Mr. Winston, Thank you for your feedback. We agree that a pump around system may not be fully practical given the drainage area and flow of Hominy Creek. A revision to the previously submitted plan set has been made to indicate that construction activities may need to occur in the active channel. Whenever possible, the contractor shall limit equipment time spent in active flow, This will be accomplished by staging all required materials adjacent to the work area to minimize dwell time, utilizing native cobbles to construct coffer dams to shunt active flow away from the work area and building from the banks where practicable. The Division has determined that your application is incomplete and cannot be processed. The application is on-hold until all of the following information is received: 1. The project plans and description indicate that a pump around system will be used to divert stream flow during constriction. This section of Hominy Creek drains approximately 15.5 square miles, and the Division is concerned that a pump around system will not be adequate to divert flow around the disturbed area. Please confirm that the stream’s drainage area and flow rate have been taken into consideration when proposing a pump around system or provide details for an alternative diversion method. [15A NCAC 02H .0506(b)(2)] Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide your response by January 12, 2024. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and appropriate fee. Please let me know if you have any questions.
