4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: *
There is a stream crossing and the keystone wall had collapsed and needs repair, this site is in a residential subdivision and this particular area has over 60 acres of land draining to the
collapsed wall.
a
4b. Have Corps permits or DWR certifications been obtained for this project (including all prior phases) in the past?
Yes No Unknown
If yes, please give the DWR Certification number or the Corps Action ID (exp. SAW-0000-00000).
Could not be found even after talking with Lyle (George Phillips) on 24 May 2023, he mentioned that he could not find records of this either.
4f. List the total estimated acreage of all existing wetlands on the property:
UKN (none in this project area)
4g. List the total estimated linear feet of all existing streams on the property:
132
4h. Explain the purpose of the proposed project: *
There was a wall that collapsed and is eroding and we are submitting this plan to correct the problem with a change in the plans to remove the wall and slope grade down, this will extend
the pipe and we are purposely oversizing the pipe to help the flow of the stream, and it provides a bigger headwall. In my professional opinion the pipe is undersized and caused the wall to
collapse so it is my opinion to prevent the best way to not have another wall fail is to not have a wall. This project is required to be done regardless if we increase the impact or not, we will
need to fix the wall at the very minimum.
4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: *
As the stream is a perennial stream, we will need to have a coffer dam and a by pass pump and will need to remove the existing wall and bring in dirt by a dump truck to the edge of the
project for an excavator to spread the dirt and something to compact the dirt to a 3:1 slope.
5. Jurisdictional Determinations
5a. Have the wetlands or streams been delineated on the property or proposed impact areas?
Yes No Unknown
Comments:
No wetlands in project area.
5b. If the Corps made a jurisdictional determination, what type of determination was made?*
Preliminary Approved Not Verified Unknown N/A
Corps AID Number:
this was determined prior to 2007
5c. If 5a is yes, who delineated the jurisdictional areas?
Name (if known):
Agency/Consultant Company:
Other:
6. Future Project Plans

E. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
this measure may increase the impact but it protects the stream from future failures and erosion issues.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Double row of silt fence along the stream banks and clean water diversion around the project area.
2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State
2a. Does the project require Compensatory Mitigation for impacts to Waters of the U.S. or Waters of the State?
Yes No
2b. If this project DOES NOT require Compensatory Mitigation, explain why:
In truth I am unsure if there is mitigation required but the new impact is far below the allowed amount without mitigation.
F. Stormwater Management and Diffuse Flow Plan (required by DWR)
1. Diffuse Flow Plan
1a. Does the project include or is it adjacent to protected riparian buffers identified within one of the NC Riparian Buffer Protection Rules?
Yes No
What type of SCM are you providing?
Level Spreader
Vegetated Conveyance (lower SHWT)
Wetland Swale (higher SHWT)
Other SCM that removes minimum 30 % nitrogen
Proposed project will not create concentrated stormwater flow through the buffer
2. Stormwater Management Plan
2a. Is this a NCDOT project subject to compliance with NCDOT's Individual NPDES permit NCS000250?
Yes No
