PROJECT SUMMARY:
The applicant is proposing to construct a single-family residence with covered and uncovered decks, 404 wetland fill,
grading, pool with decking, vegetated swale, landscaping and a gravel pervious driveway on the existing .322 acre
tract of land. The single-family lot does not border normal high water therefore no work waterward of NHW is
proposed, only high ground development, which involves filling a total of 1,528 sf of 404 jurisdictional wetlands (590
sf within the 575'ORW Estuarine Shoreline AEC).

9. Pro'ect Description
The existing .322-acre tract (14,039sf) currently is an undeveloped lot in North Topsail Beach
at 103 Old Village Lane. The site is located south of the Permuda Island Reserve. The
property does not extend to the normal high-water contour but is within the 575' ORW AEC.
The tract is 5' above NHW, has USACOE 404 jurisdictional wetlands and a small (12' x 35')
section of coastal wetlands. Permits have been issued by the USACOE and NC DWR
(USACOE- SAW-2022-02407 and NCDWR- DWR# 20221553).
The waters adjacent to the project area are classified as "SA, ORW" by the Division of Water
Resources and classified as a Primary Nursery Area. According to the maps provided by the
Shellfish Sanitation Section of the NC Division of Marine Fisheries, the waters within this area
are predominately open to shellfish harvesting. There is no development proposed within
navigable waters and there are no known historic or archaeological areas of value known within
the project site,
10. Proposed Project
The applicant is proposing to construct a single-family residence with covered and uncovered
decks, 404 wetland fill, grading, pool with decking, vegetated swale, landscaping and a gravel
pervious driveway. The lot is currently vegetated with trees, typical grasses, a section of coastal
wetlands and 404 wetlands.
The applicant is proposing to fill a total of 1,528 sf of 404 wetlands (590 sf within the AEC) to
accommodate the construction of a two-story single-family home (includes covered and
uncovered decks) on pilings over a concrete slab which includes a closed area for entry and
storage as well as garage. Per the applicant the peak of the proposed dwelling would be 43.3'
above slab elevation. A total of 1,528 sf of fill is proposed within the 404 wetlands to existing
grade.
They are also proposing the construction of a 10' x 20' pool with 6' x 34' concrete decking as
well as a pervious gravel drive, vegetated swale and landscaping. The existing tract area
calculated within the 575' AEC is 8,033 sf with 14,039 sf for the entire tract. The project
proposes a BUA for the site within the 575' AEC of 16.6% and 16.9 % for the entire tract,
11. Anticipated Impacts:
The development would grade, fill and disturb 11,761.2 sf (.27ac) of high ground with 1,336 sf
of BUA within the 575' Estuarine Shoreline AEC and 2,377 sf of BUA for the entire tract. The
proposal would fill a total of 1,528 sf of jurisdictional wetlands for the entire lot which includes
the 590 sf of wetland fill within the 575' AEC. There is no work proposed waterward of NHW at
this time. The applicant has already received permits from the USACOE and NC DWR for the
jurisdictional wetland fill (USACOE- SAW-2022-02407 and NCDWR- DWR# 20221553).

This notice is intended to make you, the applicant, aware of the
special risks and conditions associated with development in this
area, which is subject to natural hazards such as storms, erosion
and currents. The rules of the Coastal Resources Commission
require that you receive an AEC Hazard Notice and
acknowledge that notice in writing before a permit for
development can be issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alterations are designed to minimize, but not
eliminate, property loss from hazards. By granting permits, the
Coastal Resources Commission does not guarantee the safety of
the development and assumes no liability for future damage to
the development. Permits issued in the Ocean Hazard Area of
Environmental Concern include the condition that structures be
relocated or dismantled if they become imminently threatened
by changes in shoreline configuration. The structure(s) must be
relocated or dismantled within two (2) years of becoming
imminently threatened, and in any case upon its collapse or
subsidence_
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual long-term
average ocean erosion rate for the area where your property is
located is feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past 50 years.
Studies also indicate that the shoreline could move as much as
feet landward in a major storm.
The flood waters in a major storm are predicted to be about
feet deep in this area.
Preferred oceanfront protection measures are beach nourishment
and relocation of threatened structures. Hard erosion control
structures such as bulkheads, seawalls, revetments, groins, jetties
and breakwaters are prohibited. Temporary sand bags may be
authorized under certain conditions.
The applicant must acknowledge this information and
requirements by signing this notice in the space below. Without
the proper signature. the application will not be complete.

