The Division of Energy, Mineral, and Land Resources (DEMLR), received a complete Stormwater Management Permit
Authoriza?on to Construct (ATC) Applica?on for the subject project on January 9, 2024. Staff review of the plans and
specifica?ons has determined that the project, as proposed, will comply with the Stormwater Regula?ons set forth in
Rule 15A NCAC 2H.1043. We are forwarding Authoriza?on to Construct Permit No. SWA000227, dated January 18, 2024,
for the construc?on, opera?on and maintenance of the subject project and the stormwater system. This permit shall be
effec?ve from the date of issuance and shall be subject to the condi?ons and limita?ons as specified therein, and does
not supersede any other agency permit that may be required.
The original signed permit package and approved plans are being mailed to the permi?ee, Gregory Sharpe, at the

project on 9/18/23. Reviews under the Fast-Track permi?ng process can take up to 30 calendar days to complete. You
can see where this project stands in the review queue by emailing Jim Farkas (He has an autoreply set up that has the
review queue on it). Please upload all documents that you mailed into our office through the link provided below. Be
sure to choose the Central Office as the Primary Contact office.

IMPORTANT NOTE: Please ensure that each file is uploaded under its appropriate file type. Addi?onal file types can be
entered into the electronic form by clicking on the “Add Another Post-Construc?on File Upload” link directly below the
“State Stormwater Informa?on Uploads” sec?on of the form. YOU MUST CLICK ON THE “ADD ANOTHER POST-
CONSTRUCTION FILE UPLOAD” TO ADD ADDITIONAL FILE TYPES TO THE SUBMISSION. Merely changing the file type
dropdown as you upload the various files (without adding addi?onal file uploads) will upload all of the files as the last
file type selected, the submission will get flagged during review, and you will need to resubmit the files. Please do not
upload en?re plan sets through this form, but rather upload the relevant individual sheets under the appropriate file
type. Selec?ng the correct file type ensures that the files are properly named in the electronic repository and it helps
expedite the review process. NOTE: We do not require and we discourage the upload/submission of extraneous plan
sheets (such as ligh?ng plans, u?lity plans, striping plans, sight distance plans, etc…) as these files are not needed for

I received addi?onal informa?on for your project on 9/6/2023.
There are two small issues.
- On page 1 of the applica?on, for the projec?on coordinates: The provided coordinates (35° 51’ 54.7” N, 80° 46’
17.7” W) appear to be incorrect. Please revise this. (NOTE: I apologize for leaving this comment off our last
correspondence, it should have been added.)

- On page 5 of the applica?on for the receiving waters: Please remove “Catawba River (South Carolina) from
receiving water 2.
If you could respond to this email with a copy of the corrected applica?on, I can print this out and add it to your package
and get it entered ASAP.

We received your application for a new Fast-Track post-construction stormwater permit on 8/2/2022. At this time, the
submission is not administratively complete and cannot be accepted for review in its current condition. Please provide
the following submittal items within 30 calendar days (by close of business on 10/7/2022) so that we may accept the
project and begin the review process, otherwise, the project will be returned as administratively incomplete.
2x hard copies and 1x electronic copy of the Application with the following corrections made (These items are
required per 15A NCAC 02H .1043(3)(a) and per Section F of the Application):
Section E, 4 - Please use the information for the first named surface water (“Davis Branch”, “C”, “11-139-
3”) for the receiving stream name, classification and index number. This is required per 15A NCAC 02H
.1043(3).
2x hard copies and 1x electronic copy of a construc?on sequence that discusses how any future development on
the project may be phased. This is required per 15A NCAC 02H .1043(3)(g) and per Sec?on F, 5 of the
Applica?on. The construc?on sequence does not need to be lengthy, just a brief descrip?on of how future
development on the project (beyond what is shown on the plans) will be phased. If no future development is
planned for the project, you can simply state that in the construc?on sequence. This item is different than the
E&SC sequence of construc?on.
Since these are minor issues. You can a?ach the corrected pages in a follow up email that I can add to your exis?ng
applica?on.
NOTE: While not required for administra?ve completeness, this project is located in the Waxhaw Watershed and is
therefore subject to the Goose Creek Rules (15A NCAC 02B .0602). Please ensure that the difference between the pre-
and post-development 1-year 24-hour storm event is used to determine the minimum required treatment volume of the
proposed SCM(s). Please also ensure that the proposed SCM promotes infiltra?on of flows and groundwater discharge
as required per 15A NCAC 02B .0602 (Goose Creek Rules). It is recommended to revise the stormwater treatment
summary, narra?ve, and SCM details as needed to meet all of the requirements of the Goose Creek Rules. If it is not
possible/prac?cable to promote infiltra?on, a wri?en explana?on should be provided.
NOTE: This is an administrative completeness review, not a detailed engineering review, there may be other issues that
may be brought up during the engineering review.

If these items are received within the stipulated timeframe, we can accept the project and begin the review process.
Once accepted, reviews under the Fast-Track permitting process can take up to 30 calendar days per statute.
