Dear Mr. Shaeffer:
Enclosed is one copy of a revised Pre - Construction Notification (PCN) Permit Application Package for the
City of Raleigh Blenheim Culvert Repairs /Stream Relocation Sanitary Sewer Protection project. For your
review we have enclosed one copy of the PCN Application Form, Attachment A — Additional Information,
USGS Quadrangle Map, Soil Survey Map, site photos, site plan with typical construction details, and
compensatory mitigation proposal.
The project titled "Blenheim Culvert Repairs /Stream Relocation Sanitary Sewer Protection" consists of
relocating a stream channel away from the immediate vicinity of a sanitary sewer line that has become
exposed and threatens the property owner's residence. This activity will occur in sanitary sewer easements
that have not been maintained in the last to years and on the 817 and 821 Blenheim properties owned by
Ms. Betty Twiggs. This project also includes the repair of a collapsed culvert and headwall on the 3301
Marblehead Lane property.
The construction described in this permit will result in a net stream loss of 147 linear feet and a net loss of
2,800 square feet of zone 1 and 4,700 square feet of zone 2 buffer. An additional 8,700 square feet of zone
1 and 2,715 square feet of zone 2 buffer will be temporarily impacted due to disturbance necessary to
perform the construction.
Response to Comments
Comment: The preconstruction notification (PCN) states that a culvert at Blenheim Drive would be
repaired under Nationwide Permit 3. However, there are no impacts associated with this repair listed in
the PCN stream impact table or on the plans. Please revise your application and plans to quantify /show
these impacts.
Response: The application has been revised to quantify the culvert repair impacts.
Comment: The plans submitted with the PCN are too large. Please submit revised drawing on paper
11x17 - inches or smaller.
Response: 11X17 -inch drawings are submitted with this package.
Comment: 2012 NWP Wilmington District Regional Condition 3.2 requires the submittal of a
compensatory mitigation proposal for any NWP that results in a loss of more than 150 linear feet of
perennial and /or ephemeral /intermittent stream. for perennial and intermittent streams, a

compensatory mitigation ratio of 2:1 is normally required unless it can be demonstrated, using the
North Carolina Wetland Stream Assessment method, that the tributary is low functioning. Accordingly,
you must provide a compensatory mitigation proposal to compensate for 233 linear feet of stream at a
ratio of 2:1 or demonstrate that a lower ratio is appropriate. This compensatory mitigation requirement
could be partially satisfied with the stream relocation project provide you submit a
relocation /restoration plan in accordance with the compensatory mitigation regulations (33 CFR 332).
For North Carolina Department of Transportation Project, a ratio of 1:1 is normally given for onsite
stream relocations. Accordingly, if the abandoned channel is 233 linear feet and the relocated stream'is
86 linear feet, you would be responsible for providing the 147 linear feet of compensatory mitigation at
a ratio of 2:1'and the relocation /restoration plan.
Response: A compensatory mitigation proposal is included with this package. A compensatory
mitigation proposal ratio of 2:1 is proposed for 147 linear feet of stream.
Comment: You are reminded that, because this project involves clear cutting of trees within Wake
County and within the Corps ESA action area, our office is required to consult with the U. S. Fish and
Wildlife Service on the Northern Long -eared Bat. This consultation process can take more than 30 -days
and cannot be initiated until a complete application is submitted. This informal consultation is usually
conducted through e-mail. Please submit an electronic copy of the preconstruction notification and
associated documents to facilitate a timely consultation process.

Attachment A —Additional Information
3.3.a Describe existing conditions and land use:
Extreme oxbowing and streambed deepening of an unnamed tributary of Crabtree Creek has eroded the stream
bank and threatens the integrity of sanitary sewer lines. Oxbowing of the stream has exposed bell joints in the 8-
inch ductile iron sanitary sewer gravity line, and the sanitary sewer line is now approximately five feet above the
bottom of the stream bed due to natural streambed deepening. The undercutting of the stream bank at the oxbow
is naturally forcing the stream towards the property owner's home, posing a threat to the integrity of the
structure. Land use in the vicinity of the area is residential.
3.3.d Explain the purpose of the proposed project
The purpose of the proposed project is to relocate the stream channel away from the immediate vicinity of the
sanitary sewer line and property owner's residence to prevent damage to the sanitary sewer infrastructure and
property.
As part of this construction project, a collapsed culvert and headwall will be'repaired and replaced at the 3301
Marblehead Lane property that is across the street from the 821 Blenheim property.
3.3.e. Detailed project description including equipment to be used
Oxbowing and streambed deepening threatens the integrity of a sanitary sewer line and property owner's
residence. The sanitary sewer line is located within an easement that has not been maintained in the last 10 years.
A pump around or coffer dam will be used during construction to ensure all work occurs in the dry. Construction
activity will consist of clearing an area to access the project location, excavating a new stream channel, and
filling /grading the existing channel to move the stream away from the sanitary sewer line and residence. Channel
blocks will be installed to prevent re- cutting of the old stream channel and rip -rap will be placed along the new
stream channel to prevent further erosion. A cross -vane will be installed in the new stream channel to provide
energy dissipation. Native streambed material (to a 1ft depth) will be raked out of the section of stream to be
abandoned and will be stored until a new channel is formed. The reserved stream bed material will be placed in
the new stream channel prior to removal of the pump around. The excavated and graded area will be covered with
coir matting and reseeded to prevent erosion. Stream bank stabilization details are attached with this application.
Conventional construction equipment (hydraulic excavators and dumptrucks) will be used. The buffer disturbance
will be seeded and mulched. Traditional sediment control devices and conventional construction equipment will be
used.

The new stream channel was designed to provide adequate meandering and velocity reduction to reduce future
natural channel movements in this area. The placement of rip -rap will be limited to the area immediately around
the new stream bank and will not intrude into the stream. A pump- around or coffer dam will be used during
construction to ensure all work occurs in the dry. A cross vane will be installed to provide energy dissipation in the
new stream channel and allow for a gradual slope of the channel. After construction is completed the disturbed
area will be covered with coir matting, mulched, and reseeded. The riparian buffer area will also be re- vegetated
with native plant species.

Compensatory Mitigation Proposal
The proposed project will permanently impact 233 linear feet of medium quality perennial stream
located in a highly urbanized environment. A portion of this stream will be relocated on site (see
attached plans). We propose that these 86 feet of relocated stream be used to mitigate 86 feet of
impacts at a 1:1 ratio. Mitigation banks in 03020201 where the impacts will occur have been contacted;
however, credits are not currently available. Therefore, the remaining 147 feet of impact will be
mitigated through the NC Division of Mitigation Services at a 2:1 ratio. See attached acceptance letter
for 294 feet of mitigation in HUC 03020201.

The purpose of this letter is to notify you that the NCDENR Division of Mitigation Services (DMS) is willing to accept payment for
compensatory mitigation for impacts associated with the above referenced project as indicated in the table below. Please note that this
decision does not assure that participation in the DMS in -lieu fee mitigation program will be approved by the permit issuing agencie's
as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the
DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations
associated with the proposed activity including G.S. § 143- 214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to DMS. Once DMS receives a copy of the permit(s) an invoice will be issued based on
the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the in -lieu
fee to be paid by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you in your request to use the DMS, the impacts that may require compensatory mitigation are
summarized in the following table. The amount of mitigation required and assigned to DMS for this impact is determined by
permitting agencies and may exceed the impact amounts shown below.