Inlet Hazard Area
SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive storms and
erosion. Permits issued for development in this area expire on
December 31 of the third year following the year in which the
permit was issued. Shortly before work begins on the project
site, the Local Permit Officer must be contacted to determine the
vegetation line and setback distance at your site. If the property
has seen little change since the time of permit issuance, and the
proposed development can still meet the setback requirement,
the LPO will inform you that you may begin work. Substantial
progress on the project must be made within 60 days of this
setback determination, or the setback must be re -measured. Also,
the occurrence of a major shoreline change as the result of a
storm within the 60-day period will necessitate re -measurement
of the setback. It is important that you check with the LPO
before the permit expires for official approval to continue the
work after the permit has expired. Generally, if foundation
pilings have been placed and substantial progress is continuing,
permit renewal can be authorized. It is unlawful to continue
work after permit expiration.

103 OId Village Lane Project is titled to Capital Asset Topsail Development, LLC in Deed Book 6033, Page 71
of the Onslow County Registry. The property consists of one single family lot as depicted as Lot 6, Section 2,
Village of Stump Sound, Map Book 27, Page I I I as recorded on December 20, 1990. The property contains
14,039 square feet or 0.322 acres and has no shoreline along Topsail Sound and the Atlantic Intracoastal
Waterway. The Atlantic Intracoastal Waterway and Topsail Sound are located on 18-87-0.5 and are classified as
ORW(Outstanding Resource Waters), and rest within the White Oak River Basin. The waters of Stump Sound
designated as Primary Nursery Area.
The dwelling on Lot 5 to the west was constructed in 1998 and the dwelling on Lot 7 to the east was constructed
in 2017, as stated on the Onslow County Tax Office records. It is apparent the stormwater from these Iots has
sheet flowed to this vacant lot.
Capital Asset requests to construct a single family dwelling, driveway and pool with pool decking on Lot 6.
During the due diligence of the property, it was determined there was a presence of 404 Wetlands on the lot. The
wetlands were delineated by Mr. Gene Young of Applied Resource Management and confirmed by the United
States Army Corps of Engineers. Plot Plans were created illustrating the proposed construction of the dwelling in
the center of the lot, however, this would impact more wetlands than the USACE allowed, so to avoid and
minimize the impacts the proposed dwelling was shifted westward, therefore reducing the impacts. The USACE
issued a fill permit under SAW-2022-02407 for the filling of 1,528 square feet or 0.035 acres of 404 wetlands.
The Division of Water Quality has issued the 401 Water Quality Certification, DWR # 20221553.
Lot 6 has a total of 8,033 square feet of area within the 575' of ORW. The proposed impervious surface within
the 8,033 square feet is 1,336 square feet or 16.6 %.
Development of the property results in one two story single family dwelling on pilings over concrete slab,
enclosed below for entry, storage and garage. Sewer to be provided through the existing sewer system handled
by Onslow Water and Sewer Authority and water service to be provided by Onslow Water and Sewer Authority.
Land disturbance will be less than 12,700 square feet and will not require a State Erosion Control Plan. When the
subdivision was created in 1990 a State Stormwater Permit was issued and Restrictive Covenants were placed on
record and allowed for 2,500 square feet of impervious surface for Lot 6. As stated on the Survey, Capital Asset
is proposing a total of 2, 377 square feet, which is compliant with the stormwater restrictions.
