Director NORTH CAROLINA Environmental Quality January 29, 2024 DWR Project #: 2014-1149v9 George Howard Alamance County Restoration Systems, LLC (via electronic mail: george(ai)restorationsystems.com ) Re: RS Haw River Subwatershed — Phase 1 Neuse Buffer & Nutrient Offset Umbrella Mitigation Banking Instrument (UMBI) Benton Branch Bank Parcel Credit Release — Task 7 (final), Task 8 (partial) Dear Mr. Howard: On November 12, 2021, the Division of Water Resources (DWR) received a Year 4 Monitoring Report from Restoration Systems, LLC (RS) for the subject site. On March 23, 2022, DWR issued a partial (2.5%) credit release for Task 7 with the remainder 2.5% of the credit release to be issued upon 1) receiving confirmation that RS has planted stems in and around Plot 13 and, 2) if a site visit confirmed there are no additional notable concerns with the rest of the site. On December 29, 2022, the DWR received a Year 5 Monitoring Report from RS for the subject site which included documentation that the supplemental planting efforts in and around Plot 13 had been fully implemented. However, both the report and a site visit conducted by DWR on May 3, 2023, revealed additional concerns on other portions of the subject site. As a result of the site visit, DWR required RS to submit an Adaptive Management Plan (AMP) for review and approval. On June 8, 2023, RS submitted an AMP to DWR which was approved on June 19, 2023. The remainder 2.5% credit release for Task 7 is now approved. On January 10, 2024, the DWR received a Year 6 Monitoring Report from RS for the subject site. The report included documentation that the AMP was fully implemented on November 27, 2023, with the planting of 58 3-gallon and 20 1-gallon potted stems near/along Benton Branch. A partial credit release of 5% for Task 8 is being issued, with the remaining 5% to be issued upon receipt of a Year 7 monitoring report documenting successful performance of supplemental planting efforts in and around Plots 18, 19 and 20. DWR received a continuation certificate for the performance bond (#22BSBHT4273) in the amount of $60,000 issued to RS from Hartford Fire Insurance Company, to cover monitoring and maintenance at the subject site. The term of this bond applies beginning May 24, 2022 and ending with the approval of the Year 5 Monitoring Report by DWR. This bond must remain in place until DWR issues a final credit release of 5% for Task 8: Approval of Monitoring Report #5. The credit release schedule for the Benton Branch Bank Parcel was outlined in the approved Bank Parcel Development Package (BPDP). Therefore, 7.5% of your Jordan Lake riparian buffer Restoration credits (0.075 x 455,056.93 ft2 = 34,129.27 ft2) and 7.5% of your Jordan Lake riparian buffer Enhancement and Preservation credits (0.075 x 225,763.44 ft2=16,932.26 ft2) are now released. Additionally, 7.5% of your generated nitrogen (N) offset credits (0.075 x 179.95 = 13.50 lb-N) and 7.5% of your generated phosphorus (P) credits (0.075 x 11.5 = 0.86 lb-P) are now released. Generated credits are credits that have not been applied to the appropriate delivery factor. The delivery factors applied to this bank due to its location in the 14-digit HUC 03030002050050 are 25% for nitrogen and 8% for phosphorous. Therefore, the total amounts of delivered nutrient offset credits for this site are 44.99 lb-N and 0.92 lb-P. By copy of this correspondence, 7.5% of your delivered nitrogen offset credits (0.075 x 44.99 lb-N = 3.37 lb-N) and 7.5% of your delivered phosphorus credits (0.075 x 0.92 = 0.07 lb-P) are now available for sale. Please note that only the delivered nutrient offset credits can be sold from this bank and used for impacts in the Haw River Arm of Jordan Lake within the Cape Fear River Basin. Additionally, riparian buffer credits can only be used to offset impacts located in the Haw River Sub Watershed of Jordan Lake according to 15A NCAC 02B .0295, which became effective on November 1, 2015.
