His assistance and cooperation was helpful and appreciated. As a result of the inspection, the following items were noted. 1) The subject facility has 3 outfalls: 001 — Consists of the stormwater collected from the diked area of the Above Ground Storage Tanks (AST's) of the South Terminal. This water is discharged over a cascade aerator and into a stormwater ditch. The South Terminal does have a covered loading rack for trucks which is served by an oil/water separator where all wastewater is hauled to Alabama for disposal. 002 — Consists of the stormwater collected from the containment area at the railroad car loading area at the South Terminal. Flow is to an oil/water separator then to a lined lagoon prior to discharge. 003 - Consists of the stormwater collected from the diked area of the Above Ground Storage Tanks (AST's) of the North Terminal. This stormwater goes through an oil/water separator before discharge. The North Terminal does have a covered loading rack for trucks which is served by an oil/water separator where all wastewater is hauled to Alabama for disposal. If the flow from the loading rack is excessive the flow will go to another oil/water separator before discharge. 2) The facility was not discharging at the time of inspection. IS one or more chlorophenol(s) is detected at concentrations greater than or equal to 50 pg/l. the permtttee will be required to analyze for the eight chlorophenole (listed below) in addition to EPA Method e25. This additional required monitoring will begin with the permittee's next scheduled monitoring event, occur on a semi-annual basis, and will last for the duration of the permit. The facilities are considered not classified and therefore require no ORC or bORC. Please remove the oil / water separator reference from the description in item 3 under the Supplement to Permit Cover Sheet. The description of outfall 002 does not state that the lined lagoon is divided. Stormwater from the railcar loading area and the AST containment area are segregated in the lagoon and do not commingle within the lagoon. The reason for this is that the product in the AST's is jet fuel which floats on water and stormwater from the railcar loading area may contain ethanol, which mixes with water. Water in both lagoons are analyzed before being discharged. Could you please ensure that the lat and long for both outfalls are corrected in BIMS. The lat and long for both outfalls provided by TransMontaigne are not correct. Other than these comments, the draft permit looks good. Mr. Hayes has a statement that is incorrect. He states that outfall 003 in the North Terminal consists of flow from the AST's to the oil water separator. We do not discharge any water from any tank through the oil water separator system. All tank water is hauled off sight to a treatment processing plant. Also in this paragraph he states that the rack water goes through the oil water separator before going to the two 40,000 gallon PC W tanks. This is incorrect. All water from the loading racks goes straight from the loading rack to the PCW tanks. The statement made in paragraph 4 of his letter is incorrect. I was asked by Mr. Hayes why we did not do away with the oil water separators being as we have gone to a closed loop system? My response to him was that we have had some conversations on this but a decision had not been made. His response was that he would include that in his inspection report. I never said that we were going to remove the separators. (4.) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS — MTBE MONITORING For the protection of public health, oil terminals discharging to waters classified as water supplies ("WS" waters) shall adhere to the following action plan: 1. Monthly monitoring for MTBE (except as modified under 2.) is required for the duration of the permit. See Parts A. (L), A. (2.), and A. (3.). 2. After a one-year test period of monthly monitoring or after twelve (12) discharge events have been sampled and analyzed, the pemtittee shall review MTBE data. If MTBE is not detected, the facility may request the Division to reduce the MTBE monitoring frequency. Granting this request shall constitute a minor modification to the NPDES permit. 3. If MTBE is detected during the test period, the permittee shall submit an MTBE Reduction Plan. This plan may include site -specific Best Management Practices (BMPs) or engineering solutions. EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS SPECIAL CONDITIONS — ACUTE TOXICITY MONITORING (ANNUAL) The permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document EPA/600/4-90/027 entitled "Methods for Measuring the Acute Toxicity of Effluents to Freshwater and Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas) 24-hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste treatment. The permittee will conduct one test annually, with the annual period beginning in January of the calendar year of the effective date of the permit. The annual test requirement must be performed and reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this date. Toxicity testing will be performed on the next discharge event for the annual test requirement. The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was performed, using the appropriate parameter code. Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re- opened and modified to include alternate monitoring requirements or limits. His assistance and cooperation was helpful and appreciated. As a result of the inspection, the following items were noted. 1) The subject facility has 3 outfalls: 001 — Consists of the stormwater collected from the diked area of the Above Ground Storage Tanks (AST's) of the South Terminal. This water is discharged over a cascade aerator and into a stormwater ditch. The South Terminal does have a covered loading rack for trucks which is served by an oil/water separator where all wastewater is hauled to Alabama for disposal. 002 — Consists of the stormwater collected from the containment area at the railroad car loading area at the South Terminal. Flow is to an oil/water separator then to a lined lagoon prior to discharge. 003 - Consists of the stormwater collected from the diked area of the Above Ground Storage Tanks (AST's) of the North Terminal. This stormwater goes through an oil/water separator before discharge. The North Terminal does have a covered loading rack for trucks which is served by an oil/water separator where all wastewater is hauled to Alabama for disposal. If the flow from the loading rack is excessive the flow will go to another oil/water separator before discharge. 2) The facility was not discharging at the time of inspection. The draft permit renewal is currently being developed and until such time as that renewal is issued the subject facility will operate under the expired permit. 4) A review of the Basinwide Information Management System (BIMS) data base for the period August 2002 through August 2003 showed compliance with permit limits with the exception of two daily maximum Lead limit violations which occurred in November 2002 and March 2003. Those violations were addressed through Notice of Violations and an enforcement action. 5) The effluent discharge is to an unnamed tributary to Mill Creek, Class WS-IV, NSW waters in the Neuse River Basin.
