The following are our responses to the requested information following a virtual meeting on December 21, 2023 between WithersRavenel and the USACE: A. Permits for work within wetlands or other special aquatic sites are available only if the proposed work is the least environmentally damaging, practicable alternative. Please furnish information regarding any other alternatives, including upland alternatives, to the work for which you have applied and provide justification that your selected plan is the least damaging to water or wetland areas. A less environmentally damaging alternative appears possible than your Preferred Alternative. Specifically, provide and evaluate a design that realigns the interior peripheral road and any other proximate infrastructure to avoid the wetland in its entirety. Please update your plans and impact proposals for this Alternative accordingly or provide specific information to justify that such measures are not practicable. (i.e., available and capable of being done after taking into consideration cost, existing technology, and logistics in light of overall project purposes). Several on -site alternatives were evaluated with various designs of the internal peripheral road (see attached Alternative Site Layouts - Options 1-4). The primary centrally located entrance to the site to be used by large trucks has remained the same throughout all iterations of the site plan because this entrance location is set by DOT requirements and cannot be changed. Due to the location of the central entrance, avoiding Wetland A in its entirety is not possible due to the wetland's location near the required road entrance. Early site designs did not separate non-commercial traffic from heavy equipment and truck traffic. Your Success. transport trucks for safety purposes. The separate entrances allow for a freer flow of tractor trailer traffic into the site to avoid tractor trailer traffic backing up into N. Greenfield Pkwy and impeding traffic flow. Internal roads meant for heavy equipment and trucks are wider (30) with specific radii to allow for tractor trailers and other equipment to navigate the site. All previous iterations of the site design impact Wetland A. The internal peripheral road network in the final design is somewhat simpler than some previous versions. In order to make the site feasible to become the new Gregory Poole headquarters, it is necessary to impact Wetland A with the internal road and other infrastructure including required gravel lay -down areas. Additionally, the site layout could not be modified to avoid impacts to Wetland A entirely by having the access road extend into the site west of Wetland A and move the buildings entirely out of the wetlands because it would have required that the main building be split into two multiple buildings. The large building shown in the proposed site plan is necessary for the logistics of the operation of the Gregory Poole facility. This facility is intended to be both the main office and support all services/activities necessary for sales and maintenance of equipment. The single large building will house the machine repair areas, parts warehouse and loading dock. Due to the large size of the equipment to be repaired and assembled, separate buildings would require the equipment and parts to be moved between the separate buildings, resulting in interaction between forklifts/equipment with tractor trailers making shipments/exports. This creates a safety hazard and makes the operation of the facility extremely inefficient. Additionally, it exposes new parts to inclement weather during transport from separate buildings. Furthermore, avoiding Wetland A entirely would reduce the total gravel laydown area, resulting in insufficient laydown area for the facility, rendering the site unfeasible for the operation of the facility. B. It is necessary for you to have taken all appropriate and practicable steps to minimize losses of Waters of the U.S., including wetlands. Please indicate all that you have done, especially regarding development and modification of plans and proposed construction techniques, to minimize adverse impacts. Although the project description indicates that the proposed wetland impacts result from lay - down yards, project plans appear to show that at least half of the proposed wetland impact would result from truck loading areas. Could these facilities be relocated to the "Secure Storage Area" designed directly to the north or another area on -site to minimize proposed wetland impacts? Please update your plans and impact proposals for this Alternative accordingly or provide specific information to justify that such measures are not practicable. ii. It appears that proposed wetland impacts to the south of the interior peripheral road could be avoided while only losing a small amount of laydown yard area. If such minimization is not practical, provide this justification accordingly. The location of the truck loading area and Secure Storage Area are tied to the Parts Warehouse which is one of the larger buildings on the site. Your Success. away from the wetland, the relocation of the Parts Warehouse