NCEEP Mitigation Pam Paragraph 2 of the Certification calls for the mitigation payment to NCEEP to be made within one month of the date of approval (of the 401 Water Quality Certification). This time frame is not practical since the Corps of Engineers permit remains pending and capital funding for the project is not in place at this time. We request an initial extension of 6 months for this payment. It would be our expectation that payment would be required prior to the start of construction. 2. Stormwater Management Plan Submittal Paragraph 9 of the Certification calls for the submittal to DWQ of the final, written Stormwater Management Plan for the project within 60 days of issuance of the 401 Water Quality Certification. We request a 6 month extension for this submittal. It would be our expectation that Plan approval would be required prior to the start of construction. 3. Stormwater Management BMP's Paragraph 9 of the Certification outlines Stormwater Management Plan requirements. Please confirm our understanding that the 1999 NCDENR BMP Manual is applicable to this project and that linear addition maybe used to combine the assumed efficiencies of BMP's implemented in series to achieve the stipulated 85% TSS total removal efficiency. We anticipate using grassed swales in series with extended dry detention (35% + 50% = 85%) to meet the water quality requirements in a manner consistent with FAA Advisory Circular 150/5200-33A, "Hazardous Wildlife Attractants on or near Airports." Deed Notifications Paragraph 8 of the Certification requires deed notifications or similar mechanisms. This project involves construction of airport runway infrastructure on airport land. It does not involve the creation of any lot or building site for sale or lease. The sample deed notification document on the NCDENR website is clearly not applicable to this project.
