Thanks you for consolidating all of the forms. I have received all of the required countersigned MRTFs for the following components of the Vinfast project: • Project Blue component Phase 1B, and • Utilities component. Note, however, that the Corps of Engineers permit requires that the compensatory mitigation requirement for Phases 113 and 1C of the NCDOT HE-0006 component be satisfied (i.e. countersigned MRTFs must be received by the Corps) "prior to initiating any impacts as authorized by this permit." As such, once the two MRTFs for Phases 113 and 1C of the NCDOT HE-0006 component are submitted, then the compensatory mitigation requirements for the Vinfast Project Blue component Phase 1B, Utilities component, and Phases 113 and 1C of the NCDOT HE-0006 component per Permit Special Condition 28 will be satisfied. Note also the phased compensatory mitigation requirements prior to initiating any authorized impacts in Project Blue Phase 3 and Phases 1D, 1E, 2A, and 2B of the NCDOT HE-0006 component. NCDOT is currently finalizing the mitigation on their end following NCDOT procedures and we anticipate that will be wrapped up shortly. You were already copied on these, but for sake of continuity I wanted to follow up and provide the signed MRTFs for the non-NCDOT impacts in a single email. With the previously conducted pre -construction meeting, and with the mitigation payments completed, can you review the attached documentation and confirm that the mitigation requirement is complete for the VinFast and Sanford pieces of this project? The contractors are standing by to mobilize, however we wanted to confirm with USACE before any impact areas are released. NCDWR has also received these and is reviewing to confirm compliance with NCDWR mitigation requirements as well. Importantly, this authorization includes multiple Compensatory Mitigation requirements (RES, Wildlands, and NCDMS). Due to the file size of the permitted project plans I have provided a DoD SAFE link email under separate cover containing the permitted plansheets for the Project Blue, HE-0006, and utilities project components as well as the HDD contingency plan (referenced in Permit Special Conditions 1, 19, and 20); these documents are part of this permit.
