Drawer 870 Krfty Hawk NC 27949 Phone: 252 -491 -8147 Fax: 252- 491 -8146 web: quible. com The purpose of this letter is to provide an additional discussion related to the justification for the width of the jetty system at Carawan Marina which received a "Return of Application" from NCDWR and is therefore "On- Hold" by NCDCM. The following was requested as a modification to CAMA Major Permit 20 -15: A. Widening of the permitted jetties from an average of 20 ft wide (ranging from 15 -26 ft) to an average of 30 ft wide (20 -40 ft). The purpose of this is to build a jetty system that can be maintained and repaired regularly, at any time necessary. It is extremely important to have a stable jetty system at all times, given the daily use of this marina as a commercial fishing operation. This area of the Albemarle commonly has extremely rough water conditions that are difficult to navigate. Maintenance will occur by traversing the jetty system with an excavator or other equipment. And, if a large storm event causes rock to enter the channel, it would be detrimental to the large boats that need this port. Being able to walk out on the jetties with mechanical equipment will enable maintenance and repair as needed. This is very important for a commercial operation of this nature. This is similar to the existing permitted jetty system on the west side of the Alligator River bridge which is used and maintained for recreational vessels. B. Section 404 Wetland fill (5,321 sq.ft.) to access the western jetty. This proposed fill would allow access to the jetty for construction and maintenance. Without this area of impacts, land -based access to the jetty would have to include matting through a Section 404 area. This area would include sand fill with a gravel or shell surface. Based on my discussions with NCDCM and NCDWR, it is my understanding that the width of the jetty (Item A.) above is what is not supported by regulatory officials. Please note that the item A jetty widths are similar, but not exceeding widths of the jetty system located adjacent to the north side of the Alligator River bridge. That is a jetty system that Mr. Carawan would like to replicate in terms of construction, width and maintenance, especially after large storm events. The proposed jetty width would allow an excavator and other equipment to walk out on the top to construct, repair and add rock as needed. It is our firm belief that a commercial fishing operation marina should be afforded the same opportunity for repair as a recreational vessel marina (such as the one adjacent to the Alligator River Bridge). However, based on discussion with NCDCM, the Alligator River jetties may not have been permitted to the width currently built to, and the "need" after original construction may have prompted refinements to allow the wider construction. Rather than refine or modify this permit at a later date, we feel that permitting the currently proposed jetties at this time is the most efficient approach (in terms of initial construction and any periodic maintenance). Please understand that this is an important commercial marina and the jetties and channel must be maintained as such. This marina has become critical to this Tier 3 County and is a critical lifeline to this area. As we mentioned in the project narrative, there are extensive primary and secondary economic implications to this area that has nearly no other significant private industry. In the event of a hurricane, it is of utmost importance that business returns to normal as expeditiously as possible, and this include channel and jetty maintenance. Having to hire a marine barge contractor is not practical for those situations (due to time lost). Please consider this information prior to a final CAMA Major decision. We believe that precedent has been set for increased jetty widths in a nearby setting and there is a clear need. I appreciate any input you may have. In the event that a wider jetty system cannot be supported at this time, Mr. Carawan would like to continue to pursue that option through additional meetings and possible variance processes. But, please contact me to discuss first, since my likely recommendation to Mr. Carawan would be to request that Item B. above (access fill) be sought while separately working on the width issues.
