A self-report of non-compliance was sent to the agencies on September 14, 2023 and a site visit with the USACE and DWR was conducted on October 19, 2023 to observe the extent of the non-compliance. The temporary Sediment Basin #13 was incorrectly installed past the approved limits of disturbance and the impacts appear within jurisdictional wetlands, stream, and riparian buffer situated north-northwest of the planned temporary Sediment Basin #13 location. In order to address the comments in the Notification, Sediment Basin #13, which was incorrectly installed has been removed and a stream and wetland restoration plan has been designed. Sediment Basin #13 has been installed in its correct location. See Attachment No. 1 for the Bexford Restoration Plan. The restoration plan includes restoring the Sediment Basin impact area with approved wetland soils to pre-construction grade. Seed, straw, and mat will be used to stabilize the area. The stream channel will be realigned per the elevations indicated on the plans (Sheet 2 of Attachment No. 1). The banks will be replanted with native vegetation. ENGINEERING I DESIGN I TECHNOLOGY Response to Notification of Permit Non-Compliance— Bexford November 16, 2023 Page 2 Photos from the contractor are provided in Attachment No. 2 documenting the completed basin removal and light grading of the impact areas as part of the on-going restoration to pre- construction grade. Timmons Group will perform an inspection and provide photos via email to the USACE and DWR following herbaceous seed mix, and again following woody species planting (if separate planting is required). Per DWR requirement, Timmons Group will conduct 3 years of monitoring of the wetland and buffer plantings, and stream restoration. Monitoring will consist of a brief visual inspection and emailed update with photo documentation to the USACE and DWR. Monitoring is proposed to begin between late April-May 2024, continuing through 2026. If, upon the 2025 monitoring the area appears to be functioning as intended with sufficient species survival, Timmons will request no further monitoring required. Set forth below are the requests from the Notification in blue italics, followed by our responses. 1. The incorrectly installed Sediment Basin #13 must be removed from the wetland, stream, and riparian buffer areas. The incorrectly installed Sediment Basin #13 was removed between November 7 and November 10, 2023. A replacement Sediment Basin #13 was already installed at the correct location at the time of site inspection on October 19, 2023. Attachment No. 2 contains photographs of the incorrectly installed Sediment Basin #13, the updated installation of Sediment Basin #13, and the removal of the incorrect location of Sediment Basin #13. 2. The impacted areas must be restored to natural conditions. The wetland and stream features must be restored to natural grade and profile. Please ensure that design and plans are provided to both DWR and USACE for approval. The riparian buffer area must be restored using native plant species and meet all criteria under the Neuse Riparian Buffer Rules (15A NCAC 02B .0714). A restoration plan should be provided to DWR as part of your response that includes a monitoring plan for the wetland, stream, and buffers plantings for 3 years (if deemed appropriate, DWR can shorten the length of time required for monitoring). The wetland and stream features will be restored to natural grade and profile per Attachment No. 1, the Bexford Restoration Plan. The restoration plan includes restoring the Sediment Basin impact area with approved wetland soils to pre-construction grade. Seed, straw, and mat will be used to stabilize the area. The stream channel will be realigned per the elevations indicated on the plans (Sheet 2 of Attachment No. 1) with appropriate channel dimensions. The excavated material will be stockpiled within staging areas located outside of wetland and riparian buffer limits for later use as upland fill material or disposal. The side slopes of the stream areas with be fine graded and C-700 matting from toe of channel to 6-feet offset will be installed and is shown on the plans. Sheet 1 of Attachment No. 1 explains the sequence of construction, including the general site preparation, the site improvements, and general site completion. The stream banks will be replanted with native vegetation (Sheet 2 of Attachment No. 1). Complete site seeding and planting as described in the construction plans and specification (Sheet 3 of Attachment No. 1)will be completed. Once site improvements are completed, we will reach out to the USACE and DWR for approval. Response to Notification of Permit Non-Compliance— Bexford November 16, 2023 Page 3 A portion of the impact area overlaps with permitted Impact 6, a proposed sewer line and associated utility easement permitted for 0.09-acres of temporary wetland impact to be permanently maintained as herbaceous, 20-linear feet of temporary stream impact, 1,438-sq ft of Zone 1 riparian buffer impact, and 1,013-sq ft of Zone 2 riparian buffer impact. It is anticipated Impact 6 will occur by the end of 2024. The portions of Impact 6 overlapping with the non-compliance area will be restored with the overall non-compliance area, however, no wood species planting is proposed as this area is permitted to be maintained as herbaceous, and any plantings would require removal at the time of utility line construction. The monitoring plan for the wetland, stream, and buffers plantings for 3 years include the following timeframes: 1. Timmons to provide photo documentation within 2 weeks of completion of all work with the exception of the woody species planting; 2. Timmons to provide photo documentation within 2 weeks of completion of woody species planting (if separate planting is required); 3. Between late April -May beginning May 2024, for 3 years 3. Please provide an impact map that depicts: a) The unauthorized impact total to the wetland (acres) The unauthorized impact total to the wetland feature is 0.32-acres. b) The unauthorized impact total to the stream channel (linear feet) The unauthorized impact total to the stream channel is 199 linear feet. c) The unauthorized impact total to the riparian buffer area (square feet) The unauthorized impact total to the riparian buffer areas include 9,481 square feet to Zone 1 and 1,920 square feet to Zone 2. This is depicted on Attachment 1, Sheet 3. 4. As part of your plans, please include any temporary impacts that will occur during the construction process(pump arounds, etc.) and clearly indicate the access path for equipment. The access routes are located northwest and southeast of Impact 6 and the incorrectly installed Sediment Basin #13. Both access routes are located within either upland areas or areas that have already been permitted to include temporary impacts. The contractor will install a temporary crossing per the permitted plans at Impact Areas 4 and 5 to gain access to the east side of Impact 6. The contractor will provide access to the west side of Impact 6 from the stabilized upland area northwest of the impact. A check dam will be placed at the most downstream point of the LOD during construction. Due to low flow conditions at the site, no pump-around is proposed or required. 5. As part of your plans, please include an anticipated date that construction will begin and end. The proposed timeline for the project is as follows: - Final Restoration Plan, if modification requests are received — within no more than 2 months of agency request. Response to Notification of Permit Non-Compliance— Bexford November 16, 2023 Page 4 - Construction — o Sediment Basin #13 was removed between November 7 and November 10, 2023 and was installed in the correct location prior to the October 19, 2023 site visit. o Within 1 month of agency approval of restoration plans, contractor will remove sediment and replace with wetland soil fill to pre-construction grade, realign the stream channel per restoration plans, and stabilize/seed the area. Woody vegetation is proposed to be installed when materials are received, to occur after stabilization and seeding but no later than March of 2024. Depending on authorization date and time to receive woody species, herbaceous plantings may occur ahead of woody species planting. No woody plants are proposed to be installed within the maintained sewer right-of-way. Please provide a response (including photo documentation) and remediation plans within 30 days of this notification. The remediation plans and photo documentation are located within Attachment No. 1 and No. 2.
