There is a pond with a perennial stream with adjacent wetlands that bisect the property, in addition to intermittent tributaries that converge with the perennial stream. Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. S &EC completed a wetland delineation and Jordan Watershed Buffer evaluation for the entire property in order to identify natural resources so that the project engineer could design a site plan that would minimize impacts to the maximum extent practicable. Impact #1 is a proposed road crossing to an intermittent stream. Proposed impacts include 59 linear feet of permanent stream, 10 linear feet of temporary stream, 16 linear feet of permanent -no permanent loss stream (i.e. energy dissipater) and associated riparian buffer impacts. Headwalls have been utilized to minimize stream and riparian buffer impacts. This impact is necessary to access the west side of campus. It's important to note that Orange County will be completing the No Practical Alternatives review for the buffer impacts associated with impact areas #1. Furthermore, the applicant is aware of the regional conditions associated with the Nationwide Permits 39. With respect to Commercial /Institutional development conditions (NWP 39- Regional Conditions section 4.0) the applicant does not anticipate any impacts to streams or wetlands associated with stormwater facilities, there are no impacts associated with single - family recreation facilities, there are no permanent wetland or stream fills proposed within the floodway/floodplain and the stream classification for this project is WS -IV, NSW (i.e. not Outstanding Resource Waters, High Quality Waters, Coastal Wetlands or wetland adjacent to these waters). 1 b. We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural and silvicu/tural operations. The Carolina Friends School project is a privately funded institutional development. The property is located within Orange County and within the Jordan Lake Watershed, therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Water Supply, Watershed Protection Program which limits development densities as well as requires protective riparian buffers; and 2) the Jordan Watershed Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area in addition to "diffuse flow" requirements at a minimum, and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved. We anticipate that the DWR will advise us if any additional information is needed. 4. Sewage Disposal (DWQ Requirement) 4a. Clearly detail the ultimate treatment methods and disposition (non- discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. Based on our review, the SIA is in compliance with Orange County's stormwater requirements as outlined in Section 6.14 of our Unified Development Ordinance (U DO). The proposed plan utilizes two dry detention basins in order to meet peak flow attenuation requirements for new development in the Jordan Lake Unprotected Watershed of the Cape Fear River Basin. Our office hereby approves the SIA and grants permission for the Lower School Addition project to proceed, with the following conditions: 1. The Certificate of Occupancy will be held for the Lower School Addition until the Stormwater Management Plan (SMP) is submitted to our office for Pond 2 along with posting of a financial security for stormwater requirements of that Best Management Practice (BMP). 2. Approval of the Building Permit for the Performing Arts Center will be contingent upon receiving the SMP for Pond 3 along with posting of a financial security for stormwater requirements of that BMP. The Certificate of Occupancy will be held for the Performing Arts Center until all stormwater requirements are complete for Pond 3. S \5_Erosion Control and Water Quality\Erosion Control and Water QualityVobs by year \New Work 14 \Orange \Carolina Friends School \SMP EC 14 -0040 Approval 042015.docx Carolina Friends School SIA Approval Page 2 EC14 -0040 Stormwater requirements for each BMP include the following: • Civil Consultants will be required to submit a PE sealed as -built drawing of each BMP verifying that they have been installed according to the approved SMP. • A copy of the recorded Operation & Maintenance Agreement for each BMP will need to be submitted to our office. • A copy of the recorded drainage easement around each BMP along with an access easement to a public right -of -way will need to be submitted to our office. • Verification that the financially responsible party will submit annual inspection reports of the designated BMPs to our office by a person / entity certified in North Carolina Stormwater BMP Inspection & Maintenance. The surety documents are required to clearly denote that Campus -Wide stormwater requirements shall be met regardless of whether or not the Performing Arts Center is constructed. This approval is only valid for the purpose and design described in the approved SIA submittal by Civil Consultants dated April 8, 2015. Any change to the project requires notification to our office and may require submittal of a new application. If ownership of the property is transferred to another person(s) or entity, the new owner(s) will be responsible for complying with the approved plan. This approval also grants agents, officials, or other qualified persons authorized by Orange County the right to inspect the site to determine compliance with the approved Plan and Ordinance, including maintenance of on -site stormwater best management practices.
