MINIMUM CRITERIA DETERMINATION CHECKLIST

Project Location: Approximately 2.5 miles southeast of Harmony and approximately 15
miles northeast of Statesville on Kinder Road (S.R. 2132) in Iredell County.
Project Description: The purpose of this project is to replace Bridge No. 336 on Kinder
Road (S.R. 2132) over Kinder Creek in Iredell County. The existing timber -deck bridge
is functionally obsolete and will be replaced with a new concrete deck bridge that will
accommodate two 11-foot lanes. The proposed bridge will be placed on the same
alignment and will be widened by approximately 1-foot on both sides. Class 11 Riprap is
proposed along the channel banks.
The grade of Cranfill Road, which intersects Kinder Road approximately 77 feet east of
the existing bridge, will be raised approximately 2 feet in order to tie into the grade of the
proposed bridge.
Anticipated Permit or Consultation Requirements: A US Fish and Wildlife Service
(USFWS) northern long-eared bat 4(d) rule streamlined consultation form will be
completed and submitted. Due to the anticipated impacts to jurisdictional streams, a US
Army Corps of Engineers Nationwide Permit 3 is anticipated for a bridge to bridge
replacement.

Crash History
NCDOT Traffic Safety Unit has evaluated a recent ten-year period (September 1, 2008-
August 31, 2018) and found two crashes occurring in the vicinity of the project. Both
crashes occurred north of the bridge. The crash investigation notes the unprotected slopes
to the creek as a safety consideration. Additional guardrail is proposed on both
approaches to the bridge.

Design Exceptions
The roadway is designed as a Local Rural Route using Sub -Regional Tier Guidelines. A
sag vertical curve design exception is requested for a 20 mph design speed because
meeting AASHTO standards for a 30 mph design speed would require raising the grade
over 13 feet and would necessitate the adjacent bridge on Cranfill Road be replaced as
part of this project. The proposed design speed of 20 mph meets or exceeds the design
elements that currently exist for Kinder Road in the vicinity of the bridge. The posted
speed will be 55 mph and there is ongoing coordination with NCDOT to install additional
signage to enhance the safety of the roadway.
Threatened and Endangered Species
The USFWS lists three federally protected species for Iredell County (updated June
2018): the bog turtle, the dwarf -flowered heartleaf, and the northern long-eared bat
(NLEB). Species listed as threatened due to similarity of appearance do not require
Section 7 consultation with the USFWS; therefore, a biological conclusion is not required
for the bog turtle. A review of the North Carolina Natural Heritage Program (NCNHP)
database completed in January 2019 indicated no known occurrences of the bog turtle or
dwarf -flowered heartleaf within 1.0 mile of the project area. An on -site investigation was
conducted on January 9, 2019 and found suitable habitat for dwarf -flowered heartleaf.
Multiple transects of suitable habitat were surveyed during two different site visits, but
not dwarf -flowered heartleaf was identified. Therefore, the biological conclusion is "no
effect" for dwarf -flowered heartleaf.
Based upon current guidance from the USFWS Asheville office, the biological
conclusion for NLEB is "may affect, not likely to adversely affect" for any counties in
Division 12, which includes Iredell County. This is due to the fact that these counties are
located in the white nose syndrome area, but since there is no known hibernacula nor
roosting trees in Division 12, the criteria for the 4(d) rule has been met and any
associated take is exempt. A USFWS NLEB 4(d) rule streamlined consultation form will
be completed and submitted.
In accordance with the Bald and Golden Eagle Protection Act, a desktop-GIS assessment
of the project area plus a 1.0 mile radius, was performed on January 9, 2019. A survey for
bald eagle nests within the project area plus 660 feet was performed on January 9, 2019
and none were observed. Additionally, a review of NCNHP records dated January 2019
revealed no known occurrences of this species within 1.0 miles of the project area. Due to
the lack of known occurrences and the lack of observed nests, the biological conclusion
for the bald and golden eagle is "No Effect."
Water Resources
This project lies in the Yadkin River basin. Two jurisdictional perennial streams (Kinder
Creek and an unnamed tributary) were identified in the study area. All jurisdictional
streams in the study area have been designated by the North Carolina Wildlife Resource
Commission as warm waters streams for the purposes of stream mitigation. There are no
designated High Quality Waters, water supply watersheds, Outstanding Resource Waters
or 2016 Final 303(d) list streams within the study area or 1.0 mile downstream. There are
no wetlands in the study area.

Based on a 25-foot buffer of the slope stakes, there are potential impacts to 60 feet of
Kinder Creek and 80 feet of the unnamed tributary to Kinder Creek on Cranfill Road.
Other Agency Comments
The NCDOT Cultural Resources Group has indicated that no historic architecture or
archaeology survey is required.
