Ralph Huff 639 Executive Place, Suite 400 Fayetteville, NC 28305 Subject: Expiration Date Reminder – Less Than 1 Year Fast Track Authorization to Construct Permit No. SWA000064 Roslin Farms West Section 5 Cumberland County Dear Mr. Huff: The Post-Construction Stormwater Fast Tract Authorization to Construct (ATC) Permit SWA000064 for the subject project expires on 01/10/2025. This is a reminder that if the Fast Track ATC permit expires, this project is considered out of compliance and disqualified from the fast track permitting process. Further, North Carolina General Statutes and the Coastal Stormwater rules require sites that have started construction to remain covered under an active post construction stormwater permit. Failure to maintain a permit subjects the owner to assessment of civil penalties. In order to for this site to remain under an active post construction stormwater permit, please proceed with one of the following options: 1. Continue under the ATC by either: a. Completing the project, applying for and receiving the final as-built approval before the ATC expires. Under this option, please be aware that the permit holder and licensed professional are assuming liability that the site and project is compliant and final approval can be given prior to the expiration date. b. Submitting a permit renewal application along with an application fee (per G.S. 143-215.3D) and other submittal requirements a minimum of 180 days prior to this expiration date per Permit Condition 3.d and 15A NCAC 2H.1045(3). The permit renewal form can be found on the Post- Construction section of this website deq.nc.gov/SW or directly at https://deq.nc.gov/about/divisions/energy-mineral-and-land-resources/stormwater/stormwater- program/post-construction-2. If completing the project will take longer than an additional 5 years, it is recommended to consider submitting this project to the standard permitting process to ensure long term compliance and protection of the surface waters while limiting liability. 2. Apply for and receive a permit through the standard permitting process by submitting for review a new application package that includes but is not limited to: a. a new Permit Application Form (SWU-101) b. an application fee (per G.S. 143-215.3D) c. a completed Supplement-EZ form d. a recorded or completed O&M-EZ form e. as-built plans and calculations for any completed SCMs f. the full or partial designer certifications for any SCMs or project areas that have been completed (per Permit Condition 3.c) g. a completed rescission form to be acted upon once the new permit is approved. If construction has not started and there are no longer plans to construct the project such that a permit is no longer needed, please submit a permit rescission request form, which can be found on the Post- Construction section of this website.
