the volume of wastewater to be permitted in this project has been evaluated along the route to the receiving
wastewater treatment facility and that the flow from this project is not anticipated to cause any capacity
related sanitary sewer overflows or overburden any downstream pump station en route to the receiving
treatment plant under normal circumstances, given the implementation of the planned improvements
identified in the planning assessment where applicable. This analysis has been performed in accordance
with local established policies and procedures using the best available data. This certification applies to
those items listed above in Sections I and II plus all attached planning assessment addendums for which I

On behalf of Heritage Crossing LLC, WithersRavenel is submitting a Sewer Extension Application
for in Wilson, Wilson County, North Carolina. Please find the attached documentation in
support of a Fast Track Application (FTA 06-21) for the referenced project. As noted in the
application, this project will consist of 3,562 LF of 8" SDR 35 PVC sewer and located east of and
within Legends Drive. The sewer proposed within this application will service 288 apartment
units inclusive of 540 bedrooms in the Heritage Crossing of City of Wilson and connects to
sewer constructed and permitted under WQCS00021.

information is required in order to further process the application. Please provide the following information by
December 9, 2023, and note that the requested information must be submitted within 30 days of this request,or the

the receiving sewer. Please provide the required maps according to the application requirements.

Apologies for the confusion. No operational agreement form is necessary. According to 15A NCAC
02T.0304(g), the only requirement for permit approval is an agreement between the applicant, the
downstream sewer owner, and the wastewater treatment facility owner for the collection and final
treatment of wastewater to be in full force and effect. I will finish processing your FTA for permit
issuance.

Elaine,
The project is a multi-family apartment complex that will solely,for its life, be owned by one entity.
The development is not being subdivided and sold off.The owner of the buildings, the land, and the
sewer will be the same entity, even if the development changes hands. In the past for these types of
developments we have either not had to provide any additional forms for conveyance in a private
facility, or filled out the Home/Property Owners's Operational Agreement.These entities have all been
for-profit. Is there something we are missing here in order to get this approved?

Is Heritage Crossing Holdings LLC. a developer or the Home Owner's Association? If the company is a
corporation and it is likely that the lots will be sold once the project is complete,then the Developer's
Operational Agreement may be more appropriate. Please visit the Sewer Extension Permitting link
below and review the Developer Operational Agreement (DEV 12-23) and Homeowner's Association
Operational Agreement(HOA 12-23) documents, along with 15A NCAC 02T.0115 Operational
Agreements for more information on what form applies to Heritage Crossing Holdings. Then please
resubmit accordingly.

15A NCAC 02T.0115 OPERATIONAL AGREEMENTS
(a) Prior to issuance or reissuance of a permit pursuant to this Subchapter for a wastewater facility or sewer
extension as specified in G.S. 143-215.1(dI),a private applicant shall:
(1) demonstrate that the applicant has been designated as a public utility by the North Carolina
Utilities Commission and is authorized to provide service to the specific project area.This may be
a Certificate of Public Convenience and Necessity or letter from the Public Staff,or
(2) enter into and submit an executed Operational Agreement pursuant to G.S. 143-215.1(dl)with the
Division.
(b) If the applicant is a developer of lots to be sold,an executed Operational Agreement shall be submitted with the
permit application. A copy of the Articles of Incorporation, Declarations, and By-laws, with the engineer's
certification, shall be submitted prior to operation of the permitted facilities to the Division, as required by 15A
NCAC 02T.0116.
(c) If the applicant is a legally formed Homeowners' or Property Owner's Association, an executed Operational
Agreement and a copy of the Articles of Incorporation,Declarations,and By-laws shall be submitted to the Division
with the permit application.

Since the Applicant, Heritage Crossing Holdings LLC, is a privately owned corporation, a CPCN form
indicating that they have approval from the Utilities Commission to operate a sanitary sewer line is
required. Or the Applicant needs to submit a DEV form, indicating that they are a developer and the

Hello Patrick and Ricardo,
After reviewing the Fast Track Sewer System Extension Application for The Carolinian (Heritage
Crossing), additional information is required in order to further process the application. Please provide
the following information by December 9. 2023, and note that the requested information must be
submitted within 30 days of this request, or the applicant will be required to submit a new application
and application fee in accordance with 15A NCAC 02T.0107.

1. Section VI.4. of the FTA, states that there is no pool, clubhouse, or filter backwash. Is a pool or
clubhouse going to be constructed at the project site? If there is a pool or clubhouse, please
update Sections V1.4. and VI.7.to correctly reflect all wastewater generated by the project,
including filter backwash.
a. Additionally, please provide an updated Flow Tracking(FTSE)form if the total wastewater
flow generated by the project is different than the FTSE form submitted in October.
2. According to the project narrative,there is to be 288 apartment units, however, according to
Section VI.7. of the FTA,there are 540 units. Please update Section V1.7.to include all
wastewater generation type, (ex. 1-2 BR units, 3 BR, pool, clubhouse, etc). Please also update
the narrative to include these details.
3. According to the project narrative, 3,562 linear feet of 8-inch gravity sewer is to be installed,
however, according to Section VII. of the FTA, 2,068 linear feet of 8-inch gravity sewer is to be
installed. Please verify the length of the proposed gravity sewer and update the FTA and project
narrative accordingly.
4. The topographical and aerial map submitted are not sufficient. According to Section F of the
Application Instructions, an 8.5-inch x 11-inch color copy of a USGS Topographic Map and an
aerial map should be included with the application. The maps need to clearly identify the
project area, including the closest surface waters, general location of the gravity sewer,
pumpstations, and force mains, and the downstream connection points for the receiving sewer.
Please provide the required maps according to the application requirements.
15A NCAC 02T .0107 Staff Review and Permit Preparation states:
• "(2) (e) If an application is accepted and later found to be incomplete, the applicant shall be
advised how the application or accompanying supporting information may be modified to make
it complete.The staff shall advise the applicant:
(2) if all required information is not submitted within 30 days,the project will be returned
as incomplete. Any resubmittal of a returned application shall be accompanied with a new
application fee."

*Please note that the fee for fast track sewer extension permits has increased to$600 as of October
3, 2023[as stipulated in the 2023 House Appropriations Act, House Bill 259, Water Quality and
