The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: The placement of culverts in streams must be below the elevation of the streambed by one foot for all culverts greater than 48 inches to allow low flow passage of water and aquatic life. It's unclear from the culvert profiles provided for impact areas S1 and S2 whether this condition will be met, particularly as rip rap pads at the culvert outlets are proposed. Please provide a culvert cross section detail showing the provisions for culvert burial that demonstrates the culverts will meet this condition, or modify the profile figure via notes, adjustments to the figure, etc. to ensure this condition will be met. [15A NCAC 02H .0506(b)] Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide your response by February 28, 2024. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and appropriate fee. Good Morning Shannon, have attached a revised exhibit and impact table section from the PCN. Wetland impacts W3 and W4 have been avoided. The rip rap at crossing S2 has been upsized and the impact has been reduced to 20 feet. As discussed in the field, the rip rap will be embedded into the stream such that it will be flush with the existing bed. There will be no net loss associated with the rip rap at either crossing. Based on our observations, the streams consist of low flow pools as they enter the flood plain at the areas that will be impacted by rip rap. Existing aquatic function of the streams will not be compromised. The stream and wetland impacts as proposed account for 0.0939 acres, not including the rip rap impacts. have included photographs of the Rutledge House. As noted from the photographs, the Rutledge House has broken windows, a tarp over the roof, damaged soffits and one of the doors has been kicked in. The house is to be repaired and remain on the site. Wetland impact area W2 is located within the view shed of the Rutledge House. There is woody vegetation located between the house and the impact area, The wooded area is located on a steep slope and will remain. As it matures, additional buffer will be separate the impact area and the residence. Please let us know if you need additional information in order to complete the Section 106 evaluation. As we discussed, we would like to fit this project under the NWP 18 which requires less than 0.1 acres loss of waters. I have discussed with my colleagues whether they consider keyed in riprap in the bed of streams as a loss of water and it seems like the answer is fairly project dependent. For this project, I will need justification for why the length of riprap for impact S2 is necessary as the stream did not seem excessively steep. We also discussed leaving the forested buffer between the existing Rutledge House and the wetland below. This, along with the pictures you took today, will be a great help in our Section 106 evaluation. If you know any history of the house that would be relevant to its historical significance (or lack thereof) that would also be beneficial to know. Please also provide justification as to why impacts W3 and W4 associated with lot fill cannot be avoided. I've looked through the plans and have a few more questions: Stream impacts indicate that the proposed riprap will impact the "stream channel." Please clarify whether the proposed riprap associated with S1 and S2 will only be installed along the streambanks or whether there will be material placed within the bed of the stream. While the owners of HN1253 Rutledge House may not wish to have the property listed on the National Register of Historic Places, we still must consider it a potentially eligible structure. Please provide any pictures of the house, information on when it was constructed, and any significance it might have (or lack thereof). I would like to come visit the site and take a look at the impact areas. I am available this Friday 1/9 at 10am or 12:30pm, or I am available next Thursday 1/18 at 10am. Please note, a Nationwide Permit (NWP) 18 was requested but this application will be processed as a NWP 29 for residential development projects as the project impacts exceed the NWP 18 thresholds. The following information is requested: 1. Please provide new plan sets via email as the provided plans appear to be cut off at the edges, see attached. The updated plan set showing the entire site is attached. 2. There is a potentially eligible historic property (HN1253 Rutledge House) within the project area. Please provide pictures of the property, any information you have regarding the structural integrity of the property, and details on how the structure will be impacted by the proposed development. The house will remain in place and be incorporated into the new development. The structure will not be impacted by the proposed development as the grading is not close to the structure. There is no concern about the structural integrity of the house. The owners do not intend to list the structure on the historic registry. Please provide an acreage estimate of the total tree clearing. The civil has calculated the tree clearing on the whole site to be approximately 16.7 acres. Please provide the above requested information by February 2, 2024, otherwise the application will be withdrawn.
