January 23, 2024 Amanda Owens, Town Manager Town of Franklin Email: aowens@franklinnc.com SUBJECT: NOTICE OF VIOLATION Tracking Number: NOV-2024-PC-0076 Incident # 202400057 Unauthorized Bypass Permit No. NC0021547 County: Macon Dear Ms. Owens: A review has been conducted of the self-reported Bypass 5-Day Report submitted by Jason Hopkins (ORC) on January 10, 2024. The Division’s Asheville Regional Office (ARO) concludes that the Town of Franklin violated Permit Condition Part II.C.4.c.1: Bypass from the treatment facility is prohibited and the Permit Issuing Authority may take enforcement action against a Permittee for bypass. Specific incident cited in the violation includes the following: A 175,000-gallon unauthorized bypass of secondary effluent from the manhole between the secondary clarifiers and the chlorine contact chamber to the Little Tennessee River occurred on January 9, 2024. This Notice of Violation (NOV) is being issued for the noted violation of North Carolina General Statute (G.S.) 143- 215.1 and the facility’s NPDES Permit. Remedial actions, if not already implemented, should be taken to correct the above noncompliance and to prevent future noncompliance.
