The Nordi Carolina Department of Transportation (NCDOT) is proposing to replace the subject
bridge because of structural deticiency. The esisting bridge lias a 16.5' L timber deck and timber
substructure. lt will be replaced �vith a 37.75' L s 2T W s 2P' D cored slab bridge on tlie
existing aligimient using staged constiliction uietliods.
Enclosed are a PCN application, preliminaryjurisdiction form, SHPO fonns, plan sheets
showing die pioposed work, T USGS c�u�d map, photographs, a��d other pertinent project
information.
The North Carolina Natural Heritage Program database w��s checked for records of threatened
aud eudangered species. 'I'liere are 51 species listed for Ha�vood Counry that have federal
status. Tlie bog tmrtle (G/yplenrys mah/enbergii) is listed as threatened due to similarity of
appearance to the listed northern bog turtle. Bald eagle (Hrdineetus leucocephalus) is listed
imder the Bald and Golden Eagle Protection Act (HGPA). Nine species, Carolina northern tlying
s�uin�el (G/nuconrys st�brinxs coloi�nh�s), gray bat (11�I��o/is gr�isescens), Indiana bat (�t�lyotis
sod�drs), Appalachian elktoe (A/nsmidnnla rnvenelicma), spcuce-fir moss spider (�I�frcrohesio•a
monlinnga), small whorled pogonia (Isoh•io nredeoloides), spreading avens (Getnn roclitdtnn),
rock gnome licheu (Gyntnodermn Irnem•e), Tnd northern long-eared bat (ibLyotrs se�tenh•ionnlrs,
NLEB) are known from current records and are listed as eitlier tlueatened or endangered.
Accocding to the USFWS, Haywood Cowity is now considered occupied simuner range foc
Indiana bats and NLEB.
Appalacluan elktoe are found in some well-oa}�genated streauis with moderate to fast Flo�vi��g
water and stable, mixed substrates of silt, sand, gravel, and/or cobble. Streams tliat support this

mussel are typically mucl� larger and �varnier than Jolmsoi� Branch. The only records in
Haywood CoLmty are from the Pigeon River and the lo�ver portions of the East Fork Pigeon aud
West Fork Pigeon rivers; there are no records fi•om any lributaries to tliese rivers. Tlie bridge is
14 iniles upstream oY the Pigeon River aiid this reach of the river is over 16 river miles
do�vustreaui of occupied mussel habitat.
With rare esception, gi•ay bats roost iu caves year-round. This projeet only iuvobes a small
bridge replacemeut, so constrttction �vork will uot estend far from tlie existiug right-of-way into
areas �vhere caves could occur. There �re no caves or mines visible near tl�e bridge and,
according to USGS data, the nearest underground mine is over 6.5 miles away. Therefore, gray
bats rvill not be affected by the project.
Like gray bats, [ndiana bats and NLEB tvinter in caves or uiines with stable, but not freezuig,
cold temperatures. But, in summer, they geuerally roost under die loose bark of trees, either dead
with peeling bark or cavities, or live trees with shaggy bark sucli as white oak, maples, sycauiore
and liickories. Tlie consh�uction work will i•equire the reuioval of trees near the bridge. Any
obsh�ucting trees will be removed from October LS to April 15 (winter clearing) wtien bats sliould
not be roosti��g in the area. Also, we conducted a suivey of the bridge on Jtme 1, 2015 and did
not see roosting bats or aiiy evidence of bat usage (i.e. staining or guano). This bridge is only a 5
Yeet above the water surface and very cool uuderneath. With winter tree cleariug, we recommend
a"uiay nffect, uot lilcely to adve�sely affect" determination for NLEB and Indiana bat.
Small whorled pagonia generally oecuis iu open, diy, deciduous woods with acid soil, though
habitats can include slopes along streams and mesic forest witli white pine and rhododendron.
Land use adjacent to the bridge consists of maintained road shoulders and driveways. 1'licre is
�vooded l�abitat along the stream near d�e bridge, but these areas are damp and/or heavily shaded
�vith rhododendron and large trees. No small �vhorled pago�iia were seen on site visits. And, the
nearest record for this plant is over 4 miles from the project.
The Caroluia uortheui flying sqtiirrel, i•ock giionte lichen, spruce-fir moss spider and spreading
avei�s are found in spruce-tir rorests and otlier isolated high elevation locations in westeru North
Caroliva. However, rock gnome lichen is an etceptio�� because it cau occasiouall}� be found at
lower elevatious in deep river gorges witli high humidity or oii some vertical rock faces that aie
periodically wet The bridge site has an elevation of only 3,240 feet and lacks roek faces and
other ltabitat conditions required by tliese species.
The peoject is limited in scope. Erosion and sedimentation control measm�es ��vill be
implemented to minimize adverse eYYects of the work on �quatic habitats. Habitats for listed
species appear lacking �t the project site aud uone of d�ese species �vere observed duriiig tield
visits. Por tliese reasons aud those discussed �bove, �ve recouimend tliat a determination of"no
effect" on listed species �pply to tl�is project, eacept for NLEB and Indiana bats.
Tliis project was reviewed by NCDOT's Human Enviroimient Unit in 2013 for potential effects
to historic arcliitechire �nd arcl�aeology. It was determined that no suivey was required tor
historic architech�re. A smvey was conducted for �rolieological resottrces wit� a determii�atiou
of "no effecY' (see attached forms).

