As requested, enclosed are five (5) revised copies of the Pre - Construction Notification (PCN) Form, four (4) copies of the Agent Authorization Form and a check in the amount of $330 (check #1432). The enclosed check supplements the check for $240 (check #1428) that was submitted with our original letter and PCN dated September 4, 2015. The two checks total $570 which should satisfy the requirements of 143- 215.3D (e), the processing fee for a major water quality certification. The project information included in our previous submittal is still applicable and is included herein for ease of reference: The U.S. Army Corps of Engineers (Corps), on behalf of the Town of Hookerton, NC requests NC Division of Water Resources (DWR) concurrence with applicability of General Certification (GC) #3885 for the emergency protection of a municipal wastewater lagoon (Lagoon #1) located adjacent to Contentnea Creek in the Town of Hookerton, North Carolina. This proposed project would be constructed under the authority of Section 14 of the Flood Control Act of 1946, as amended. The Section 14 program exists to protect public facilities which provide essential public services and are experiencing imminent threat of damage or failure due to natural erosion processes on stream banks and shorelines. The proposed project includes placement of a layer of stone (riprap) over a layer of bedding stone along approximately 550 linear feet of streambank and extending for a distance of approximately 40 -50 feet from the top of the existing streambank in the oxbow bend of Contentnea Creek adjacent to Lagoon #1 of the Hookerton wastewater treatment plant. The streambank would be cleared and graded to a 1.5H:1V to 2H:1 V slope (depending on segment) for placement of the streambank slope protection measures. Below the ordinary high water line, backfill material consisting of NC Department of Transportation (DOT) #57 stone would be placed over a geotextile layer, graded, and compacted as required to provide a smooth sloped surface for the placement of additional stone. Above the ordinary high water line, backfill material consisting of satisfactory fill (earth) material would be placed on the existing cleared streambank, graded, and compacted as required to provide a smooth sloped surface for placement of the stone slope protection. The streambank slope protection measures would consist of a 12 -inch layer of bedding stone (DOT #57 stone) and a 27 -inch thick layer of DOT Class II riprap placed over a layer of geotextile and graded fill slope. Toe protection will be -2- placed along the toe of the stream bottom. The stone toe protection will be placed to a distance of approximately eleven (11) feet to eighteen (18) feet from the toe and to a height of approximately 3 feet above the stream bottom. Materials staging would take place in previously disturbed areas. Vegetative clearing not to exceed one acre may be required to accommodate necessary equipment and to allow for proper construction of protection measures. The proposed project would provide protection for Lagoon #1 of the Hookerton wastewater treatment plant and prevent the discharge of between 2.5 and 3.6 million gallons of raw sewage directly into Contentnea Creek, should dike failure occur. Stop -gap measures (completed by the State of North Carolina), which include streambank riprap placement across —50 linear feet of most severe erosion and are currently in place in anticipation of more robust, Corps- constructed project to follow. An in -water construction moratorium spanning February 15 -June 30 has been established to ensure uninterrupted use of water bodies known to be seasonally inhabited by anadromous fishes. Contentnea Creek, which includes the proposed project area, is subject to this moratorium. Work would be conducted in accordance with this environmental window, to the extent practicable. The Corps has been in communication with the US Fish and Wildlife Service, National Marine Fisheries Service, and NC Wildlife Resources Commission regarding use of Contentnea Creek by anadromous fishes, and the proposed in -water construction activity. Should resources be available to begin in -water construction prior to June 30, 2016, the Corps will coordinate with the above - mentioned resource agencies regarding anadromous fish activity in the project area and adjust construction schedules accordingly. The proposed action will not impact submerged aquatic vegetation or other essential fish habitat and will not incorporate contaminated sediments. With the exception of the Northern Long -eared bat, which will not be affected by the proposed action, the project may affect but is not likely to adversely affect federal or State listed threatened or endangered species, or other species of concern including the Red - cockaded woodpecker, American eel, Carolina madtom, and Pinewoods shiner. The proposed project's length of 550 linear feet slightly exceeds the 500 -foot length limit described within conditions of Corps' Regulatory Nationwide Permit 13 (NWP 13); however, because this proposed project involves stabilization of a highly eroded streambank, and is of an emergency nature, it is of the Corps' opinion that the proposed proj'ect complies with GC #3885. It should be noted that since the Corps does not permit itself, a NWP 13 will not be issued for this action; however construction will be done in accordance with the conditions of NWP 13. No significant comments were received during public review; therefore the Corps has determined that a Finding of No Significant Impact ( FONSI) is appropriate for this project. Our comments are provided in accordance with the North Carolina Environmental Policy Act (G.S. 113A -1 et sec{., as amended; l NCAC -25), provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), Coastal Area Management Act(G.S. 113A -100 through 1 I3A -128), as amended and Sections 404 and 404 of the Clean Water Act (as amended). The US Army Corps of Engineers (USAGE) has submitted a plan to stabilize the shoreline adjacent to the Town of Hookerton's Wastewater Treatment Plant (WWTP). This facility has a series of wastewater lagoons, one of which is in danger of breaching into Contentnea Creek. A temporary measure was installed May 2015 to provide additional time until a more long term measure could be implemented, The preferred alternative presented by the USACE and supported by Hookerton is to harden approximately 550' of shoreline with geotextile and riprap from the bank down to the bottom contour. To minimize elevated turbidity levels and prevent debris from entering the construction area, the work will be conducted behind a turbidity curtain, closing approximately one half of creek width in this area during construction. Department of Administration 1301 Mail Service Center Raleigh, North Carolina 27699 -1301 Subject: Intergovernmental Review State Number: 16 -E -4600 -0035 NC Section 14 Streambank and Shoreline Erosion Protection Project, Greene County As requested by the North Carolina State Clearinghouse, the North Carolina Department of Public Safety Division of Emergency Management Risk Management reviewed the proposed project for the streambank stabilization along Contentnea Creek at the Hookerton Wastewater Treatment Facility and offers the following comments: 1) Executive Order 11988 requires an eight -step review process that agencies should carry out as part of their decision - making on projects that have potential impacts to or within the floodplain. Any work within the SFHA of studied streams, based on the current Flood Insurance Rate Map, should follow these guidelines in order to avoid to the extent possible the Iong and short term adverse impacts associated with the occupancy and modification of floodplains. The eight steps are summarized below. a. Determine if a proposed action is in the base floodplain (that area which has a one percent or greater chance of flooding in any given year). b. Conduct early public review, including public notice. Identify and evaluate practicable alternatives to locating in the base floodplain, including alternative sites outside of the floodplain. d. Identify impacts of the proposed action. e. If impacts cannot be avoided, develop measures to minimize the impacts and restore and preserve the floodplain, as appropriate. f. Reevaluate alternatives. g. Present the findings and a public explanation. h. Implement the action. Greene County participates in the National Flood Insurance Program and enforces a Flood Damage Prevention Ordinance that requires a Floodplain Development Permit be issued for all development located in the Special Flood Hazard Area (SFHA) within its jurisdiction. The site outlined in the application encroaches on the SFHA of Contentnea Creek. Please see Flood Insurance Rate Map Panels 4600 and 4620. Any grading, fill or placement of equipment or materials in the SFHA will require a floodplain development permit issued by Greene County. 3) The project will encroach on the floodway of Contentnea Creek. A hydraulic analysis shall be performed to determine the impact on flood levels during the base flood discharge due to the proposed construction. An increase in flood levels will require approval of a Conditional Letter of Map Revision prior to construction. No structures shall be impacted by the increase in flood levels.
