Director Environmental Banc & Exchange, LLC Attn: Jamey Mceachran (via electronic mail: jmceachrangres.us ) NORTH CAROLINA Environmental Quality July 13, 2023 DWR Project #: 2014-0820v6 Wayne County Re: RES 2022 Phase II Umbrella Mitigation Banking Instrument (UMBI) Carraway Bluff Phase II Bank Parcel Credit Release — Task 2 Dear Ms. Mceachran: On April 21, 2023, the Division of Water Resources (DWR) received documentation from Environmental Banc & Exchange, LLC (EBX) that the Carraway Bluff Phase II site had been planted and constructed in its entirety and monitoring plots had been installed. EBX also provided documentation confirming that riparian restoration activities including riparian plantings and installation of all monitoring plots for the Carraway Bluff Full -Delivery Mitigation Site for the Division of Mitigation Services (DMS ID# 10016) had been fully completed. On May 16, 2023, staff with DWR, with assistance from staff with EBX, inspected the site and confirmed that the subject site had been mostly adequately planted, all monitoring plots were installed and the conservation easement was mostly adequately marked. DWR communicated concerns with EBX regarding supplemental planting needed as well as non -diffused flows onsite where unstable and unseeded banks were contributing sediment loss into ditches and streams. On July 5, 2023, EBX submitted documentation to DWR confirming that all remedial work and supplemental planting efforts had been fully implemented and addressed. DWR received a performance bond (#612402526) issued to EBX from United States Fire Insurance Company, in the amount of $150,000, to cover performance obligations for the construction of the subject site. The term of this bond is from February 6, 2023, through February 6, 2024. In accordance with the UMBI (DWR ID# 2021-0306v2), signed on April 22, 2022, the following Project Milestones have been met and the corresponding credits shall be released: Task/Milestones Credit 2) All riparian Earthwork & Mitigation activities, planting and installation 20% of monitoring devices completed for both the Carraway Bluff Full Delivery Site and the Bank Parcel, easement boundaries adequately marked, all applicable permits obtained. Additionally, the riparian buffer credits must be used for impacts in the Neuse River Basin in accordance with guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on November 1, 2015 Upon receipt of this correspondence, update all credit ledgers accordingly.
