Fifth Credit Release (Monitoring Year 3 Completion)
Dear Mr. Tugwell:
This correspondence is in reference to the Daniels Creek Mitigation Site, part of the Middle Cape Fear Umbrella
Mitigation Bank. The 56.144‐acre site is in the Cape Fear 04 Cataloging Unit (03030004), north of the
intersection of Seminole Road and US 421, in Harnett County, North Carolina. The purpose of this letter is to
request the fifth release of credits (Year 3 Monitoring Complete) for the mitigation Site.
Monitoring Year 3 (MY3) Site assessments were conducted between January 2023 and December 2023. Overall,
the Site is in good condition and functioning as intended. Forty‐three out of 45 vegetation plots met the MY3
interim stem density requirement and all 45 are on track to meet the final success criteria. A 9.49 acre
supplemental planting took place in February 2023. Supplemental stems have shown a high rate of survival
through their first growing season and were successful in boosting stem density. Invasive vegetation has been
treated and additional treatment may be necessary during future monitoring years. Visual assessment and
geomorphic survey indicate that project streams are stable and well‐functioning aquatic resources. Bankfull
events were observed on 3 of the 6 subject streams. Each intermittent stream has recorded greater than 30
consecutive days of flow during each monitoring year to date. Twelve out of 18 groundwater monitoring wells
achieved the hydroperiod success criterion during MY3. An additional well was installed in the beginning of MY3,
which also met the criterion. Abnormally dry precipitation conditions likely contributed to many of the seven
groundwater gauges recording hydroperiods below 13%. Wildlands proposes exploring areas on‐site not
currently generating wetland credit where wetland restoration credit might be gained to offset potential losses
from groundwater wells that are not performing as anticipated. No easement encroachment occurred during
MY3. All easement crossings are in good condition, stable, and provide access to adjacent agricultural areas
while excluding livestock and prohibited activities.
Pursuant to the Umbrella Mitigation Banking Instrument and the site‐specific Daniels Creek Mitigation Site Final
Mitigation Plan, successful completion of MY3 activities and demonstration that interim performance standards
are being met for all parcels within the bank grants ten percent (10%) of the mitigation site’s total stream
mitigation credit and fifteen percent (15%) of the site’s total riparian and non‐riparian wetland credits be
available for sale. Therefore, we are requesting 1,202.4 stream credits (SMUs), 2.088 riparian wetland credits,
and 0.059 non‐riparian wetland credits be released.

Wilmington District Mitigation Bank Credit Release Schedule
4 ‐ A 10% reserve of credits to be held back until the bankfull event performance standard has been met.
1 ‐ The first credit release milestone is based on the potential credits stated in the approved mitigation plan.
2 ‐ The first credit release shall occur upon establishment of the mitigation bank, which includes the following criteria:
1) Execution of the MBI or UMBI by the Sponsor and the USACE;
2) Approval of the final Mitigation Plan;
3) Mitigation bank site must be secured;
4) Delivery of the financial assurances described in the Mitigation Plan;
5) Recordation of the long‐term protection mechanism and title opinion acceptable to the USACE;
6) 404 permit verification for construction of the site, if required.
3 ‐ The second credit release is based on the credit totals from the as‐built survey, and may differ slightly from the credit totals stated in the mitigation plan.

Section 1: PROJECT OVERVIEW
The Daniels Creek Mitigation Site (Site) is in Harnett County near the town of Broadway, North Carolina.
The Site is situated on the boundary of the Piedmont and Inner Coastal Plain physiographic provinces of
North Carolina. Table 3 presents information related to the project attributes.
1.1 Project Quantities and Credits
Mitigation work on‐site includes restoration, enhancement I, and enhancement II of perennial and
intermittent streams along with restoration, rehabilitation, and enhancement of wetlands. Table 1
below shows stream credits by reach and the total amount of stream and wetland credits expected at
closeout.

1.3 Project Attributes
Prior to construction stream and wetland stressors at the Site included livestock access and ditching.
Stream channels were generally incised, unstable, lacking bedform diversity, and lacking adequate
riparian buffers. Agricultural land conditions on‐site had remained consistent since 1992. Beginning in
the early 90’s, much of the Site was converted from timber land to pastureland. Table 3 below and Table
8 in Appendix C present additional information on pre‐restoration conditions.

