Thanks for the photo. If we can confirm a 3‐foot maximum riprap installment with a 2:1 slope then this project can be

Do you know the slope of the lake floor at this location? Is it too steep to comply with the 3‐foot maximum riprap 
requirement? Additionally, the riprap is required to be placed at a 2:1 slope.

I answered the questions to joey, it will definitely not be 10' out, it will be 4‐6'.. Here are my answers.. 

1. 175 linear feet to be stabilized 
2. Proposed slope of riprap is 2%. The riprap will be placed along the face of the boulder wall.  
3. Sorry, about that, the riprap will only be 4‐6' waterward. 
4. The dock will be constructed offsite and later placed in the water, securely anchored to posts in concrete on the 
shoreline rather than in the water itself.

Thank you for sending these plans. I would second Joey’s questions below. Regional General Permit 30 authorizes the 
construction of seawalls along Lake Glenville, however Special Condition t. states “Placement of riprap should be 
limited to only that which is necessary to protect existing/new bulkheads. In general, riprap will be placed at the base 
of all bulkheads and will extend a maximum of three (3) feet waterward on a 2: 1 slope. However, in cases of steep 
slopes, a maximum of six ( 6) feet waterward on a 2: 1 slope is authorized provided it complies with the applicable 
shoreline or reservoir management program. All other fill material will be confined landward of bulkheads.” 

As such, the proposal to place riprap extending 10 feet lakeward beyond the boulder wall would not be authorized 
under Regional General Permit 30 without sufficient justification. Please either justify why this extent of riprap is 
required or modify the plans to comply with the permit conditions.

Mr. Mathis, 

On December 20, 2023, the Division of Water Resources (Division) received your application requesting a 401 Water 
Quality Certification from the Division for the subject project. The Division has determined that your application is 
incomplete and cannot be processed. The application is on‐hold until all of the following information is received:  

1. Please provide the proposed length of shoreline that is to be stabilized and include on project plans. [15A 
NCAC 02H .0502(a)(9)] 

2. Please provide the proposed slope of riprap placed in front of the boulder wall and include on project plans. 
Please also clarify whether riprap will be placed along the face of the boulder wall. Please note that riprap is 
required to be installed waterward of a bulkhead, including along its face, to protect aquatic habitat from 
secondary impacts of the bulkhead. [15A NCAC 02H .0502(a)(9); 15A NCAC 02H .0506(b)(3)] 

3. The project proposes to install riprap 10 feet waterward of the boulder wall for stabilization. Projects are 
required to avoid and minimize impacts to surface waters to ensure remaining surface waters continue to 
support existing uses. The shoreline slope does not appear steep enough to warrant riprap extending 10 
feet from the boulder wall when the boulder wall is 6 feet tall. Please explain why riprap must extend 10 
feet from the boulder wall. [15A NCAC 02H .0506(b)(1)]

4. The project description states that the dock will be relocated and reconstructed. Please clarify whether 
pilings will be installed within Lake Glanville and if so, how they will be installed. Please also include these 
pilings on project plans along with details of the installation method. [15A NCAC 02H .0502(a)(4); 15A NCAC 
02H .0502(a)(9); 15A NCAC 02H .0506(b)(2)] 

5. Your application is for coverage under the Division’s General Certification 4502 (GC 4502), which is 
associated with the Army Corps of Engineer’s (Corps’) Regional General Permit 30 (RGP 30). To be eligible 
for coverage under GC 4502, the project must also qualify for the Corps’ RGP 30. Communication with the 
Corps has indicated that the project, as proposed, will not qualify for RGP 30. Please reach out to Shannon 
Healy ([e-mail], 828‐271‐7980, ext. 4233) to determine the Corps’ requirements for 
coverage under RGP 30. [15A NCAC 02H .0506(a); 15A NCAC 02H .0506(b); GC 4502 General Certification 
Coverage] 

Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the 
proper consideration of the application. Please provide your response by January 19, 2024. If all of the requested 
information is not received, the Division will be unable to approve the application and it will be denied as 
incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a 
complete application package and appropriate fee.
