On May 4, 2015, the Division issued a Notice of Violation (NOV) against the City of Hickory WWTP. The NOV
was based upon a violation of the reporting requirement by failing to file the February 2015 Discharge
Monitoring Report with the Division of Water Resources within the thirty (30) days reporting period.
Please note that the original NOV letter had a type -o for the date of the missing report (February 2013) and
was intended to be for the February 2015 report.
Subsequent to your receipt of the NOV, Rick Stine contacted the Division indicating that the DMR was sent in a
timely manner. The DMR was signed and dated March 9, 2015 indicating that it was likely mailed thereafter. As
a result, I have withdrawn the NOV against Lowell Investments I, LLC for the cited violation and directed that the
record of this violation be removed from our files.