Section 2: MONITORING YEAR 3 DATA ASSESSMENT
Annual monitoring and site visits were conducted during MY3 to assess the condition of the project. The
vegetation and stream success criteria for the Site follow the approved success criteria presented in the
Mitigation Plan (Wildlands, 2019). Performance criteria for vegetation, stream, and hydrologic
assessment are in Section 1.2 Table 2: Goals, Performance Criteria, and Functional Improvements.
Methodology for annual monitoring is presented in the MY0 Annual Report (Wildlands, 2021).
2.1 Vegetative Assessment
The MY3 vegetative survey was completed in August 2023. Out of 45 vegetation plots, 43 met the MY3
interim requirement of 320 planted stems per acre. While vegetation plots 19 and 23 did not meet the
interim requirement they are still on track to meet the final density criterion with a density of 283 stems
per acre. Vegetation plot 23 would meet the performance standard if tulip poplar (Liriodendron
tulipifera) was counted toward the success criteria. The IRT will be contacted via email to obtain
approval to include tulip poplar toward the success criteria. Fixed vegetation plots exhibited stem
densities ranging from 283 to 647 planted stems per acre, with an average stem density of 378 planted
stems per acre. Random Vegetation plots exhibited stem densities ranging from 405 to 688 stems per
acre, with an average density of 534 stems per acre. Vegetation plots show high diversity with planted
species counts ranging from 4 to 10 within individual plots and a total of 19 across plots. Numerous
desirable volunteers are establishing on‐site, increasing the total species count across plots to 27.
Herbaceous vegetation is abundant across the Site and the riparian habitat is reducing nutrient runoff
from the cattle fields outside the easement and stabilizing stream banks. Refer to Appendix A for
Vegetation Plot Photographs and the Vegetation Condition Assessment Table and Appendix B for
Vegetation Plot Data.
2.2 Vegetation Areas of Concern
During MY1 and MY2, coastal Bermudagrass (Cynodon dactylon) was observed in various locations
throughout the Site and was treated in 2022. Treated areas were then seeded with a native seed mix
and supplementally planted in February 2023. Native herbaceous and woody vegetation are now re‐
established in these areas, as can be seen in photographs included within Appendix A and random plot
stem counts in Table 7b of Appendix B. Coastal Bermudagrass is one of the primary vegetations in the
cattle pastures surrounding the easements and therefore will be monitored and treated as necessary in
future monitoring years.
Areas previously dominated by coastal Bermudagrass experienced high, but localized, stem mortality
during MY1 and MY2. To address this, a supplemental planting occurred within these areas in February
2023. Species planted were those approved in the mitigation plan and baseline monitoring report. In
total, 9.49 acres were planted along portions of Daniels Creek, T3, T4, T5, T7, T9, and T10 (Figures 1.1‐
1.4). The supplementally planted area was less than 20% of the original 54 planted acres. To aid in
supplementally and originally planted stem’s success, ring sprays and soil amendments applied locally
around the base of stems were completed in May 2023 in various locations across the Site (Figures 1.1‐
1.5).
Scattered Chinese privet (Ligustrum sinense), multiflora rose (Rose multiflora), and callery pear (Pyrus
calleryanna) occurrences were treated throughout the Site in MY3 and will be treated as necessary in
future monitoring years.

