The Oceanaire Subdivision no longer has valid 401 and 404 permits. In addition, the wetland delineation has expired. Mr.
Majewski has hired Charles Riggs to get the wetlands redelineated and submit a new application. At such time that new
401 and 404 permits are issued the site is in violation/non-compliance.
At this time, Lots # 17, 19, 21 and 23 are being built upon. Lots # 17, 19, and 23 have wetland impacts associated with
them. The lots with the wetland impacts associated with them are essentially in violation since they were constructed
under the expired JD and 401/404 permits. Until a new 401/404 permit is issued the division is requesting that the Town
hold the COCl per GS 160A-423 for lots with the wetland impacts.