NCDOT best mauagement practices will be used to minimize and control sedimentation aud
erosion on this project The constn�ction foreman will review all erosion control measures daily
to ensure sedimentation and erosion controls are being effectivel}� controlled. If the devices are
uot functioning as intended, tliey will be replaced inunediately with better devices.
Impacts to Waters of the Unitecl States
Johnson Branch (DWQ Class: WS-III "Cr) is sho�vn on the USGS topogr�pl�ic map as a perennial
stream. The channel is well detined with a substrate of saud, silt, cobble and bedrock and is
approximately 7 feet in width. The stceam has sufficient flow to support tish and other aquatic
life. Joluison Brancli flows to CampUell Creek, which in tunl Ylows to Jonathan Creek aud oii to
the Pigeon River. The Pigeou River meets tlie detiiiition of a Traditional Navigable Water
(TN��. For tliese reasons, �ve believe Joluison Branch is a Relatively Permanent Water (RPW)
and is iinder thejurisdiction of the U.S. Army Corps oY Eugineers. In order ro construct the
project, it will be necessary to impact watecs of tl�e United States in tlie Freucl� Broad River
Basin (CU 06010106). Specifically, NCDOT is requesting to eeplace Bridge No. 334 with a
cored slab bridge. Listed below is a summaiy of the proposed iinpacts.

The purpose of the project is to replace a functionally obsolete 16.5' L x 20' W single span timber bridge with a single
span 37.75' L x 27' W x 21" D cored slab bridge on existing location.

Erosion and sedimentation measures will be installed. The bridge will be staged constructed to the upstream side of the
existing bridge in order to maintain traffic on this dead end road during construction. Track hoes, dump trucks,
bulldozers, cranes, paving equipment, water pumps, sandbags, diversion pipe and various hand tools will be used to
accomplish the work.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The bridge is being replaced with anolher spanning bridge. Bridge replacement and associated roadway improvements have
been designed in a manner to minimize the increase in impervious surtace area lo the inaximum extent possible. Grade falls
from south to north on lhe bridge; therefore, a drainage device will be necessary at lhe north end of lhe bridge in order to
convey stormwater runoff from the bridge deck. Stormwater runoff from the north side of the bridge deck will be conveyed to
the base of the fll slope through a modifed concrete flume which will outlet onto a class'B' rip rap pad in order to protect
against erosion. A modified concrete Oume was chosen at this location to avoid a direct, erosive discharge into lhe stream.

All instream work will be performed in a dry work area using an impervious dike and diversion to divert the water around the
project site during bridge removal. Appropriate BMPs according to the approved erosion and sedimentalion control plan will
be installed on the project prior to the bridge work.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicanYs acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.