2.3 Stream Assessment
Morphological surveys for MY3 were conducted in May 2023. All streams within the Site are stable and
functioning as designed. All 25 cross‐sections on‐site show little to no change from design in the bankfull
area and width‐to‐depth ratio. Bank height ratios are less than 1.2. Visual assessments indicate that in‐
stream structures have remained stable. In‐stream vegetation was treated within most restoration and
enhancement I reaches from July 2023 to September 2023. No sedimentation issues were observed
during MY3 and no effect on bank stability as a result of treatment was observed. Vegetation remains
well established on many of the stream banks, providing adequate coverage and protection. Pebble
count data is no longer required per the September 29, 2021, IRT Technical Work Group Meeting. The
IRT reserves the right to request pebble count data and particle distributions if deemed necessary during
the monitoring period. Refer to Appendix A for the Visual Stream Morphology Stability Assessment
Table and Stream Photographs and Appendix C for Stream Geomorphology Data.
2.4 Stream Areas of Concern
Murdannia grew in several stream channels during MY1 and received treatment in MY2. Follow up
treatment occurred within most restoration and enhancement I reaches from July to September 2023
(Figures 1.1‐1.5). Live stakes were also planted along stream banks site‐wide, where necessary, during
the winter of 2023 to shade in‐stream vegetation. Additionally, Murdannia was treated within
headwater wetlands in September 2023, followed by the application of a cover‐crop mix of Virginia
wildrye (Elymus virginicus) and a wetland species mixture consisting of Panicum rigidulum, Bidens
aristosa, Helianthus angustifolius, Carex albolutescens, Juncus effusus, Carex lupulina, Rhexia mariana,
and Carex vulpinoidea. These were added to headwater wetlands to increase beneficial plant
competition with invasive species. Due to Murdannia’s ability to reproduce via fragmentation and
transport downstream, it is believed that controlling populations in headwater wetlands will reduce
quantities in downstream waters. While corrective action over the monitoring period has shown
effective in reducing the degree of Murdannia within stream channels, Wildlands recognizes that
multiple treatments are typically needed for effective invasive plant control. Murdannia treatment has
not appeared to show any negative effects on stream bank stability or vegetative conditions across the
Site. The Site will continue to be monitored and invasive species will be treated as necessary.
Beaver activity was observed during MY3 on Daniels Creek beginning in May 2023. Beaver were trapped
and dams were removed in May, and once again in November 2023 (Figure 1.3). No evidence of long‐
term damage to the stream or surrounding vegetation was observed as a result of beaver activity.
Herbaceous vegetation was either not affected or has grown back in areas which were affected. While
some trees were lost, stem density was high along Daniels Creek and therefore is continuing to meet
success criteria based on vegetation plot data and visual assessments throughout the year. While no
further evidence of beaver has been observed, Wildlands will continue to monitor the Site and take
action as necessary.
2.5 Hydrology Assessment
Bankfull events were recorded on T3 R2, T4 R1, and T8 R2. Bankfull events were not recorded on T1 R4,
T8 R1, and Daniels Creek R4. Daniels Creek Reach 4, T7, and T1 R4, however, experienced a bankfull
event during MY2. While T8 is B‐type channel and floodplain interaction is not an integral aspect of this
stream type, an additional crest gauge was added further downstream, where events were more likely
to occur given that T8 is a headwater stream. Two bankfull events were observed on T8 R2 during MY3.
The presence of baseflow must be documented on intermittent reaches (T1 R1, T2 R1, T5 R2, and T8 R1)
for a minimum of 30 consecutive days during a normal precipitation year. All flow gauges were well
above the performance criteria during MY3 with flow ranging from 53 to 222 consecutive days. Flow

