His previous permit actions on the property already included wetland impacts and this proposal involves additional impacts and we will need to address those as cumulative. He did not mitigate for the previous loss of wetlands as part of the scope of analysis there was not any additional proposed impacts at that time. However, as discussed previously, the applicant's preferred option to preserve wetlands on the site is not favorable to the Federal review agencies and we recommend that you provide further information on this matter. In the CAMA Major Modification request package, the proposed mitigation plan included: "Section 404 wetland preservation at a minimum ration of 5:1. Since there are in -kind on -site wetlands present on the subject property, this form of mitigation on the subject property and could be considerably more than 5:1 if deemed necessary by USACE. It is understood that mitigation credits are available through the NC Division of Mitigation Services (DMS), but this is not the preferred mitigation option by the client due to costs and also because of the availability to offer mitigation on- site." After recent discussions with Phillip Carawan and an understanding that preservation is not the preferred form of mitigation in this particular case, the proposed mitigation plan has been amended to purchase mitigation credits from The Great Dismal Swamp Restoration Bank, LLC ( GDSRB). Prior to contacting DMS, I contacted GDSRB and confirmed that they are currently able to supply credits from their Timberlake location. Please see the attached acceptance letter, dated 6/22/2015.
