sheet NPDGS NC0062855 Modification Paec 1 Mercury The town began using method 1631 for mercury analysis in September 2003. Since they monitor weekly, this provided 70 data points for a reasonable potential analysis. The RPA indicated no reasonable potential to exceed stream standards at either the 1.3 MGD or the 0.5 MGD flow limits. Total Phosphorus Although the Deep River is not listed as impaired on the 2002-303(d) list, the basin plan does indicate that impounded segments of the river near Carbonton can be periodically affected by low dissolved oxygen due to algal blooms. For this reason, TP limits have been required in permits of new and expanding dischargers in this area. For facilities expanding to 0.5 MGD or greater (up to 1.0 MGD) a 2.0 mg/1 limit has been required, and for facilities expanding to 1.0 MGD or greater a 1.0 mg/1 limit has been given. Robbins WWTP currently has a limit of 1.0 mg/1 for TP and has consistently met this limit. A 2.0 mg/1 limit will also be included in the 0.5 MGD effluent page. Cockman, CMC Clerk/Finance Officer Daniel L. Brown Chief of Police The Town of Robbins would like to request a modification to its existing NPDES Permit. In January 2003, Perdue Farms, the Town's largest industrial user, ceased production and discharge to the Town's wastewater treatment plant. Perdue Farms represented approximately 57% of the Town's discharge. Since their closing, the Town's annual average discharge has been reduced to 0.232 MGD. The Town of Robbins wastewater treatment plant is a 1.3 MGD design capacity treatment facility. Operating at less than 20% of the design capacity has challenged the Town's wastewater operation in regards to economically satisfying current treatment needs with grossly oversized treatment units and equipment. The Town is faced with numerous financial challenges as a result of this enormous loss in revenue. Corrective measures will require aggressive adjustments throughout the Town's operational and budgetary structure. We are requesting that the current Town of Robbins NPDES Permit be modified from a Grade III Permit to a Tiered NPDES Permit. We request that the Tiered Permit be provided with a flow limit of 0500 MGD and Grade II sampling and monitoring frequency to correspond with the current facility loading. The Town of Robbins made an enormous financial commitment to provide the 1.3 MGD wastewater treatment facility and desires to maintain its capabilities for future use. Therefore, the Town requests that the tiered NPDES permit allow for the return to 0 q��o 4 Ms. Dawn Jefferies Page 2 January 24, 2005 Grade III Permitted conditions once the discharge flow consistently exceeds the Grade II 0.500 MGD limit. The Town of Robbins also requests that all of the current permit limits be re-evaluated based on the significant reduction in flow to the receiving stream. This reduction in flow may affect the 7Q10 and subsequently provide the Town with increased limits. Specifically, in regards to limits, the Town requests that the Total Phosphorous and Mercury limitations be removed from the permit. As noted earlier, the Town's largest industrial user which was a poultry processing plant represented 57% of the Town's flow. Once the poultry plant closed, the organic and hydraulic characteristics of the Robbins Wastewater Treatment Plant were significantly reduced. Due to these circumstances, we request that the Total Phosphorous limit be removed from the permit. The Town of Robbins is committed to continued environmental compliance and protection of our receiving stream. A review of past operating data will indicate that the Robbins Wastewater Treatment Plant has experienced 100% compliance with permitted limits for over 2 years. As you are aware, the Town lost its largest industrial user which has affected the flow tremendously. _I_talked with Ms. Dawn Jefferies of the DWQ Permitting section about including a monitoring page with a permit flow of 0.5 MGD which will reclassify the plant as a grade II facility. She said that the Division could modify the permit to include the new permit limit page if the local regional office was in agreement. Would you please contact Ms. Jefferies and let her know if the Fayetteville regional office is in agreement. Also, are there any forms that will require completion? Brown Chief of Police F E B - G 2003 This is a follow-up to your conversation with Mr. Brant Sikes, Robbins WWTP ORC, concerning the mercury detections in the effluent and what the Town is doing to eliminate the mercury from the effluent. As you are aware, the Town is conducting an investigation to determine the source(s) of mercury. Samples have been collected within the collection system, at the influent, before and after chemical addition at the treatment plant, and from the industrial users. Attached for your review is an updated summary of the mercury results from the sampling campaign. As you will note, mercury is primarily detected at the Shield's Woods lift station and after the addition of caustic. The Shield's Woods lift station is located in an area that is predominately residential. We are in the process of surveying the dischargers to the lift station to identify the source. After meeting with the Town's wastewater treatment consultants, Hydro Management Services on January 16, we have identified the Health Center as a possible source. The Town is scheduled to collect mercury samples at a manhole before the Health Center and at a manhole after the Health Center but prior to the lift station. In addition, samples will be collected at the lift station. The effluent mercury results received as of date of this letter for the month of December were all reported as less than 0.2 ug/i. The Town is actively searching for the source(s) of mercury. We will keep you informed of our findings.
