Gastionia, North Carolina 28052 Subject: Amended Special Order by Consent City of Gastonia Gaston County Dear Mayor Jeffers: As requested, enclosed are an original and three (3) copies of an Amended to Special Order by Consent Number EMC WQ 79-33. The Amended to Special Order by Consent Number EMC WQ 79-33 will be put on the agenda of the next Environmental Management Commission Meeting, if executed by the city. Appropriate representatives of the city must be present at the Environmental Management Commission Meeting to request the Amendment, The next Commission meeting will begin at 9:00 a.m. on January 10, 1980 in the Archdale Building in Raleigh, North Carolina. The enclosed Amended to Special Order by Consent Number EMC WQ 79-33 should be signed and returned by noon January 8, 1980 so that the Commission meeting's agenda may be completed. Box 27687 Raleigh, North Carolina 27611 An Equal Oppottunity Atiirmatir•e Action Employer ppppppp- NORTH CAROLINA AMENDED SPECIAL ORDER BY CONSENT EMC WQ 79-3 3 GASTON COUNTY IN THE MATTER OF THE DISCHARGE OF INADEQUATELY TREATED WASTEWATER FROM THE CITY OF GASTONIA, WATER TREATMENT PLANT GASTON COUNTY NORTH CAROLINA WASER pN� This ORDER BY CONSENT is made and entered into y the City of Gastonia, hereinafter referred to as the CITY, with the North Carolina Environmental Management Commission, an agency of the State of North Carolina, hereinafter known as the COMMISSION. WITNESSETH: I. _The CITY does hereby stipulate as follows: A. The CITY owns and operates a water treatment plant located in Gaston County, North Carolina, and in operating said water treatment plant does_ discharge_filter backwash Seater and alum sludges to. an unnamed. tributary to Long Creek in the Catawba River Basin. B. The CITY will be unable to comply with final effluent limitations required by the COMMISSION to.protect water quality in the receiving stream without the construction of wastewater treatment facilities. II. The CITY and the COMMISSION recognize the following: A. The wastewater from the water treatment plant receives no treatment prior to discharge to the surface waters of the State. B. The CITY shall achieve compliance with the final effluent.limitations contained in NPDES Permit No. NC 0040070 by ceasing all discharges to the surface waters and discharging the wastewater to the City sewerage system for treatment. III. The CITY, desiring to comply with the legal requirements of the COMMISSION regarding waste disposal and with all pertinent provisions of the law and applicable rules and regulations of the COMMISSION, does hereby agree to do and perform all of the following things: A. Comply with the following interim effluent limitations and monitoring requirements: A. (1) EFFLUENT LIMITATIONS AND MONITORING, REQUIREMENTS - INTERIM During the period bog inning on Lhe ei'Ferti ve c.lato of Order and lasting Until May 31, '1980, the perm-ittee is authorizea 'to discharge from outfall serial number 001. Monitoring and reporting of the wastewater treatment plant influent, effluent, and surface waters shall be in compliance with Title 15, NCAC,;Chapter 2, Subchapter 26, Section .0505, .0506, and .0508 (Surface Water Monitoring, Reporting). The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units and shall be monitored weekly by grab samples at E, U, D. Construct wastewater collection facilities in order to cease all discharges of wastewater to the surface waters from the water treat- ment plant in accordance with the following time schedule: (1) Submit a progress report on or before January 18, 1980; (2) Complete construction and cease all discharges of wastewater to the surface waters on or before May 31, 1930. IV. Any violation of the terms and conditions of this Order, including failure to comply with interim effluent limitations and to meet the compliance schedule shall subject the CITY to enforcement action pursuant to N.C.G.S. 143-215.6, including the assessment of civil penalties.
