We can update the approval letter but to do that I need a detailed table of which wetland impacts are boardwalks versus fill/paved path. Can you take the original PCN impact table and mark the ones that are boardwalks and fill/pavement and then I can update the 401 accordingly. Hi Amie —Thank you for your quick response to this request. We had been working with Roberto, who I understand is not working with the 401 unit any longer, which is why we reached out to him today. The project for which we are seeking a modification is the Walker Branch -Hoover Creek Greenway project (DWR# 20230271). The project includes a greenway trail, which crosses several jurisdictional wetlands using elevated boardwalks. During their initial review, the USACE indicated that compensatory mitigation would be required for the boardwalks; however, upon further review, they determined that the boardwalk piles did not constitute an impact under Section 404. As a result, they removed the mitigation requirement because permanent impacts were reduced to 0.02 acres. We documented this change and modification request in an email, dated 9/6/2023 (refer to attached email). We followed up with Roberto on October 2 and again on December 19 with our modification request (refer to attached email). The emails refer to supporting documentation, which we can provide. The project is going to construction in the next week or two and the 401 still lists compensatory mitigation as a requirement. Because the permanent impacts are only 0.02 acres, our hope is DWR will agree the mitigation requirement is no longer required. Note that the USACE included a condition related to use of micropiles. I know this is a lot of information to read through, so I will try to give you a call tomorrow to explain everything. "This project was proposed to put a boardwalk over a wetland or something and they have now changed the permanent impacts to wetlands to temporary impacts (as adjusted by USACE)... they want to know if they have to do anything for mitigation now that it is temporary?" I looked over your project of which I approved on January 11, 2024. 1 didn't see anything in your application for impacts to wetlands. I only approved you for stream and buffer impacts. Can you please explain?
