Box 866 Pembroke, NC 28372 Subject: Pretreatment Review of Industrial User Pretreatment Permit Draft Program: Town of Pembroke Wastewater Treatment Plant: Town of Pembroke (Pembroke WWTP) NPDES #: NC0027103, Robeson County Dear Mr. Thomas: The Municipal Unit of the Division of Water Resources has reviewed the new Industrial User Pretreatment Permit (IUP) submitted by the Town of Pembroke for the following Significant Industrial User (SIU). The draft submission was received by the Division on January 15th, 2024, with a revision received on January 18th, 2024. IUP # SIU NAME 002 Dessert Holdings Pembroke, NC Facility The review indicates that the draft IUP is adequate and meets the minimum requirements of 15A NCAC 2H .0916 and 40 CFR 403.8(f)(1)(iii). The Town of Pembroke is required to provide the final signed IUP by March 1st, 2024, to the Division. The allocation table, maintained in the Division’s database, has been updated accordingly. Within 180 days of the effective date of any reissued or modified NPDES permit the permittee would be required to submit to the Division a written technical evaluation of the need to revise local limits (i.e., an updated IWS, or documentation of why one is not needed). This action may include revising, updating, or adding to the list of Significant Industrial Users (SIUs). Pursuant to 15A NCAC 2H .0907(b) either the Division or the permittee may initiate pretreatment program revisions. Federal and State pretreatment regulations require the local delegated pretreatment program to effectively control and document the discharge of wastewater from Significant/Categorical Industrial Users to the POTW . It is the POTW’s responsibility to ensure that these objectives are consistently met.
