EXEMPTION of Tar-Pamlico River Buffer Rule (15A NCAC 02B .0259) , NO WRITTEN
CONCURRENCE NEEDED
Dear Ms. Slack:
On October 31, 2007 the Division of Water Quality (DWQ) received documentation from you showing
that your clients' proposed athletic park would be constructed outside of the 50-foot protected Tar-
Pamlico Riparian Buffer. Since you are not impacting the protected Tar-Pamlico Riparian Buffer, your
activity is exempt from the Tar-Pamlico Buffer Rules and therefore does not require a buffer
authorization from DWQ.
You should obtain or otherwise comply with any other required federal, state or local permits before you
go ahead with your project including (but not limited to) Erosion and Sediment Control, Non-discharge
regulations.
