Dear Mr. Blakely:
On September 14, 2007, the Division of Water Quality (DWQ) received your application dated
September 5, 2007, to fill or otherwise impact 25 linear feet of perennial stream and 1,200 square
feet of Zone 1 Neuse River basin protected riparian buffers. On September 26, 2007, the DWQ
received additional information regarding this project.
The DWQ has reviewed the stormwater management plan that has been approved by the Town
of Smithfield per their letter dated August 24, 2007. On August 20, 2007, the DWQ initiated a
new policy by which stormwater management plans that have been approved by a local
government that is implementing astate-mandated stormwater program do not typically require
additional stormwater approval from the DWQ for the issuance of a 401 Certification.
Notwithstanding this new policy, DWQ reserves the right to review individual stormwater
management plans on a case-by-case basis in order to ensure that a proposed activity will not
violate water quality standards.
On this project, the DWQ will require a stormwater management plan that complies with the
stormwater management provisions of the 401 Certification program as codified in General
Certification 3631. The DWQ has made this decision on the following bases:
• The high level of impervious surface currently proposed on the site (35 percent) as well
as the intent to add additional-impervious surface in the future.
The sensitivity of the watershed as a nutrient sensitive water (NSW).
The lack of water quality controls on the locally approved stormwater plan as well as the
failure of the locally approved plan to account for the nutrient loading associated with the
future development plans for this site.

Based on the reasons stated above, the DWQ is requiring that a stormwater management plan
that complies with General Certification 3631 be submitted for review and approval. General
Certification 3631 requires that projects that are over 30 percent impervious provide stormwater
BMPs that treat the runoff from the entire site to a minimum standard of 85%TSS removal and
30% total nitrogen and total phosphorus removal. Please provide the following information so
that we may continue to review your project.
Additional Information Requested:
1. Please provide stormwater BMPs that removal a minimum of 85%TSS and a
minimum of 30% total nitrogen and total phosphorus. The BMPs must be designed
according to the latest version of the DWQ BMP Manual. The BMPs should be sized
to handle the stormwater from the entire site as currently proposed. If the BMPs are
not large enough to handle the flows from the future building planned on this site,
then a modified stormwater plan will have to be submitted to DWQ for approval prior
to the construction of any future buildings.
2. Please provide a separate BMP Supplement Form for each proposed BMP on the
project. Both worksheets must be submitted (Design Summary and Required Items
Checklist) along with all of the required items. The new BMP Supplement Forms are
available at: http•//h~o enr.state.nc.us/su/bmp forms.htm.
Please submit this information within 30 calendar days of the date of this letter. If we do not
receive this requested information within 30 calendar days of the date of this letter and an
extension has not been requested, your project will be withdrawn and you will need to reapply
with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your application
are not authorized (at this time) by the DWQ. Please call Ms. Cyndi Karoly or Mr. Ian