was also observed in these channels during visual assessments that were conducted throughout the
year. Refer to Appendix D for hydrologic data.
It is worth noting that as of December 9th, the annual precipitation total is approximately 10 inches
below the 30th percentile value obtained from the Agricultural Applied Climate Information System
DUNN 4 NW, NC WETS table (ACIS, 2023). Additionally, according to the National Integrated Drought
Information System, Harnett County experienced abnormally dry conditions at the end of March and
beginning of April 2023 (NOAA, 2023). Abnormally dry conditions re‐occurred through much of August
and November (NOAA, 2023). Approximately 80% of Harnett County also experienced moderate
drought in mid‐November. Overbank events might have been affected as low precipitation reduces soil
moisture in the floodplain, which promotes infiltration and reduces discharge in the channel. These
processes may have led to not observing an overbank event on T7, T1, and Daniels Creek during MY3.
2.6 Wetland Assessment
Nineteen groundwater gauges were installed to monitor the hydrology in wetland re‐establishment and
rehabilitation areas. Groundwater gauge 19 was installed in a jurisdictional wetland, as requested by the
Army Corps of Engineers, but is not tied to performance criteria. This wetland is influenced by hydrology
of an adjacent, uphill, seep wetland. Wetland restoration areas within the Site are typically bottomland
hardwood forest or headwater forest wetlands that do not experience the same hydrologic influence
from adjacent seep wetlands. Therefore, Wildlands believes this wetland area may not be
representative of the restored wetland areas on‐site.
As stated in the Mitigation Plan, the growing season dates at this Site are March 1 to November 20. Soil
temperature probes and observation of bud burst were not used during MY3 to corroborate the
beginning and end of the growing season, as growing season dates are fixed for the Site. To meet the
success criterion, gauges must show groundwater within 12 inches of the soil surface for 13% of the
growing season (i.e., 35 consecutive days).
Twelve of the 18 groundwater gauges held to performance standards attained the success criterion for
MY3. An additional well (groundwater gauge 20) was added at the beginning of MY3, which also met the
criterion. Overall, groundwater hydrology across the Site was affected by relatively low antecedent
precipitation during February 2023 and overall dry conditions throughout the year. The annual
precipitation total was close to 10 inches below the WETS table 30th percentile value for rainfall
accumulation up to the beginning of December. Also, as stated in Section 2.5, Harnett County
experienced abnormally dry conditions toward the end of March and beginning of April 2023 (NOAA,
2023). Abnormally dry conditions re‐occurred for much of August (NOAA, 2023). Additionally, 30‐day
cumulative totals indicated below normal precipitation through February and portions of March. Due to
these conditions, Wildlands believes additional seasons of water table observations and additional
groundwater gauges are required to better understand hydrology at the Site and thoroughly evaluate
the success of wetland restoration areas.
Gauges 1, 5, 7, 8, 10, 11, and 17 did not meet the performance standard during MY3. The groundwater
table would have been within 12 inches for 35 consecutive days at groundwater gauge 11, however, the
water table dropped below 12 inches for 36 hours, which brought the consecutive days meeting criteria
down to 26 days. Groundwater gauges 1, 5, 7, 8, 10, and 17 had a groundwater table consecutively
within 12 inches of soil surface for less than 5% of the growing season. An additional groundwater gauge
will be installed within the same wetland restoration area as groundwater gauge 1 in the upcoming
winter of 2024 to gather more information. While groundwater gauge 5 did not meet criteria in MY3, it
exceeded criteria in MY2, and therefore Wildlands does not intend to install another groundwater gauge
within this area. Groundwater gauge 20 was installed during MY3 to investigate more of the wetland

restoration area surrounding groundwater gauges 7 and 8. This gauge met the criterion, and another
groundwater gauge will be installed on the left side of T4 to further isolate the surrounding area which is
not meeting the performance criterion. An additional groundwater well near gauge 17 will also be
added to isolate the surrounding area which is not meeting performance standards.
Wildlands proposes exploring areas on‐site not currently generating wetland credit where wetland
restoration credit might be gained to offset potential losses from groundwater wells that are not
performing as anticipated. Figures 1.2‐1.5 display proposed groundwater well locations for areas which
might meet the wetland hydroperiod criterion that were not originally proposed for wetland restoration
crediting.
2.7 Monitoring Year 3 Summary
Out of the 45 vegetation plots, 43 exceeded the MY3 interim requirement of 320 planted stems per acre
and all 45 are on track to meet the final success criterion. Overall diversity has remained high across the
Site and planted stems have shown good growth in their third growing season. A supplemental planting
took place in February 2023 to replace stems lost due to coastal Bermudagrass competition and ensure
the rest of the Site is on track to meet the final success criterion. This planting was successful in boosting
stem density. Scattered invasives treatments also took place in MY3 and will be treated as necessary in
future years. Areas with coastal Bermudagrass which were treated in 2022 have recovered, with native
herbaceous vegetation and trees and shrubs once again established in these areas. Murdannia has been
observed in several stream channels and was treated during MY3. Additional measures including live
stake planting and efforts to control Murdannia in headwater wetlands were also implemented to
further reduce its presence. Visual assessments and cross‐sections show streams within the Site are
stable and functioning as designed. Beavers were noted on‐site and have been removed along with their
associated dams. No long‐term damage to the stream or surrounding vegetation was noted as a result
of beaver activity. Bankfull events were documented on T3 R2, T4 R1, and T8 R2 and greater than 30
days of consecutive flow were recorded on all flow gauges. Twelve out of 18 groundwater gauges met
success criterion. An additional groundwater well was installed in the beginning of MY3, which also met
the criterion. The failure of the 7 groundwater gauges might be attributed to a relatively dry March and
low annual precipitation conditions. Wildlands intends to install additional groundwater gauges within
areas not currently generating wetland restoration credit in an effort to circumvent potential credit loss.
Also, to further investigate the wetland restoration areas represented by groundwater gauges 1, 7, 8,
and 17, additional groundwater gauges will be installed during MY4. Stream crossings are functioning as
intended, fencing is in good condition throughout the Site, and no signs of encroachment were observed
in MY3.