'fRC has conducted an intensive archaeological survey aud evalnation for the replacement of Bridge No.
334 on SR1212 (Johnson Branch Road) in Hnywood County, Norlh Carolina (Figures I and 2). As
defined by the NCDOT, ihe swvey area aud Area of Potential Effecis (APE) Cor archaeology extends 300
feet (91.44 m) norlh and 300 feet (91.44 m) south along SR 1212 from ihe ends of BriAge No. 334. The
corridor is approximately 150 feet (45.73 m) wide, extending 75 feet (22.86 m) on each side of SR1212
from ils present center.
A mep review and site files search was conducted by I3elinda Cox of TRC at ihe Office of S�a(e
Archaeology (OSA) Western 6ranch on September, 26 2013, �vhich supplemenled a previous NCDOT
revie�v. These reviews identified no archaeological sites within or adjacent to ihe APE, although Quentin
D�ss (1975) recorded three sites withiu a mile of the project area. Nearest to lhe project �rea is 31 H W 188,
which is locnted along Campbell Creek and contained a vnriety of lithic nrtifacts some of which were
identifiable as Middle Archaia Sile 31IiW 189 yielded Connestec cernmics, along with Middle and Late
Archaic and Enrly Woodland projeclile poinis. Site 31 H W 187, along Jonalhan Creek, was found to
contnin lithic �rtifacts �h�t were not idcntifi�ble to time period.
Topogrephic m�ps, United States Depariment of Agriculture (USDA) soil survey maps, and historic maps
�vere esTmined for informntion on natural or cul�ural vari�bles ihat migh� have �ffected site locations.
Ninetccnih century maps of Haywood County show little detail in ihis are�. T'he Price and Strother map
( I 808) shows Jona�han Creek and some southern iributnries at the edge the mapped arcn with the nren to
the immediate west labeled as "Bowidary's not yet Settled". The MacRae Q 833) map shows Old
Ch�tlucheeRoad, and an intersectiug road along Soco and Jonathan Crcek and "Davidsons" in ihe
Jonnlhan Creek setllement area, bul no delail in Ihe project vicinity. Tlie Kerr (1882) map depicls
Jonalhan Creek, but little other detail in the �rea. The 1893 Mt. Guyot USGS qundrangle shows a stream
in Ihe location of Campbell Creek, and a tributary in �he location of Johuson Branch. A road is shown
lending to a s�ruc�ure above the west side of Campbell Creek, but no other detail in �he project vicinity
(USGS 1893). The I935 USGS quadrangle shows more structures along Campbell Creek, but none up
tvhal appears to be Johnson Branch (USGS 1935). The 1941 quadrangle shows Johnson Branch anA a
rold in the SR1212 location, with the creek crossing in �pproxim�tely tlie same location as present day.
Severnl structures are depicted, but noue within ihe project area (USGS 1941).
On-line soils data indicnte thnt two generalized soil lypes �re present in tl�e APE (NRCS 2013). Most of
ihe vea is mapped ns consis�ing of Snimook loam, 8—I S% slopes, stony. The steeply sloped nrea iu ihe
southeastern part of ihe APE consisls of Soco-Stecoah complex, 30-50%slopes.
'fhe �rchneologicnl reld survey included n wnikover of ihe APF, ro senrch for above-ground featwes and
the excavatiou of 10 shovel tesis (STs) in Tre�s Incking st�nding wnter, wetland soils, or signs of severe
disturbance (see Figure 2). The STs mwsured 30 cm in diameter and were cxcavated �o subsoil,
impenelrable rock, or at least 75 cm below surf�ce (cmbs); all soils were dry-screeued ihrough'/a-inch
mesh. The survey ideNified one archaeological resource, 31HW571, in lhe nortli�vest quadrant (�igure 3;
'1'able I), which was �he only portiou of ihe survey area suitable for shovel testing. The southcastern
portion consists of n stceply sloped wooded area (Figwe 3). The sou�hwestern quadrant contains Johnson
Brnnch, along wiili its boulder slrewn banks nnd tlie roTd shoulder (Pigure 4). The no�theasteru part of the
swvey area also contains Johnson Branch, along �vith slope and extant siructures. That area has been
I�eavily modified (�igwe 5).

'Cen shovel tests were excavnted, all in the norlhwestern portion of ihe survey area in a gently slopiug
pasture with small, discrete flat are�s (Figure G).'Ch�t �ren �Iso coninins an intermiltent dr�innge. No
testing was conducted outside of the APE. The A horizon was clearly a plowzone iu some locations, but
was thick in some areas, �nd in some are�s appeared Aisturbed; all shovel tests ended within a rocky, dark
yellowish brown B horizon and all enwuntered large rocks at the bases. One isolated find (31HW571)
was fowul, consisting of wiideutified prehistoric ceramics found in S72 (Figure 7). Close intervel shovel
testing resulted in no additional material, save modern wire nails. A 50 x 50 cm wiit was excavated at die
posi�ive test (ST2) to investigate hvo small stains visible at ihe base of lhe plowzone; these were
detennined to bc rodent burrows. That test eucountered 10 cm of overburden with gravels, �vhich was
undedain by a dark brown 13 cm �hick plowzone. The shovel test wns excnvated into the dark yellowisl�
brown B horizon to 50 cmbs, after �vhich large rocks were encountered. The ST2 soil profile is fairly
represeutative of that found withiu ihe other tcsts, although ihickncsses varicd, and thc historic
overbinden �vas not encountered in all areas.
The eight sherds rccovered from ST2 are residual or eroded, save one example that appears to be
rectilinenr complicnted stamped, but may be over stamped simple stamped (Table 2). This sherd exhibits
a slightly bwnished iuterior, however, �nd does not �ppenr to be Connestee. The sherds may be
redeposited from elsewhere or may represent a small si�e ihal was previously disturbed by Ihe
construction of Cessna Lane; il is also possible lhnl a sile exlends oulside of ihe APE lo ihe �vesL Due to
low density within the project area, and ihe lack of potential for associaled features, �his IF is
recommended not eligible to the NRHP.
Based on the resulis of the background research aud field survey, there is no evidence that NRHP-eligible
archaeological resources are situaled wilhin the Bridge No. 334 APE. Consequently, no ndditionnl
nrchaeologicnl investigations nre recommeuded for ihis project �s currently defined.
