Ross Jr., Secretary ~ ~ North Carolina Department of Environment and Natural Resources .=,1 ~ .~ Colleen Sullins, Director Division of Water Quality November 5, 2007 DWQ Project # 07 1730 Brunswick County CERTIFIED MAIL: 7006 0810 0004 4475 2574 RETURN RECEIPT REQUESTED Wakefield Development Company Mr. Jim Green 10255 Beach Drive SW Calabash, NC 28467 Subject Property: San Rio Ocean and River Club Brunswick County REQUEST FOR MORE INFORMATION Dear Mr. Green: On October 11, 2007, the Division of Water Quality (DWQ) received your Pre-Construction Notification application to temporarily fill or otherwise impact 0.378 acres of 404 Wetland and 68 linear feet of stream to construct the proposed single-family residential structure. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive a copy of the additional information requested below at the DWQ central office and the Wilmington Regional Office, we will have to recommend moving towards denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Additional Information Requested: Indicate all stream impacts including all fill slopes, dissipaters, and bank stabilization on the site plan. 2. Indicate all isolated or non-isolated wetlands, streams, or other waters of the State as overlays on the site plan. 3. Locate any planned sewer lines as overlays on the site plan. 4. Proposed "Wetland Span #1" on the plan sheet labeled "Overall Wetland Impact" appears to be a stub road that ends abruptly. The DWQ cannot permit impacts for "roads to nowhere". Explain why this impact is necessary and provide details on the future development to where "Wetland Span #1" is pointed. 5. Provide detailed engineering drawings describing how utility lines will be installed at the wetland impact sites listing the depth of placement. Provide a letter of concurrence from the Town of Shallotte for the placement of the utility lines outside of the 10 foot easement or stating where the utility lines should be placed within the easement. 7. Explain what is meant by "10 foot utility and sidewalk easement" found on the plan sheets for wetland spans 1 & 2. Sidewalks cannot be counted as temporary impacts. 8. You do not appear to have avoided and minimized to the greatest extent practicable. Please explain why the utility impacts cannot be avoided through the use of some sort of directional boring, to eliminate wetland impacts. Respond within 30 calendar days of the date of this letter. If we do not receive the above requested information within 30 calendar days of the date of this letter, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers.
