The Division of Water Resources (Division) has determined that your application is incomplete and cannot be processed. The application is on-hold until all of the following information is received: The application did not include enough detail or plans to allow the Division to fully evaluate the project’s effects on water quality. Specifically, questions 2 and 3 in Ms. Healy’s email regarding the minimization of total impacts and the size and location of all temporary impacts to streams and wetlands \[15A NCAC 02H .0502(a)(4); 15A NCAC 02H .0502(a)(9)\]. Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide your response by February 29, 2024. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and appropriate fee. Please let me know if you have any questions. Hi Alex, Thank you for submitting the pre-construction notification (PCN) for the subject project. I have reviewed the project package and would like to request the following information: 1. The surveys for the threatened dwarf flowered heartleaf (DFH) were conducted on June 23, 2022, June 15, 2023, December 12, 2023, and January 10, 2024. The USFWS designated survey window is March through May. Please clarify how the DFH was identified. 2. Please explain why the impacts for this project cannot be further reduced either by reconfiguring the building pads/roads or by utilizing retaining walls. 3. The PCN language indicates that there will be temporary impacts to streams and wetlands, but no temporary impacts are listed in the impact tables. Please provide information on the size, reason, and location of the proposed temporary impacts. 4. Please provide details on how the building pads will be utilized. The Corps cannot authorize fill for potential development without a designated purpose. Additionally, the proposal to relocate DFH will be considered an adverse effect to the species which will necessitate formal consultation with the USFWS and the development of a Biological Assessment (see guidance attached). The formal consultation process takes 135 days, and it is possible that a re-survey of DFH during the designated survey window will be required.