would also be required resulting in a complete reorganization of the site layout. Moving the truck loading area to the Secure Storage Area would require the secure storage area be relocated but again, these two areas are part of the Parts Warehouse and therefore moving either is not feasible. Reconfiguring the site layout would not change the need for large areas of gravel and concrete lay -down areas and the need for a 30' internal road network for large equipment resulting in wetland impacts. As demonstrated in the attached Alternative Site Layouts, no configuration of the site can completely avoid the wetland while maintaining a feasible site layout for Gregory Poole's needs now and in the future. Under a scenario where the site was redesigned to avoid the northern portion of Wetland A, the remnant portion of Wetland A would be indirectly impacted, as the entire drainage area would be graded to drain away from the wetland and into the stormwater management system. The primary source of hydrology for Wetland A appears to be overland runoff. Therefore, the elimination of the drainage area for Wetland A would likely result in Wetland A eventually drying up due to a lack of sufficient hydrology to maintain wetland conditions. And as previously discussed, avoiding impacts to the northern portion of Wetland A results in a site layout that is not feasible for the operational logistics. Site designs that avoided the southern end of the wetland were explored but grading and fill placed around Wetland A would have resulted in indirect impacts to the wetland by preventing recharge from overland flow events. Options to recharge the wetland through stormwater drainage were evaluated, however, there is an existing approved Stormwater Management plan for the larger commercial subdivision that included this parcel, and the design is largely based on the previously approved Stormwater Management Plan. Efforts to route stormwater drainage to Wetland A to maintain the hydrology were not feasible because swales within the gravel storage areas would present a safety issue for moving equipment. Additionally, surface drainage directed through the gravel areas would undoubtedly pick up sediment, other debris and potentially pollutants (oil, hydraulic fluid, diesel fuel, etc.) which would result in sedimentation of the remnants of Wetland A and potential pollution of downstream waters. Ultimately it was deemed to not be feasible to avoid the southern end of the wetland because grading around the wetland would have prevented overland flow and wetland recharge, therefore the decision was made to impact this part of the wetland to increase the amount of lay down area. Without a source of overland flow to recharge the wetland, it is not possible to keep this section of wetland in the post developmental condition. Page 3 of 4 ::WithersRavenel Our People. The U.S. Army Corps of Engineers, Wilmington District (Corps) advertised your proposal by public notice dated September 29, 2023. Comments in response to the notice were received from agencies including the North Carolina Department of Natural and Cultural Resources (NCDNCR), United States Environmental Protection Agency (USEPA), and Catawba Indian Nation; the comments received are enclosed for your information. No comments from the general public or other organizations were received. Note that the NCDNCR, in a letter dated October 2, 2023, stated that they are aware of no historic resources which would be affected by the project, and concur with the assessment that no historic properties would be affected. The USEPA, in an email dated October 13, 2023, stated that they had no comments or concerns with the project as presented. The Catawba Indian Nation, in a letter dated November 17, 2023, stated that they "have no immediate concerns with regard to traditional cultural properties, sacred sites or Native American archaeological sites within the boundaries of the proposed project areas. However, the Catawba are to be notified if Native American artifacts and / or human remains are located during the ground disturbance phase of this project." Further, on February 6, 1990, the Department of the Army (DA) and the U.S. Environmental Protection Agency (EPA) signed a memorandum of agreement (MOA) establishing procedures to determine the type and level of mitigation necessary to -2- comply with Clean Water Act (CWA) Section 404(b)(1) Guidelines. This MOA provides for first, avoiding impacts to waters and wetlands through the selection of the least damaging, practical alternative; second, taking appropriate and practical steps to reduce impacts on waters and wetlands; and finally, compensation for remaining unavoidable impacts to the extent appropriate and practical. To enable us to process your application, in compliance with the MOA, we request that you provide the following additional information: A. For this project, the applicant proposes to mitigate for 0.102 acre of permanent wetland impacts at a 2:1 mitigation to impact ratio, by procuring 0.21 riparian non-riverine wetland credits from a mitigation bank with available in -kind credits in HUC 03020201.
